Proposed COMELEC Resolution No. 001-2024

PROPONENT: COMMISSIONER CHARLES WINSTON B. DOLIENTE

RESOLUTION TO ESTABLISH CAMPAIGN FINANCE AND STATEMENT OF


CONTRIBUTIONS AND EXPENDITURES GUIDELINES FOR THE USG-ASG-LSG
ELECTION 2024

WHEREAS, the University Student Government - Commission on Election is


guided by the Omnibus Election Code of 2019, which dictates all election matters within
its prescribed boundaries;

WHEREAS, the USG-COMELEC is committed to upholding transparency and


accountability in electoral processes;

WHEREAS, the 1987 Constitution, Article 2, Section 26, guarantees equal


access to opportunities for public service;

WHEREAS, the Omnibus Election Code of the Philippines (OEC) Art. XI., Sec.
94 provides guidelines for campaign finance and disclosure of contributions and
expenditures;

WHEREAS, there is a need to establish specific regulations tailored to the


university setting while adhering to the principles of the OEC;

NOW, THEREFORE, BE IT RESOLVED BY THE UNIVERSITY STUDENT


GOVERNMENT – COMMISSION ON ELECTION:

Article 1. Campaign Finance Regulations

Section 1. Campaign Spending Limits

a. No candidate shall spend for their election campaign an aggregate


amount exceeding ₱1.50 for every bona fide student within the
constituency where they filed their candidacy.
b. Expenses incurred by political parties shall also be included within
the spending limit.
c. Spending on campaign materials, events, and other campaign-
related activities shall be included within the limit.

Section 2. Permissible Sources of Contributions

a. Contributions to election campaigns are permissible only from bona


fide students or university - recognized organizations.
b. Solicitation or receipt of aid or contribution from any Local,
Provincial, National, or foreign government or entity outside the
university for the purposes of influencing the election is unlawful.
c. Contributions from faculty, staff, administrators, or external entities
are prohibited.

Section 3. Recordkeeping and Reporting

a. All candidates shall maintain detailed records of all campaign


contributions and expenditures.
b. Every contribution received must be issued a receipt, and every
expenditure made must be recorded accurately.
c. Candidates and political parties shall file a full, true, and itemized
statement of all contributions and expenditures not later than seven
days before the day of the election.

ARTICLE 2. ENFORCEMENT

Section 1. The COMELEC shall review Statement of Contributions and


Expenditures (SOCE) forms and investigate potential violations.

Section 2. No person elected to any public office shall assume duties until
they have filed the required statement.

Section 3. Violations may result in penalties, including public reprimand,


disqualification from the election, and ineligibility to hold future office.

ARTICLE 3. EFFECTIVITY

Section 1. This Resolution shall take effect immediately upon its passage
by the Commission on Elections.

BE IT FURTHER RESOLVED, that copies of this resolution be transmitted to the


Office of the University Student Government, the Office of Student Affairs, and all
concerned candidates/parties for their awareness and adherence.
