JUDGEMENT AND PROCEEDINGS OF THE CASE BETWEEN MRS.
MARIAM SIKOADE AND CHIEF ISIAKA OLUTOBI GBADAMOSI
OKUREWO
TH
THE HEARING STARTED 11 FEBRUARY, 2020
CLAIMANT: Mrs. Mariam Sikoade
She said she saw some people and pillars on her mother’s farmland at Egan
Along Lagos/Ibadan Expressway. In her claim, she said she was surprised when
she saw the pillars at the farmland and she later went ahead to find out who
trespassed on her mother’s farmland. She said she later got to know that it was
one of her family member that put the pillar on her farmland. She said the
farmland belongs to her Late mother Madam Funmilayo (Olole Osugbo). She
reported that one Mr Sheu son of Abudu Onirokuro was the one that trespassed
on the land in dispute. I will like the council to summon Mr Sheu Onirokuro to
hear his own side of the matter. The matter was adjourned and the palace
ordered the palace messenger to summon Mr Sheu Onirokuro to appear on the
next adjourned date. On the adjourned date Mr Sheu Onirokuro stated that he
never trespassed on any land and that one Chief Isiaka Olutobi Gbadamosi son
of Late Alhaji Abudu Gbadamosi aka Okurewo was the one that he knows to be
working on the land in dispute. The palace adjourned the matter and they sent
the palace messenger to go and invite Alhaji Chief Isiaka Olutobi Gbadamosi to
appear before his Highness Akufon of Idarika on the next adjourned date.
Furthermore, the palace chiefs appointed the Asipa of the palace and four other
chiefs to go and visit the land in dispute and report back to the palace before the
adjourned date. At this point Mrs Mariam Sikoade pleaded with the Idarika
Traditional Council Chiefs and the King to thoroughly investigate the matter
who might have trespassed onto the land that she claimed to be her own so as to
avoid the person not to override her on her mother’s personal land. The matter
was adjourned pending the report of the visitation team to the land and the
appearance of Alhaji Chief Isiaka Olutobi Gbadamosi.
DEFENDANT: ALHAJI Chief Isiaka Olutobi Gbadamosi aka Okurewo
On the adjourned date Alhaji Chief Isiaka Olutobi Gbadamosi appeared and
stated in his defence as follows;
That the land in question belongs to his grandfather Late Chief Janutala
Osinowo, the first Onimale of Oro cult in Iperu Remo. That grandson of
Janutala Alhaji Abudu Gbadamosi (Okurewo) inherited the land in question and
later transferred the inheritance to Alhaji (Chief) Isiaka Olutobi Gbadamosi. He
said before the demise of his father he was farming on the land with his father
during his schools days and that his father arranged for the perimeter survey of
the entire land by a registered surveyor of Waltfield& Associate a licensed
surveyor with the plan number AT/OG/10.322/89 in the year 1989. He
supported his claim by a duly stamped registered survey. Alhaji (Chief) Isiaka
Olutobi Gbadamosi stated that the mother of the claimant Mrs Funmilayo
Okubosa aka Olole Osugbo with his brother Mr Onasanya Okubosa encroached
the land and sold it to one Alhaji Disu Adenuga on the 6 th day of June, 1977.
His father Alhaji Abudu Gbadamosi aka Okurewo summoned both the seller’s
i.e the claimer’s mother and her brother to the families meeting at Imobido
before the elders of the families. The elders of the family warned both Mrs
Funmilayo Okubosa and Mr Onasanya Okubosa not to near the land again and
the sales was voided and they were instructed to refund money back to Alhaji
Disu Adenuga. Then he Alhaji Chief Isiaka Olutobi Gbadamosi supported his
claim by presenting the sales agreement dated 6 th day of June, 1977. Alhaji
Isiaka Olutobi Gbadamosi stated that he migrated to England in the year
January 1990 and unfortunately his father Alhaji Abudu Gbadamosi aka
Okurewo died in April 1990. The land was left unused since his departure to
England 1990 only for him to come back in November 2000 and discovered that
the land has been sold again to one Alhaji (Chief) Fasasi Sanusi aka Chairman.
The defendant approached Alhaji Sanusi and told him that the land he bought
belongs to him and after much deliberations and discussion, he agreed to vacate
the land because he’s been told by some people that he made a mistake by
paying for the land. All the sellers of the land to Alhaji Sanusi are of blessed
memories, they are namely;
1. Late Madam Bintu Alaba
2. Late Mr Raufu Okubosa(Ram Seller) and also Claimant’s brother
3. Late Madam Muibat Alaba
He the defendant supported his claim by presenting the duly signed agreement
by all the vendors and purchasers prepared by Abimbola Adesina esq. of
Abimbola Adesina& Co of Olutayo Chamber 66, old Abeokuta motor road
Agege, Lagos. Furthermore, the defendant stated that the claimant is not known
to the family because she has never attended any of the family meetings nor
participate in any gathering or our annual traditional Oro festival at the Family
compound Orele Imobido Iperu Remo. The defendant stated that he was
surprised that the claimant labelled him as a thug and a Land grabber who is not
known to the family whereas as of today the defendant stated that he is the head
of the entire Orele family and apart from that he is the Chief Olotu Ile (Head of
family) of Orele of Imobido Kingdom Iperu Remo and that the land in question
and the entire family land within his environ is totally under the control of him
the defendant.
After he (the defendant) stated his story the claimant admitted that she never
knew that there is someone of his calibre within the family and that the King
and Akufon Traditional Council should please thoroughly look at the matter and
decide on it without any bias.
Am hereby stating that the second claimant Mr Wasiu Akintoye is never in
anyway or any form a member of Orele Family, his name was imported by the
Claimant for the reasons best known to her.
