Ni WEN a Perea ACT.2005 INTRODUCTION The Disaster Management Act, 2005 was made effective from fi December 23, 2005 for the effective management of disasters and ior matters connected therewith or incidental thereto. DEFINITION: “Disaster” means a catastrophe, mishap, calamity or grave occurrence in any area, arising from natural or man made causes, or by accident or negligence which results in substantial loss of life or human suffering or damage to, and destruction of, property, or damage to, or degradation of, environment, and is of such a nature or magnitude as to be beyond the coping capacity of the community of the affected area; “Disaster management” means a continuous and integrated proces: planning, organizing, coordinating and implementing measures whic Qn necessary or expedient for- (i) prevention of danger or threat of any disaster; (ii) mitigation or reduction of risk of any disaster or its severity or consequences; (ii) capacity-building: (iv) preparedness to deal with any disaster; (v) prompt response to any threatening disaster situation or disaster; (vi) assessing the severity or magnitude of effects of any disaster; SIGNIFICANCE OF DISASTER MANAGEMENT Ci For planning and implementation of disaster plans. +To prevent or mitigate people from disaster-affected areas. To respond and recover from disaster events. Coordination and management of disaster-affected areas. GOVERNING BODIES Ci 1, NATIONAL DISASTER MANAGEMENT AUTHORITY: Is headed by the Prime Minister of India as the chairperson and will have no more than nine members including a Vice-chairperson . >All the members will tenure of five years. >The main responsibility of the NDMA is to lay down the policies, plans and guidelines for disaster management to ensure an effective response in the event of any disaster. 2. NATIONAL EXECUTIVE COMMITTEE Ci To assist the National Disaster Management Authority. Functions of NEC: = Prepare the National Plan to be approved by the National Authority = Coordinate and monitor the implementation of the National Policy = Provide necessary technical assistance to the State Governments and the State Authorities for preparing their disaster management plans in accordance with the guidelines laid down by the National Authority "Monitor the implementation of the National Plan and the plans prepared by the Ministries or Departments of the Government of India Monitor, coordinate and give directions regarding the mitigation an + preparedness measures to be taken by different Ministries or Depar Cy and agencies of the Government. Plan and coordinate specialised training programme for disaster management for different levels of officers, employees and voluntary rescue workers. Advise, assist and coordinate the activities of the Ministries or Departments of the Government of India, State Authorities, statutory bodies, other governmental or non-governmental organisations and others engaged in disaster management. Promote general education and awareness in relation to disaster management. STATE DISASTER MANAGEMENT AUTHOR] Ci A State Authority shall consist of the Chairperson and such number oi other members, not exceeding nine, as may be prescribed by the State Government and, unless the rules otherwise provide, the State Authority shall consist of the following members, namely:— the Chief Minister of the State, who shall be Chairperson, ex officio >Other members, not exceeding eight, to be nominated by the Chairperson of the State Authority >the Chairperson of the State Executive Committee, ex officio Function + = Lay down the State disaster management policy Cy = Approve the State Plan in accordance with the guidelines laid down by ine National Authority = Approve the disaster management plans prepared by the departments of the Government of the State * Lay down guidelines to be followed by the departments of the Government of the State for the purposes of integration of measures for prevention of disasters and mitigation in their development plans and projects and provide necessary technical assistance. = Coordinate the implementation of the State Plan. = Recommend provision of funds for mitigation and preparedness measures STATE EXECUTIVE COMMITTEE Ci The State Executive Committee shall consist of the following membe namely:— “the Chief Secretary to the State Government, who shall be Chairperson, ex officio; “four Secretaries to the Government of the State of such departments as the State Government may think fit, ex officio. FUNCTION:The State Executive Committee shall have the responsibility for implementing the National Plan and State Plan and act as the coordinating and monitoring body for management of disaster in the State. DISTRICT DISASTER MANAGEMENT AUTHO™"** i The District Authority shall consist of the Chairperson and such number « members, not exceeding seven, as may be prescribed by the State Govern d unless the rules otherwise provide, it shall consist of the following, namely.— >the Collector or District Magistrate or Deputy Commissioner, as the case may be, of the district who shall be Chairperson, ex officio; >the elected representative of the local authority who shall be the co-Chairperson, ex officio: >the Chief Executive Officer of the District Authority, ex officio; >the Superintendent of Police, ex officio; >the Chief Medical Officer of the district, ex officio; >not exceeding two other district level officers, to be appointed by the State Government FUNCTION “Prepare a disaster management plan including district response for the district Coordinate and monitor the implementation of the National Policy, State Policy, National Plan, State Plan and District Plan Ensure that the areas in the district vulnerable to disasters are identified and measures for the prevention of disasters and the mitigation of its effects are undertaken by the departments of the Government at the district level as well as by the local authorities NATIONAL DISASTER RESPONSE FORCE: Ci + NDRF is tasked with responding to a threatening disaster or situation similar to it. “NDRF is led by a Director- General appointed by the Central Government. *NDRF has played a major role in rescuing people from many disaster related events. OFFENCES PENALITIES Punishment for obstruction , refuses to comply with any direction given by govt. authority. Imprisonment for a term which dd one year or with fine or both. Punishment for false claim Imprisonment for a term which may extend q two year or with fine Punishment for misappropriation of money or materials, Imprisonment fora term which may extend q two year or with fine Punishment for false warning. Imprisonment for a term which may extend q one year or with fine Failure of officer in duty Imprisonment for a term which may extend cone year or with fine Contravention of any order regarding requisitioning Imprisonment for a term which may extend ‘one year or with fine or both.
