Taking leave is important because it


promotes good physical and mental of
employees, which ultimately improves people's work-life
balance and reduces unscheduled days off.

Recharged people are less likely to be sick or take


unexpected time off work.

By allowing your team to take leaves, the organization is


showing that it cares about its employees. This means
happier, more loyal employees who are motivated to help
the business achieve its objectives.

However, leave may also mean that the employee is absent. Looking at it in different perspective, an employee
who is always absent may also have a negative impact in the overall wellness of the company regardless of the
reason of the employee.

Laws are in place to avoid scenarios where an employee will not be allowed by the employer to take a leave of
absence for reasons other than the usual sick leave and vacation leave. In this module, prepare to learn about
maternity leave, paternity leave, parental leave for solo parent, and battered woman leave.

B. MAIN LESSON

1) Activity 2: Pre-Printed Content Notes (13 mins)

MATERNITY LEAVE:

According to Section 14-A of the Republic Act No. 8282 or the SSS
Law, a female member who has paid at least 3 monthly
contributions in the twelve-month period immediately
preceding the semester of her childbirth or miscarriage shall
be paid a daily maternity benefit equivalent to 100% of her average
daily salary credit for 60 days or 78 days in case of caesarian
delivery.

The maternity leave shall be extended without pay on account of


illness medically certified to arise out of the pregnancy, delivery,
abortion, or miscarriage, which renders the woman unfit for work,
unless she has earned unused leave credits from which such
extended leave may be charged.

PATERNITY LEAVE:
Republic Act No. 8187 grants paternity leave of 7 days with full pay to all married male
employees in private and public sectors.

Paternity leave is available only for the first 4 deliveries of the legitimate spouse with
whom the husband is living.

Delivery includes childbirth, miscarriage or abortion.

The purpose of paternity leave is to enable the husband to lend support to his wife during
the period of recovery and/or nursing of the newly born child.

Conditions for Entitlement of Paternity Leave Benefits.


A married male employee shall be entitled to paternity benefits provided that:
a. he is employed at the time of delivery of his child;
b. he has notified his employer of the pregnancy of his wife and her expected date of delivery subject to
the provisions of Section 4 hereof; and
c. his wife has given birth, suffers a miscarriage or an abortion.

Non-Conversion of Benefits:
In the event that the paternity leave benefit is not availed of, said leave shall not be convertible to cash.

PARENTAL LEAVE FOR SOLO PARENT:


Republic Act No. 8972 otherwise known as Solo Parents’ Welfare Act of 2000
which took effect on November 28, 2000 grants paid leaves to solo parents.

In addition to leave privileges under existing laws, parental leave of not more than
seven (7) working days every year shall be granted to any solo parent employee
who has rendered service of at least one (1) year. The seven-day parental leave
shall be non-cumulative.

In the event that the parental leave is not availed of, said leave shall not be
convertible to cash unless specifically agreed upon previously. However, if said
leave were denied an employee as a result of non-compliance with the provisions
of these Rules by an employer, the aforementioned leave may be used as a basis
for the computation of damages.

Solo Parent:

Any individual who falls under any of the following categories:


o A woman who gives birth as a result of rape or crimes against chastity, even without a final
conviction of the offender: Provided, that the mother keeps and raises the child;
o Parent left solo or alone with the responsibility of parenthood due to death of spouse;
o Parent left solo or alone with the responsibility of parenthood while the spouse is detained, or is
serving sentence for a criminal conviction for at least one (1) year; The law applies to the spouses
of prisoners, whether or not a final judgment has been rendered, provided they are in detention
for a minimum period of one (1) year;
o Parent left solo or alone with the responsibility of parenthood due to physical and/or mental
incapacity of spouse as certified by a public medical practitioner;
o Parent left solo or alone with the responsibility of parenthood due to legal separation or de facto
separation from spouse for at least one (1) year: Provided, that he or she is entrusted with the
custody of the children;
o Parent left solo or alone with the responsibility of parenthood due to declaration of nullity or
annulment of marriage as decreed by a court or by a church: Provided, that he/she is entrusted
with the custody of the children;
o Parent left solo or alone with the responsibility of parenthood due to abandonment of spouse for
at least one (1) year;
o Unmarried mother/father who has preferred to keep and rear his/her child/children instead of
having others care for them or give them up to a welfare institution;
o Any other person who solely provides parental care and support to a child or children provided
he/she is duly licensed as a foster parent by the DSWD or duly appointed legal guardian by the
court;
o Any family member who assumes the responsibility of head of family as a result of the death,
o abandonment, disappearance or prolonged absence of the parents or solo parent: Provided, that
such abandonment, disappearance, or absence lasts for at least one (1) year.

BATTERED WOMAN LEAVE:

Women employees who are victims as defined in Republic Act No. 9262,
otherwise known as the Anti-Violence Against Women and Their Children Law,
are entitled to a leave of up to ten (10) days with full pay.

The said leave shall be extended when the need arises, as specified in the
protection order issued by the barangay or the court. The leave benefit shall cover
the days that the woman employee has to attend to medical and legal concerns.

In order to be entitled to the leave benefit, the only requirement is for the victim-
employee to present to her employer a certification from the barangay chairman (Punong Barangay) or barangay
councilor (barangay kagawad) or prosecutor or the Clerk of Court, as the case may be, that an action relative to
the matter is pending.

The usage of the ten-day leave shall be at the option of the woman employee. In the event that the leave benefit
is not availed of, it shall not be convertible into cash and shall not be cumulative.
