MEMORANDUM CIRCULAR NO.

JMT -2023-2390

SUBJECT OMNIBUS GUIDELINES ON THE ACCREDITATION, SUPERVISION,


AND CONTROL OF DRIVING INSTITUTIONS, AND THE
STANDARDIZATION OF DRIVER AND CONDUCTOR'S EDUCATION

WHEREAS, pursuant to Republic Act No. 4136, the Land Transportation Office (LTO) is
empowered to issue rules and regulations prescribing the procedure for the examination and
licensing of drivers among others;

WHEREAS, under Executive Order No. 248, s. 1970, the LTO is empowered to exercise control
and supervision over the operations of motor vehicle driving schools and to promulgate rules and
regu lations for the guidance of these institutions;

WHEREAS, the same Executive Order mandates the LTO to receive and pass upon all
applications of such schools to ascertain if their course of study, buildings, classrooms, training
aids, equipment and other facilities conform with the minimum standards as required in the Rules
and Regulations that it has promulgated so as to attain the objectives for which such institutions
are established;

WHEREAS, the mandate of the LTO in the licensing and supervision of motorized vehicle driving
schools was reiterated in Executive Order No. 1011, s. 1985;

WHEREAS , pursuant to Section 23 of Republic Act No. 4136, as amended by Batas Pambansa
Big. 398 and further amended by Republic Act No. 10930, the LTO is directed to promulgate
prerequisites and guidelines before the grant of driver's licenses to ensure that these are issued
only to deserving applicants with sufficient driving skills and knowledge on road safety and proper
road courtesy;

WHEREAS, Section 32 of Republic Act No. 4136, as amended by Batas Pambansa Big. 398 ,
requires the conductors of public utility trucks or buses to obtain a permit or license from the LTO
before being employed by any public service operator;

WHEREAS, the LTO initially issued Memorandum Circular No. 2019-2176 on 05 December 2019
entitled , "Rules and Regulations on Accreditation, Supervision, and Control of Driving Institutions,
and on Standardization of Driver Education," that primarily provides for requirements for the
accreditation of driving schools and driving instructors;

WHEREAS, subsequent thereto, several issuances were promulgated, to wit: Memorandum


Circular No. 2021-2282 (Guidelines on the Accreditation of Online Driving Enhancement Program
Pro viders) , Memorandum Circular No. 2021-2284 (Revised Rules and Reg~lat~ons on .the
Accreditation, Supervision, and Control of Driving Institutions and the Standard1zat1on of Dnver
Education), Memorandum Circular No. 2021-2286 (Revised Guidelines on the Accredit~tio~ of
Online Theoretical Driving Course Providers), Memorandum Circular No. 2021-2293 (~utdeltnes
for the Accreditation of Practical Driving Examination Centers under Memorandum Circular No.
2019-2176), and Memorandum Circular No. 2022-2324 (Guidelines for the Accreditation of
Accredited Driving Schools IT Service Providers);

WHEREAS the rationalization, development and continual improvement of the administrative


framework for the exercise of supervision and control over the operation of driving institutions will
enhance the effectiveness of driver and conductor's education which will eventually redound to
the welfare of the public;
WHEREAS , recognizing the importance of engaging stakeholders in the form ulation of its policies,
th e LTO conducted consultations with driving institutions , other government agencies , and the
general public on 15 September 2022 , 14 December 2022 , and 14 March 2023 as well as
subsequent exchanges of correspondence with the end view of finding lasting solutions to the
difficu lties and challenges faced by the LTO, the driving institution managements, and the
clientele alike;

WHEREFORE , the following consolidated guidelines on the accreditation , supervision and control
of driving institutions , and the standardization o.f driver and conductor's education are hereby
promulgated to improve the quality of driver's education and to ensure that driver's licenses are
issued only to des~rving applicants with sufficient driving skills and knowledge on road safety and
proper road courtesy.

ARTICLE I
GENERAL PROVISIONS

Section 1. Objectives

This Memorandum Circular shall have the following objectives:

A. To establish an accreditation system that ensures and strengthens compliance of driving


institutions with the prescribed education standards on driving instructor's qualifications,
physical sites and facilities, equipment, materials , and other similar requirements prior
to the issuance of an authority to offer or undertake driver and conductor education
programs ;

B. To ensure uniformity of th e ed ucation course components , including topics of instruction


and minimum time requirements , in all accredited driving institutions;

C. To raise the standard of instruction and to develop safety consciousness and positive
driving attitudes with the aim of minimizing the incidence of road crashes ;

D. To recognize the Memorandum of Agreement (MOA) with the Technical Education and
Skills Development Authority (TES DA), other national government agencies , civil society
organizations or non-governmental organizations, academe, business sector, and other
stakeholders as partners in providing uniform, standard, and quality education and
training of drivers and conductors; and

E. To supplement, clarify and accordingly amend certain prov1s1ons of Memorandum


CircularNos . 2021 -22821, 2021 -2284 2 , 2021-22863 , 2021-2293 4 , and 2022-23245 , and
to include recently issued rules and regulations in relation to the operation of driving
institutions, to ensure the efficient implementation of the same.

Section 2. Scope and Coverage

These omnibus guidelines shall cover the accreditation , control , and supervision of driv!ng
institutions and their instructors . In addition , these shall govern the standards fo r the following
cou rses of instruction :

A. Theoretical Driving Course;

Section 3. Definition of Terms

For purposes of this Memorandum Circular and as used herein, the following definitions shall be

Applicant Driver ,- an individual with a valid student driver's permit and who has satisfactorily
completed the Practical D~iving Course (PDC), or holder of a driver's license who is required to
undertake a practical driving examination .

Ass istant Secretary - Chief of the Land Transportation Office (L TO)

Authorized Test Vehicle - a duly registered motor vehicle authorized by the LTO to be used in
practical driving instructions and examinations which specifications shall conform to the
requirements stipulated in this Memorandum Circular. This also includes motor vehicles owned
by Practical Driving Education and Examination Centers (PDEECs) and reported to the LTO for
the practical driving examination.

Automotive Servicing (Engine Repair) NC II - a TESDA qualification which consists of


competencies that a person must achieve to diagnose and repair engine cooling and lubrication
system and intake and exhaust system and diagnose and overhaul engine mechanical system.

Automotive Servicing NC I - a TESDA qualification which consists of competencies that a


person must achieve to perform pre-delivery inspection and periodic maintenance of automotive
parts and components .

Automotive Servicing NC Ill - a TESDA qualification which consists of competencies that a
person must achieve to check, test, replace and repair mechanical, electrical and electronic
control system components of a motor vehicle such as the automatic transmission systems;
engine management system ; steering and suspension systems; to inspect, prepare, install and
service mechanical, electrical and electronic control parts, components, assemblies and sub-
assemblies of LPG Kit to or gas engine light-duty automotive vehicle in accordance with
manufacturer's specifications; to remove and replace auto engine and engine-related system for
repowering the vehicle. It also covers testing and replacing electronic components or devices in
security and engine management systems.

Central Office Driving Institutions Accreditation Committee (CODIAC) - an LTO committee


responsible for the review and evaluation of the submitted application for new and renewal
accreditation of driving institutions and instructors for the approval of the Assistant Secretary.

Competency-based Curriculum on Driving NC II - the enhanced module of TESDA on Driving


NC II where the LTO Theoretical and Practical Driving Course have been incorporated to.

Comprehensive Driver's Education (COE) - a course designed in compliance with Section 27


of the (IRR) of R.A. No. 10930 as a requirement for the initial renewal of the fi ve (5)-year valid ity
driver's license.

Conductor's License (CL) - an authority granted by the LTO to a qualified person to assist the
driver of a public utility vehicle in fare collection and ensure the safety of the passengers or cargo
while the said vehicle is in operation.

Conductor's Theoretical Course (CTC) - a theoretical instruction designed by LTO to be


conducted by the Driver's Education Centers (DECs) as a mandatory requirement for the new
application of Conductor's License.

DEC Lecturer - ~ duly authorized LTO personnel to conduct lectures on Theoretical Driving
Course (TDC), Comprehensive Driver's Education (COE), Driver's Reorientation Course (DRC) ,
and Conductor's Theoretical Course (CTC) under the Driver's Education Centers (DE Cs).

Demerit Points - an arith metical value, specified by integer numbers, assigned to and
accumu lated by a driver-violator for every correspondin g traffic viol ation committed as used in the
Point System .

Driver - any person duly licensed by the LTO to operate a motor vehicle.

Driver's Educ ati~n Center (DEC) - a government driving institution operated by the LTO,
established in every region or province, to offer free courses of instructions for the education of
drivers and conductors.

Driver's License (DL) - the authority in the form prescribed by the LTO granted to a person to
operate a motor vehicle that is either nonprofessional or professional driver's license .

Driver's License Code (DL Code) - the collective code representing the vehicle category or
categories that a licensed person is allowed to operate; previously referred to as Restriction Code
(RC) .

Driver's Reorientation Course (DRC) - a course designed in compliance with Section 14 of the
IRR of R.A. No. 10930 as a requirement for the renewal of a driver's license with at least five (5)
demerit points during the accumulation period ; and with Section 15 as a requ irement for every ten
(1 0) accumulated demerit points or whenever the same violation is comm itted for at least three
(3) times during the validity of the driver's license .

Driving Enhancement Program (DEP) - the seminar designed by the LTO for driver' s license
holders that covers road safety and land transportation laws, rules , and regulations. It includes
the Comprehensive Drivers Education and Driver's Reorientation Course under the Implementing
Rules and Regulations (IRR) of R.A. No. 10930.

Driving Institution (Institution for brevity) - any agency, organization , bu siness entity, private or
public/govern ment, engaged in the conduct of LTO's courses of instruction for the education of
the drivers and conductors.

Driving Institution Portal - a facility of the Land Transportation Management System (L TM S)


used by the driving institutions to transmit certificate of completion in real-tim e.

Driving NC II - TESDA certificate recognized as the equivalent of Practical Driving Course for
DL Codes B, 81 ,' and 82 (Refer to the Supplemental IRR of R.A. No. 10930 Table 1 Drive r's
License Code and Its Equivalent Restriction Codes for the complete definition of DL Codes).

Driving NC Ill - TESDA certificate recognized as the equivalent of Practical Driving Course for
DL Codes BE, C, CE , and D (Refer to the Supplemental IRR of R.A. No. 10930 Table 1 Driver's
License Code and. Its Equivalent Restriction Codes for the complete definition of DL Codes).

Driving (Articulated Vehicle) NC Ill - qualification consists of competencies that a person must
achieve to drive/operate upon highways motor road vehicles classified under LTO restriction
codes 6 up to 8 (DL Codes BE and CE) ; transport heavy goods , liqu ids, and materials over
specified long or short distances; comply with local traffic rules/regulation s and ordinances and
perform minor repairs on the assigned vehicle .

Driving (Passenger Bus/Straight Tru ck) NC Ill - qualificatio n consists of competencies that a
person must achieve to drive/operate buses/straight trucks classified under LTO restriction cod es
3 up to 5 (DL Codes C and D) on highways; transport passengers and/or heavy good s, liquids
and materials over specified long or short distances; comply with local traffic rules/ regulations
and ordinances and perform minor repairs on the assigned vehicle.

Driving School - a private educational institution , duly accredited by the LTO, which is
established, organized , and authorized to engage in the conduct of lectures on Theoretical and
Practical Driving Courses. It may refer to the main school/office or any of its branches . For this

Memorandum Circular, driving school branches shall be treated as entities distinct and separate
fro m their main office and shall be subjected to the same treatment as any other driving school.

Driving School Instructor - an employee of the driving school duly accredited by the LTO as a
theoretical driving course instructor or practical driving course instructor to conduct theoretical
and practical driving courses, respectively.

Driving Skills Rater (DSR) - an employee of the LTO who administers theoretical examination
and practical driving examination to applicant-driver prior the issuance of an appropriate driver's
license.

Land Transportation Management System (L TMS) - a web-based integrated application


established and managed by the LTO that consists of a driver's licensing system (DLS), law
enforcement and traffic adjudication system (LET AS) , motor vehicle registration system (MVRS),
revenue collection; system (RCS), executive information system (EIS) and a front-end LTO public
portal system with online appointment/booking features. The LTMS application is secured by
advanced biomet ·c technology.

Land Transportation Office (LTO) - a sectoral agency of the Department of Transportation


(DOTr) by virtue of Executive Order (E .O) No. 125 and 125A dated 13 April 1987 and E.O No.
226 dated 25 July 1987, tasked to register motor vehicles, issue driver's/conductor's licenses and
permits, enforce transportation laws, rules and regulations and adjudicate apprehension cases.
Further, under Republic Act No. 10930, the LTO is directed to promulgate prerequisites and
guidelines before the grant of driver's licenses to ensure that these are issued only to deserving
applicants with sufficient driving skills and knowledge on road safety and proper road courtesy.

Local Business Tax - a tax imposed by local government units for the grant of privilege of
operating a business within their jurisdictions

Motorcycle/Small Engine Servicing NC II - a TESDA qualification which consists of


competencies that a person must achieve to install and service parts of motorcycle/small engine
and to perform periodic maintenance. Servicing includes inspecting , diagnosing, cleaning and
overhauling of mechanical and electrical parts , components, assemblies and sub-assemblies of
the unit.

National TVET Training Certificate (NTTC) - the authority issued by the Technical Education
and Skills Development Authority (TESDA) to a trainer who is a holder of a National Certificate
(NC), a Trainer Methodology Certificate (TMC) , and Industry Work Experience as may be
provided in Section 3 of the respective Training Regulation.

Nonprofessional Driver's License (NPDL) - an authority in the form prescribed by the LTO
granted to a person to operate a private motor vehicle.

Practical Driving Course (PDC) - the minimum of eight (8)-hour in-vehicle instruction conducted
by LTO-accredited driving institution as a mandatory requirement for the issuance of
nonprofessional driver's license and for additional driver's license codes as may be required under
prevailing LTO rules.

Practical Driving Course Instructor - an employee of a driving school duly accredited by the
LTO to con duct the Practical Driving Course.

Practical Driving Education and Examination Center (PDEEC) - a facility owned or operated
by an individual or group of individuals or entities duly authorized and accredited by the LTO,
designed and established as a venue for the conduct of practical driving courses and practical
driving examination administered by an accredited driving school instructor and DSR,
respectively.

Practical Driving Examination - an in-vehicle assessment administered by the driving skills


rater (DSR) to gauge the driving skills and competence of an applicant-driver prior to the issuance
of an appropriate driver's license.

Professional Driver's License (POL) - an authority in the form prescribed by the LTO granted
to any driver for driving or operating a motor vehicle whether private, government or for hire.

Regional Accreditation Committee (RAC)- a committee constituted in the Regional Office level
to receive and evaluate new and renewal applications for accreditation of driving institutions and
their instructors, and to recommend the same to the Central Office Driving Institutions
Accred itation Committee (CODIAC) for final evaluation prior to the recommendation to the
Assistant Secretary for approval and issuance of Certificate of Accreditation .

Restriction Code (RC) - refers to previous code representing the vehicle category or categories
that a licensed person is allowed to operate.

Retooling Program - a mandatory reorientation seminar conducted for Driving Institution


Instructors prior to the renewal of their accreditation.

Student-driver - a person enrolled in a driving institution undertaking prescribed courses of


instruction to operate a motor vehicle

Student-driver's Permit - the authority valid for a period of one (1) year embodied in a form
prescribed by the LTO granted to a person who desires to learn to operate a motor vehicle when
accompanied by ~ duly licensed driver possessing a driver's license with the appropriate
restriction code/s for the type of motor vehicle to be operated by the student-driver.

Technical Education and Skills Development Authority (TESDA) - is the government agency
tasked to manage and supeNise technical education and skills development (TESD) in the
Philippines.

TESDA Technical Vocational Institutions (TVls) - TESDA private training centers with Unified
TVET Program Registration Accreditation System (UTPRAS)-registered program in Driving NC II
and Driving NC Ill, duly accredited by LTO" as a driving school , to conduct lectures on Developed
Competency-based Curriculum on Driving NC II , and Driving NC Ill. For this Memorandum
Circu lar, TVI branches shall be treated as separate entities from their main office and shall be
treated as any other TVls.

TESDA Technology Institutions (TTls) - the government training centers operated by the
Technical Education and Skills Development Authority (TESDA) with Unified TVET Program
Registration Accreditation System (UTPRAS)-registered program in Driving NC II and Driving NC
Ill , to conduct lectures on Developed Competency-based Curriculum on Driving NC II an d Driving
NC Ill.

Theoretical Driving Course (TDC) - the minimum of fifteen (15) hours of theoretical instruction
designed by the LTO as a mandatory requirement for the application for a Student-driver's Permit.

Theoretical Driving Course Instructor - a driving school instructor duly accredited by LTO to
conduct lectures on Theoretical Driving Course.

Trainers Methodology Level I - a TESDA qualification which consists of competencies a TVET


trai ner performing functions of trainer and assessor must achieve. A TVET trainer is a person who
enables a learner or a group of learners to develop competencies to performing a particular trade
or techn ical work.

Value-Added Tax (VAT) Income Tax - is a form of sales tax. It is a tax on consumption levied
on the sale, barter, exchange or lease of goods or properties and seNices in the Philippines and
on importation of goods into the Philippines . It is an indirect tax, which may be shifted or passed
on to the buyer, transferee or lessee of goods, properties or seNices.

Vehicle Category - refers to motor vehicle category as specified in the Philippine National
Standard on Road Vehicles-Classification and Definition.

ARTICLE II
COURSES OF INSTRUCTION
I

Section 4. Theoretical Driving Course (TDC)

A. A Student-driver's Permit shall only be issued upon completion of the mandatory 15-
hour theoretical driving course (TDC) to be conducted by the LTO or its duly accredited
driving institution, and shall be completed within one (1) month from the start of the
course. The Course Outline for the TDC is attached herein as Annex A.

8. For uniform implementation, an up-to-date version of the TDC module shall only be
downloadrd by the driving institutions nationwide from a cloud-based storage service
authorize9 by the LTO.

C. The classroom instruction shall be comprised of the following topics/fields of study:

1. Background/evolution of land transportation and its role in development;

2. Basic organization and functions of LTO ;

3. Driver's license and motor vehicle registration requirements and processes;

4. Traffic rules and regulations including traffic signs , signals, pavement, markings,
and road right of way;

5. Special laws and administrative issuances related to Land Transportation;

6. HJzard scanning and recognition, and road crash risk reduction;

7. Functions of automotive assemblies and accessories;

8. Cockpit drill and driving maneuvers;

9. Parking techniques such as the three-point turn , parallel , reverse, and angle
PC\rking;

1O. Fuel conservation tips and techniques;

11 . Vehicle safety checks and basic troubleshooting cum practicum;

12. Road courtesy, discipline, anger management, and defensive driving practices;
and

13. Detailed topics/concepts for the safe operation of motorcycles and light motor
vehicles.

D. The driving institution shall enroll the details of the client to the Land Transportation
Management System (L TMS) using the LTMS Client ID to determine the starting date of
the client's TDC . The applicant shall also need to register his/her biometrics before and
after every session for attendance purposes.

E. The driving institution shall provide and maintain an attendance sheet to record the
actual presence of the applicant during the conduct of the face-to-face TDC and Written
Examination or validation using the attached format (Annex B), and should be readily
available for verification, investigation and audit.

F. The conduct of the mandatory 15-hour TDC shall be divided into two (2) sessions which
shall be taken in two (2) separate days. The first session shall be held for seven (7)
hours and the second session for eight (8) hours.

G. The applicant shall need to pass the examination administered after every session. The
TDC final examination, which shall consist of 120 questions with an 80% passing score,
shall be taken personally by the applicant in the authorized classroom of the driving
institution . Applicants who have failed the final examination may retake the same.

H. After the, completion of the course and passing the final required examination, the
applicant shall then be issued a TDC Certificate of Course Completion which shall be
electroni~ally transmitted in real-time to the LTMS though the Driving Institution Portal
following · the forms and biometric sign-off protocol provided in this Memorandum
Circular.

I. Theoretical instruction shall be conducted face-to-face inside the classroom of the


accredited driving institution.

Section 5. Practical Driving Course (PDC)


.
Practical instruction shall cover safe driving techniques through different road gradients and
conditions, densities of traffic, and weather conditions.

A. The practical driving instructions shall not be less than eight (8) hours per driver's license
code applied for. Holders of PDC certificate indicating DL Code 8 or 81 or 82 (light 4-
wheeled motor vehicles with weight categories up to 5,000 kgs) may apply for other DL
code/s under the said vehicle weight category, provided that he/she must pass the
theoretical and practical driving examination administered by the LTO. The applicant
may opt to bring his/her motor vehicle for the practical driving examination of LTO .

B. PDC for light and heavy vehicles shall be conducted for at least two (2) days while the
8-hour PDC for motorcycles (DL Code A and A1) may be conducted in one (1) day,
provided that the student-driver has proven to have already acquired the knowledge
based on the assessment by a practical driving instructor. The course outline for the
PDC is attached herein as Annex C.

C. After the completion of the 8-hour PDC , the applicant shall be issued a PDC Certificate
of Completion which shall be electronically transmitted in real-time to the LTMS though
the Driving Institution Portal following the forms and biometric sign-off protocol provided
in this Memorandum Circular.

D. DSRs may be detailed to driving institutions authorized as PD EEC to administer practical


driving examination , including the operation of a Special Purpose Vehicle , depending on
the performance evaluation of the previous accreditation period. The practical driving
examination administered by the DSR in PDEEC shall be credited to the application for
a driver's license.

E. The licensed driver duly accredited by LTO, acting as an instructor to the student-driver,
shall be equally responsible and liable as the latter for any violation of the provisions of
the R.A. No. 4136 and for any injury or damage done by the motor vehicle on account
or as a result of its operation by a student-driver under his direction.

F. Under rio circumstance shall a driving institution conduct a practical driving course for a
student-driver who has not been issued a Student-driver's Permit.

G. A DL holder is allowed to learn and operate a motor vehicle with a DL Code other than
what he/she is allowed to operate. Provided , that the said holder is accompanied by a
duly licensed driver accredited by LTO as driving instructor, possessing the appropriate
license code for the desired type of motor vehicle.

Section 6. Driving Enhancement Program (DEP)

The DEP shall be conducted in accordance with the following:

A. Comprehensive Driver's Education (COE)

1. Pursuant to Section 27 of the IRR of RA No. 10930, which mandates all holders
of 5-year validity driver's licenses to undergo the CDE on road safety and proper
rqad courtesy upon their first renewal , the COE shall be a mandatory requirement
for the following licensing transactions:

1.1 Plain renewal of driver's license holders that were issued student-driver's
permit prior to 03 August 2020 ;

11.2 REfnewal of driver's license with miscellaneous license transactions (e.g.,


revision of records, additional driver's license code/s, etc.);

1.3 Renewal of expired Philippine driver's license with a valid foreign driver's
license (continuity Philippine driver's license);

1.4 Renewal of driver's licenses with five or more demerit points (in addition
to the completion of driver's reorientation course);

1.5 Renewal of driver's licenses of Overseas Filipino Workers (OFWs) and


Filipinos living abroad in addition to the conditions provided under Section
9.4 .4 of the Supplemental IRR of RA No. 10930;

1.6 Renewal of licenses expired for more than two (2) years in addition to the
requ irements provided under Section 9.4.2 of th e Supplemental IRR of
R.A. No. 10930; and

1.7 Advance renewal for Filipinos with imminent travel out of the country as
provided under Section 12.1 of the Supplemental IRR of R.A. No. 10930.

2. Holders of professional and nonprofessional driver's license (PDL/NPDL) due for


renewal shall undergo the COE Learning Module which consists of six (6) major
topics with a duration of five (5) hours. The course outline for the COE is attached
herein as Annex D.

3. The CDE may be availed from any of the LTO Driver's Education Centers (DECs)
nationwide.

4. The COE can also be accessed online for free anytime through the LTMS Portal
using the driver applicant's account. The E-Learning module accessed via the
LTMS Portal shall be configured in a manner that it cannot be skipped or
bypassed by any applicant before taking the examination component. The
applicant shall be required to access each topic in a pre-defined order. The
timestamp for starting and completing a topic shall likewise be recorded, and that
access to subsequent topics shall be restricted until the time allotted for the
preceding topic has elapsed.

Moreover, all applicants must personally take the CDE Validation Examination
at any LTO District Office (DO), Extension Office (EO), Driver's License Renewal
Office (DLRO), or DEC using the equipment or facility provided by the LTO .
However, in cases where the applicant is technologically challenged or has
difficulty using the available facility, or in LTO offices short of equipment to
access or answer the COE Online Validation Examination , it is the discretion of
the Chief of Office to provide a randomized pen-and-paper test. The pen-and-
paper test sheets shall be signed by the Driving Skills Rater and the Chief of
Office.

5. The CDE Validation Examination shall be administered to test the applicant's


~nowledge on the topics contained in the CDE Learning Module.

6. A designated area within the LTO offices and DECs shall be provided for
applicants who will be taking the Validation Examination .

7. The LTO office administering the COE Validation Examination must employ the
necessary safeguards to maintain the integrity of the examination. The LTO
employee in-charge of the examination must always ascertain the identity of the
applicant .w ho will be taking the test prior to the commencement of the
examination by requiring the presentation of the driver's license or a valid
identification card or document and comparing the photo in the driver's license
or 1.0. with the actual physical appearance of the applicant. After confirming the
identity of the applicant, the LTO frontliner shall generate through the LTO
Internal Portal an onsite accessibility code, which shall be used by the applicant
to access the COE Validation Examination in the LTMS . Provided, however, that
the onsite accessibility code can only be generated after the applicant has
completed the COE Learning Module through any of the authorized modes of its
delivery.

8. In order to pass the examination , the applicant must correctly answer at least
eighty percent (80%) of the twenty-five (25) questions randomly selected from
the bank of questions.

9. The examination shall be administered with a duration of not more than thirty
(30) minutes. The use of cellular phones and any other gadgets , including smart
phones/watches, books and other forms of printed materials and all other similar
items while taking the examination shall be prohibited.

10. After the completion of the course and passing the required examination , the
applicant shall then be issued a Certificate of Course Completion which shall be
electronically transmitted in real-time to the LTMS following the forms and
biometric sign-off protocol provided in this Memorandum Circular.

11 . Applicants and LTO employees involved in cheating and such other anomalous
acts, including such other individuals who collaborated in the commission
thereof, shall be held administratively or criminally liable under Section 23-B of
R.A. No. 10930, if after an investigation they are found guilty of such anomalous
or dishonest acts.

12. The COE shall no longer be required for the renewal of all driver's license holders
that were issued with Student-driver's Permit on or after 03 August 2020, and
those who have renewed to their current driver's license on or after 28 October
2021.

B. Driver's Reorientation Course (DRC)

The Driver's Reorientation Course (DRC) shall be conducted in accordance with Section
14 and 15 of the IRR of R.A. No. 10930:

1. '
Every applicant for the renewal of license to operate any motor vehicle who has
accumulated at least five (5) demerit points shall undergo a mandatory four (4)-
hour DRC to be conducted face-to-face inside the authorized classroom of the
LTO Driver's Education Center (DEC) . The DRC shall be conducted only through
the LTO DEC . The course outline for the DRC is attached herein as Annex E.

lri addition to the completion of the required DRC, a driver due for renewal who
has accumulated ten (10) or more total demerit points shall be required to pass
the automated theoretical examination before he/she may be allowed to renew
his/her driver's license.

The examination may be taken in all LTO offices capable of conducting


theoretical examination. To pass the theoretical examination, the applicant must
obtain at least eighty percent (80%) of the sixty (60) questions randomly selected
from the bank of questions.

2. rv,oreover; a driver who has accumulated at least 1O demerit points, or has
committed the same violation thrice during the validity of the driver's license,
shall undergo an intervention program by completing the module under the DRC
and passing the DRC examination. To pass the DRC examination, the applicant
must obtain at least eighty percent (80%) of the twenty-five (25) questions
randomly selected from the bank of questions.

The DRC intervention program shall be completed within thirty (30) days from
the last apprehension. Failure of the driver to complete the DRC within thirty (30)
days from the date of the last apprehension shall cause the suspension of the
driver's license upon prior notice until the required attendance to the cou rse is
complied with.

After completion of the course and passing the required DRC examination, the
applicant shall then be issued a DRC Certificate of Course Completion which
shall be electronically transmitted in real-time to the Driving Institution Portal of
the LTO LTMS in order to process and settle the applicant's seminar penalty due
to accumulated demerit points .

3. Applicants and LTO employees involved in cheating and such other anomalous
acts, including such other individuals who collaborated in the commission
thereof, shall be held administratively or criminally liable under Section 23-B of
R.A. No. 10930, if after an investigation they are found guilty of such anomalous
or dishonest acts.

Section 7. Conductor's Theoretical Course {CTC)

An applicant for a Conductor's License shall be required to undergo the mandatory eight (8)-hour
Conductor's Theoretical Course (CTC) to be conducted by the LTO DE Cs. Applicants shall also
need to pass 80% of the required examination after the completion of the course to be issued a
CTC Certificate of Completion which shall be electronically transmitted to the LTO LTMS .

The DECs shall schedule the conduct of CTC at least twice a month th rough an appointment
system. No other driving institutio n as identified in this Memorandum Circular is allowed to co nd uct
the CTC unless duly authorized by the LTO .

The course outline for CTC is attached herein as Annex F.

ARTICLE Ill
ACCREDITATION COMMITIEES

There shall be constituted Accreditation Committees at the Central Office and Regional Office
levels for the accreditation and registration of driving institutions, instructors, and administrators.

Section 8. Central Office Driving Institutions Accreditation Committee (CODIAC)

The COD IAC shall be composed of the following:

The COD IAC shall be tasked to perform the following functions and respon sibilities:

A. Accreditation and registration of driving institutions;

B. Accreditation and registration of driving instructors;

C. Registra~ion of driving institution administrators;

D. Monitori~g of driving institutions and instructors;

E. Conduct. of mandatory inspection and review as well as evaluation of the overall


performance of the driving institution;

F. Schedule the conduct of random drug testing to driving instructors at least twice every
year, and require the driving institutions to submit their drug abuse prevention program
in the workplace and related reports;

G. Continu ously provide updated modules for the TDC and DEP for use of the driving
institutions, whenever there are new issuances of laws, rules and regulations concern ing
driving and road safety ; and

H. Resolve cases involving violations of the provisions of this Memorandum Circular.

Section 9. Reg ional Accreditation Committee (RAC)

A Regional Accreditation Committee (RAC) shall be constituted in every LTO Regional Office to
receive and evaluate submitted applications for accreditation.

The RAC shall have primary supervisory and visitorial powers over the accredited driving
institutions within their respective regions or geographic area of responsibility (GAOR). Prior to
the renewal of accreditation, the RAC shall conduct a mandatory inspection and shall review as
well as evaluate the overall performance of the driving school. The RAC may recommend to the
Assistant Secretary, through the CODIAC, the upgrading of driving schools to PDEEC that are in
good standing, without violation and record of suspension for the last accreditation period subject
to compliance with the provisions under Section 11 of this Memorandum Circular.

The RAC shall likewise, to wit :

A. Recommends accreditation and registration of driving institutions and the renewal


thereof;

B. Recommends accreditation and registration of driving instructors and the renewal


thereof;

C. Recommends registration of driving institution administrators an d the renewal thereof;

D. Nom inates regional proctors ;

E. Monitors driving institutions and instructors;

F. Conducts mandatory inspection and review as well as evaluation of the overal l


performance of the driving institution;

G. Conducts hearings, require the submission of a supplemental answer, and submit fact-
finding resolutions in relation to cases of violations of this Memorandum Circular; and

H. Schedules the conduct of random drug testing to driving instructors at least twice every
year, and require the driving institutions to submit their drug abuse prevention program
in the workplace and related reports.

Section 10. Composite Au~it Team

'
A Composite Audit Team co.mprising of members from the Central Office and Regional Offices of
the LTO shall be created to conduct a random and periodic audit of the driving institutions
nationwide and ensure that they comply with the existing laws, rules, and regulations.

The Composite Audit Team shall also be tasked to perform the following functions and
responsibilities:

A. Determine compliance of driving institutions to the existing rules and regulations as


stipu lated in this Memorandum Circular to ensure consistency with the objectives of R.A.
No. 10930;

8. Randomly evaluate submitted requirements of the driving institutions and instructors


during new and renewal of accreditation;

C. Validate reported occurrences of irregularities between driving institutions and LTO


offices;

D. Monitor compliance to the audit findings by the RAC , Regional Internal Audit Staff
(RIAS) , and Commission of Audit (COA);

E. Evaluate the adequacy of system control in the issuance of TDC and PDC ; and

F. Recommend to the Assistant Secretary, through the CODIAC, policy improvement and
appropriate courses of action to strengthen internal controls.

ARTICLE IV
ACCREDITATION OF DRIVING INSTITUTIONS

Section 11. Accreditation of Driving Schools

A. Classification of Driving Schools

1. New Driving Schools - any person or group of persons, natural or juridical , who
intends to establish and operate a driving school, shall file with the Office of the
Regional Director through the RAC concerned , an application , in a form
prescribed by the LTO (Annex G) , containing the prescribed information and
showing compliance with the standard requirements of this Memorandum
Circular. All applications shall be forwarded to the CODIAC for review and
recommendation to the Assistant Secretary for approval.

2. Currently Accredited Driving Schools - driving schools that have already


been established and operating, and which have previously been issued a
certificate to operate shall continue to operate with the remaining period of its
validity subject to its renewal. Existing driving schools operating under a
provisional permit shall be subject to the requirements as defined in the transitory
provisions of this Memorandum Circular.

3. Practical Driving Education and Examination Center (PDEEC) - Driving


Schools that are of good standing or have no record of violations and
suspensions for the last accreditation period with the recommendation of the
RAC are eligible to apply for authorization to operate as PDEEC upon
compliance with Section 11 of this Memorandum Circular. All applications shall
be forwarded to the CODIAC for review and recommendation to the Assistant
Secretary for approval.

B. Documentary Requirements

1. For new driving school applicants:

1.1. Duly accomplished application form (Annex G), under oath and signed
by the owner; .

1.2. Payment of non-refundable application fee amounting to One Thousand


Pesos (P1 ,000.00);

1.3. A certified true copy of the following , whichever is applicable:

1.3.1 For single proprietorship, Certificate of Business Name


Registration frorn the Department of Trade and Industry (DTI) ;

1. 3.2 For partnership or corporation, Securities and Exchange


Commission (SEC) Certificate of Registration and Articles of
Incorporation/Partnership and Board Resolution issued by the
Board Secretary, specifying the name of authorized
representatives who must be an officer of the
partnership/corporation; or

1.3.3 For a cooperative, Cooperative Development Authority (CDA)


Certificate of Registration and Articles of Cooperation and
Board Resolution issued by the Board Secretary, specifying the
name of authorized representatives, who must be an officer of
the cooperative;

1.4 Valid Business Permit;

1.5 Bureau of Internal Revenue (BIR) Registration and Taxpayer's


Identification Number (TIN) ;

1.6 Pre-operating Financial Statement showing that the owner-applicant


shall be in such financial condition as to reasonably expect it to operate
for at least one ( 1) year;

1.7 Bank Certificate or Credit Line in the name of the proprietor of the driving
school in case of sole proprietorship, or in the name of partnership or
corporation, whichever is applicable;

1.7.1 Three Million Pesos (P3 ,000 ,000 .00) for the main office

1.7 .2 One Million Five Hundred Thousand Pesos (P1 ,500,000.00) for
every additional driving school

1.8 Applications of at least one (1) theoretical driving course instructor and
one (1) practical driving course instructor with their documentary
requirements ;

1.9 Location plan and a sketch of maneuvering site;

1.10 Official Receipt (OR) and Certificate of Registration (CR) of the vehicles
registered under the name of the proprietor of the driving school in case
of a sole proprietorship, or in the name of partnership or corporation,
whichever is applicable. For a corporation , motor vehicles registered
under the name/s of the incorporator/s shall not be allowed; and

1. 11 Payment of non-refundable accreditation fee amounting to Five


Thousand Pesos (P5 ,000 .00) ;

2. For renewal of driving schools:

2.1 Duly accomplished application form (Annex H) , under oath and signed
by the owner;

Pesos (P1 ,000.00);

2.3 An audited financial statement prepared by a certified public accountant;

2.4 Valid Business Permit;

12.6 List of accredited instructors with their driver's license number and other
pertinent qualifications; ·

2.7 Official Receipt (OR) and Certificate of Registration (CR) of the vehicles
re~istered under the name of the proprietor of the driving school in case
of a sole proprietorship, or in the name of partnership or corporation,
whichever is applicable; and

2.8 Payment of non-refundable renewal accreditation fee amounting to Three


Thousand Pesos (P3,000.00) . For late renewal, a fee of Five Thousand
Pesos (P5 ,000 .00) .

3. For Practical Driving Education and Examination Center (PDEEC)

3.1 Letter of Intent;

3.2 Recommendation from the RAC to upgrade to PDEEC ;

3.3 Certificate of Accreditation as driving school ;

3.4 Certified picture or diagram of facility and its dimension ;

3.5 Sworn statement that the owner/sis/are not related to any DOTr or LTO
official within the fourth (41h) civil degree; and

3.6 In case of group, the driving schools must show proof of their agreement
to use and maintain a PDEEC or common driving test track.

C. Facilities and Equipment for Driving School

1. Classroom (Main Office and Branches)

1.1 The minimum dimension of a classroom must not be less than twenty-
four (24) square meters. Provided that, a space of not less than one and
a half square meters (1 .5 sq. m) shall be provided for every student to
ensure comfort. Provided further that, the maximum class size shall be
forty (40) students per classroom .

1.2 Classrooms must ensure that ergonomics, anthropometry, thermal


comfort, ventilation, illumination , and acoustics are considered in the
overall layout and design of the classroom.

1.3 Each classroom must have audio-visual materials and display, an


updated set of traffic signs , signals, and pavement markings as described
in the manual of the Department of Public Works and Highways (DPWH)
and other land transportation regulatory agencies. The lateral
dimensions or diameter of each sign must not be less than six (6) inches .

1.4 For students intending to apply for a light vehicle professional driver's
license, the school shall have in the classrooms automotive components
and parts assemblies which may be used as aids in teaching basic
automotive servicing.

1.5 All classrooms used for theoretical instruction must be equipped with a
closed-circuit television (CCTV) system connected with built-in date, time
recordi ng features , with a graphic resolution of at least 5MP.

1.6 All theoretical instructions shall be recorded. The recordings must be:

1.6.1 Stored in an external hard drive or similar storage devices;

1.6.2 Kept for at least six (6) months from the date it was captured ;
and

1.6.3 Always available for inspection by the RAC and the CODIAC at
any possible time during the operation of the driving institution .

1.7 The school shall maintain student records for monitoring and evaluation .
Attendance sheets shall be provided and must always be made available
by the driving institutions for this purpose.

1.8 Driving School Kiosks in malls or registration offices may be established


for marketing purposes only. The driving schools are required to inform
the RAC about the existence or establishment of a kiosk. In no case shall
any course of instruction of the LTO be conducted in the kiosk.

2. Library

Driving school library facilities must have the following reference and reading
materials:

2.1 R.A. No. 4136, as amended, and R.A. No. 10930 - An Act Rationalizing
and Strengthening the Policy Regarding Driver's License by Extending
the Validity Period of Driver's Licenses and Penalizing Acts in Violation
of its Issuance and Application;

2.2 Letters of Instructions, Administrative Orders or Memorandum Circulars


of the Department of Transportation (DOTr) , Land Transportation Office
LTO, Land Transportation Franchising and Regulatory Board (L TFRB) ,
and city/municipal ordinances relative to land transportation and traffic
rules and regulations;

2.3 Latest edition of the Filipino Driver's Manual , Defensive Driving Manual ,
and Automotive Mechanics Manual which must be available for use at
the library ;

2.4 Special laws relative to land transportation, such as:

2.4.1 R.A. No. 87 49 - Philippine Clean Air Act of 1999

2.4. 2 R.A. No . 8750 - Seat Belts Use Act of 1999

2.4.3 R.A. No. 8794 - Act Imposing a Motor Vehicle User's Charge
on All Types of Motor Vehicles and for Other Purposes

3. Practical 'Driving Course (PDC)

The driving institution shall conduct Practical Driving Course and issue PDC
Certificates of Completion for DL Codes that corresponds to their authorized test
vehicle/sonly.

Driving institutions authorized to operate as PDEEC shall issue DL Code/s based


on its compliance to facility requirements and the authorized test vehicles for
each DL Code for practical driving examination. The practical driving
examination administered by Driving Skills Rater (DSR) in PDEEC shall be
credited as practical exam ination result for driver's license code application .

3.1 PDC for Motorcycles/Tricycles

The driving school shall comply with the following :

3. 1.1 Motorcycle test track shall be provided for the conduct of PDC
for motorcycles and tricycles with an area of at least 300 square
meters complete with an obstacle course , standard traffic signs ,
and pavement markings . The obstacle course shall consist of,
but not be limited to, Figure 8 maneuver, Straight Line Riding ,
Cone Serpentine Maneuver, and 30-degree Gradient.

The PDC for motorcycles and tricycles shall strictly be


conducted inside the Motorcycle Test Track. The test track may
be leased provided that a notarized lease agreement shall be
submitted upon application.

3.1.2 The school shall comply with the motor vehicle corresponding
to the following DL Code/s as defined in the Supplemental IRR
of R.A. No. 10930, applied for by each branch.

3.1 .3 Motorcycles and tricycles to be used for practical instruction
shall not be more than seven (7) years of age upon application
for accreditation of the school. The driving institution shall be
required to register another vehicle compliant with the said age
requirement if the vehicles previously registered reached the
age of seven (7) years .

3.1.4 All motorcycles and tricycles shall be roadworthy, operational ,


and currently registered in the name of the proprietor of the
driving school in case of a sole proprietorship, or in the name of
partnership or corporation, whichever is applicable.

3.1.5 The students shall be provided with a motorcycle helmet, safety


gear, and a vest with the markings "CAUTION - STUDENT-
DRIVER" imprinted in it during the practical instruction .

3.2 PDC for Light Vehicles

The driving school shall comply with the following:

3.2.1 The school shall provide a maneuvering site where students


undertake in-car but off-highway driving lessons , including the
development of maneuvering dexterity, prior to major highway
driving lessons. The dimension of the maneuvering site for Light
PDC shall be at least fourteen (14) meters in length and in width
and shall bear standard traffic signs and pavement markings . It
shall only be established within the registered business address
of the driving school.

3.2.2 Driving schools shall comply with the motor vehicle


corresponding to the following DL Code/s as defined in the
Supplemental !RR of RA No. 10930, applied for by each
branch.

Mandatory: DL Code B
one (1) with manual transmission
one (1) with automatic transmission

Optional:
DL Code 81
DL Code 82
DL Code BE

3.2.3 The motor vehicles to be used in the practical instruction for DL


Codes B, B1, B2 and BE shall not be more than seven (7) years
of age upon application for accreditation of the school. This may
be extended up to ten ( 10) years provided that it remains to be
fit for its purpose as assessed annually by the RAC Inspector.
The vehicles shall be modified to include a separate brake pedal
for the instructor which shall be fixed in the vehicle. The driving
institution shall be required to register another vehicle compliant
, with the said age requirement if the vehicles previously
registered reached the age of seven (7), unless the extension
has been granted by the RAC Chairperson .

3. 2.4 All vehicles must be roadworthy, operational, equipped with


front and rear-view dashboard recording cameras, and currently
registered in the name of the proprietor of the driving school in
case of a sole proprietorship, or in the name of partnership or
corporation, whichever is applicable.

3.2.5 All motor vehicles to be used in the practical instruction shall
bear painted markings "CAUTION - STUDENT-DRIVER" in
white capital letters at least eight (8) inches in height with a red
background, and readable from the back of the motor vehicle.
The use of magnets and any other similar detachable materials
for the required markings is strictly prohibited .

3.3 PDC for Heavy Vehicles

The driving school shall comply with the following requirements:

3.3 .1 The school shall provide a maneuvering site for the conduct of
PDC for heavy vehicles with a dimension of at least thirty-one
(31) meters in length and thirty-one (31) meters in width with
complete standard pavement markings . PDC for heavy vehicles
shall only be conducted inside the maneuvering site. The area
may be leased provided that a notarized lease agreement shall
be submitted upon application.

3.3.2 The driving school must have at least one (1) heavy motor
vehicle corresponding to either of the following DL Codes :

3.3 .2.1 DL Code C - Straight Truck;

3.3.2.2 DL Code D - Passenger Bus; or

3.3 .2.3 DL Code CE - Heavy Articulated

These heavy vehicles shall not exceed the age of ten ( 10) years
and may be leased provided that a notarized lease agreement
shall be submitted upon application . The driving institution shall
be required to register another vehicle compliant with the said
age requirement if the vehicles previously registered reached
the age of ten (10) years .

3.3.3 The heavy vehicles shall be roadworthy, operational, equipped


with front and rear-view dashboard recording cameras, and
currently registered in the name of the proprietor of the driving
school in case of a sole proprietorship, or in the name of
partnership or corporation, whichever is applicable.

3.3.4 All motor vehicles to be used in the practical instruction shall


bear painted markings "CAUTION - STUDENT-DRIVER" in
white capital letters at least eight (8) inches in height with a red
background, and readable from the back of the motor vehicle.
The use of magnets and any other similar detachable materials
for the required markings is strictly prohibited.

3.3. 5 The school must submit a detailed course syllabus for the
operation of heavy vehicles.

4. Facilities and Equipment for PDEEC

The facilities for the operation of PD EEC shall be as follows:

4.1 PDEEC for Motorcycle

PDEEC shall provide authorized test vehicles for both DL Codes A and
A 1 for the conduct of practical driving examination by the Driving Skill
Rater (DSR).

For PDEEC , at least 300 square meters is required with a minimum width
of 20 meters. The .PDEEC shall comply with the parking requirement as
provided under Presidential Decree No. 1096 or the National Building
Code of the Philippines, as amended .

PDEEC must have enough area , signage, equipment, and facilities to


perform th e following maneuvers : Serpentin e Maneuver, Left Turn and
Stop in the Box, Cone Weave and U-t urn , Acceleration and Sudden
Braking.

4.2 PDEEC for Light Vehicles

PDEEC shall provide authorized test vehicles for DL Codes B, 81 and B2


for .the conduct of practical driving examination by the Driving Skill Rater
(DSR).

For PDEEC , at least 2,800 square meters is required with a minimum


width of 40 meters and a minimum length of 70 meters. The 2,800 sq . m
shall be inclusive of the 300 sq. m requirement if they offer PDEEC for
mqtorcycle. The PDEEC shall comply with the parking requirement as
provided under Presidential Decree No. 1096 or the National Building
Code of the Philippines, as amended .

PDEEC must have enough area, signage, equipment, and facilities to


perform the following maneuvers : Starting and Stopping; Gear Shifting ;
Left turn; Right Turn ; Traffic Light; Intersection (4-way crossing) ; U-Turn;
Backing; Parallel Parking; Perpendicular Parking; Reverse Parking ;
Diagonal Parking; Uphill Hanging (elevated gradient); Downhill hanging
(declined gradient); 2-point turn; 3-point turn ; Overtaking ; Roundabout;
Pedestrian Crossing ; and Yield (merging lanes).

4.3 PDEEC for Heavy Vehicles

PDEEC shall provide authorized test vehicles for C, D, and CE DL codes


for th e conduct of practical driving examination by the Driving Skill Rater
(DSR).

For PDEEC, at least 3,000 square meters is required with a minimum


width of 50 meters . The PDEEC must comply with the parking
requirement as provided under Presidential Decree No. 1096 or the
National Building Code of the Philippines, as amended .

PDEEC must have enough area, signage, equipment, and facilities to


perform the following maneuvers: Starting and Stopping; Gear Shifting ;
Left turn; Right Turn ; Traffic Light; Intersection (4-way crossing) ; U-Turn ;
Backing; Parallel Parking; Perpendicular Parking; Reverse Parking;
Diagonal Parking; Uphill Hanging (elevated gradient) ; Downhill hanging
(declined gradient) ; 2-point turn ; 3-point turn ; Overtaking; Roundabout;
Pedestrian Crossing; and Yield (merging lanes) .

D. Application for Initial Accreditation

1. The applicant for accreditation as a driving school shall file an application with
the Office of the Regional Director throu gh the Regional Accreditation Committee
(RAC) having jurisdiction over the location of th e driving school using the
prescribed form (Annex G) together with the complete accreditation
requirements and payment of a non-refundable application fee amounting to One
Thousand Pesos (P1 ,000.00) . Applications with incomplete documents shall not
be accepted. The application form may be secured from the RAC Secretariat or
may be downloaded from the LTO website (www.lto.gov.ph) .

2. T e RAC Secretariat shall evaluate the submitted documents and conduct an
inspection of the driving school's facilities, equipment, motor vehicles, and other
requirements as prescribed and in compliance with this Memorandum Circular
w,ithin fifteen (15) working days upon receipt of the complete documentary
requirements . The RAC shall immediately notify in writing the applicant of any
deficiency or nonconformity in the submitted requirements as well as recorded
fi~dings after the conduct of inspection. The applicant shall be given a non-
extendible period of ten ( 10) working days from receipt of the notice to comply
with the findings.

3. Based on th e results of the ocular inspection and evaluation of the application


and documentary requirements, the LTO Regional Director, within a period of
five (5) working days, shall either disapprove the application or endorse the same
together with the approved Inspection Report (Annex I) and payment of the non-
refundable accreditation fee amounting to Five Thousand Pesos (P5,000 .00) to
the LTO Assistant Secretary through the CODIAC for approval and issuance of
a 1certificate of accreditation. The Official Receipt (OR) shall form part of the
documents to be submitted to the CODIAC .

ln 1case of disapproval, the applicant shall be notified in writing stating therein the
grounds why the application was disapproved . Consequently, the RAC shall
forward to the CODIAC within five (5) working days the original complete
application documents including the results of the evaluation and inspection
report and to retain a copy of the submitted documents with the RAC Secretariat.

4. Within five (5) working days from receipt, the CODIAC shall evaluate the
application as to its completeness and compliance with this Memorandum
Circular. The CODIAC Secretariat shall prepare a Certificate of Accreditation
which shall be valid for one (1) year reckoned from the date of payment of the
accreditation fee . The CODIAC Vice Chairperson shall then recommend the
approval of the same to the Assistant Secretary .

In case the CODIAC finds a deficiency or nonconformity in the submitted


requirements , the CODIAC Vice Chairperson shall immediately notify in writing
the applicant, through the RAC, stating the grounds for disapproval.

5. The Assistant Secretary, within fifteen (15) working days upon receipt in his
office , shall approve or disapprove the applications for accreditation as endorsed
by the CODIAC. If the Assistant Secretary failed to do so, the said application
shall be deemed approved provided that all required documents have been
submitted and all required fees and charges have been paid (Sec. 1Oof R.A. No.
11032, otherwise known as the Ease of Doing Business and Efficient
Government Service Delivery Act of 2018) .

6. The CODIAC Secretariat shall register the driving school details to the LTMS
immediately upon receipt of the approved Certificate of Accreditation. The same
Certificate will be forwarded to the RAC for dissemination to the accredited
driving school. No driving school shall operate without having valid certificate of
acc red itation.

E. Renewal of1Accreditation

1. A period of thirty (30) working days is given to the applicant to file for renewal of
accreditation . The last day of filing shall be twenty (20) working days prior to the
expiration of the certificate of accreditation . The driving school shall file with the
Office of the Regional Director concerned, through the RAC , a renewal
application (Annex H) together with the complete documentary requirements
and payment of a non-refundable application fee amounting to One Thousand
Pesos (P1 ,000 .00) . Applications with incomplete documents shall not be
accepted . The application form may be secured from the RAC Secretariat or may
be downloaded from the LTO website (www.lto.gov.ph).

2. The RAC Secretariat shall evaluate the submitted documents and conduct the
rrandatory reinspection of the driving school's facilities , equipment, motor
vehicles, and other requirements within fifteen (15) working days upon receipt of
tpe complete documentary requirements. The RAC shall immediately notify in
vrriting the applicant of any deficiency or nonconformity in the submitted
requirements as well as recorded findings after the conduct of reinspection. The
applicant shall be given a non-extendible period of seven (7) working days from
receipt of.the notice to comply with the findings .

3. Based on the results of the inspection and evaluation of the application and
documentary requirements, the LTO Regional Director, within a period offive (5)
working days, shall either disapprove the application or endorse the same
t9gether with the approved Inspection Report (Annex I) and payment of the non-
refundable renewal accreditation fee amounting to Three Thousand Pesos
(P3 ,000 .00) to the LTO Assistant Secretary through the CODIAC for approval
and issuance of a renewal certificate of accreditation . The Official Receipt (OR)
shall form part of the documents to be submitted to the CODIAC .

In case of disapproval, the applicant shall be notified in writing stating therein the
grounds why the application was disapproved . Consequently, the RAC shall
forward to the CODIAC within five (5) working days the original complete
application documents including the results of the evaluation and reinspection
report and to retain a copy of the submitted documents with the RAC Secretariat.

Pursuant to Section 11 (E)(1) of this Memorandum Circular, a late renewal fee
~mounting to Five Thousand Pesos (P5,000.00) shall be charged upon failure to
file a complete renewal application within the prescribed thirty (30)-day period.

4. Within five (5) working days from receipt, the CODIAC shall evaluate the
application as to its completeness and compliance with this Memorandum
Circular. The CODIAC Secretariat shall prepare a renewal Certificate of
Accreditation which shall be valid for one ( 1) year reckoned from the date of
payment of the accreditation fee. The CODIAC Vice Chairperson shall then
r~commend for the approval of the same to the Assistant Secretary .

In case the CODIAC finds a deficiency or nonconformity in the submitted
requirements, the CODIAC Vice Chairperson shall immediately notify in writing
the applicant, through the RAC, stating the grounds for disapproval.

5. The Assistant Secretary , within fifteen ( 15) working days upon receipt in his
office, shall approve or disapprove the applications for accreditation as endorsed
by the CODIAC . If the Assistant Secretary failed to do so, the said application
shall be deemed approved provided that all required documents have been
~ubmitted and all required fees and charges have been paid (Sec. 10 of R.A. No.
1,1032, otherwise known as the Ease of Doing Business and Efficient
(fovernm~nt Service Delivery Act of 2018).

6. The CODIAC Secretariat shall renew the driving school's accreditation to the
~ TMS immediately upon receipt of the approved Certificate of Accreditation. The
same Certificate will be forwarded to the RAC for dissemination to the accredited
driving school. No driving school shall operate without the possession of any
valid certificate of accreditation .

7. Based on the performance assessment during its last accreditation period and
upon recommendation of the RAC and the CODIAC, a driving institution with
good standing and no record of violation and suspension shall be entitled to a
renewal of accreditation valid for two (2) years.

F. Revis ion of Records

1. The driving school shall file with the RAC concerned an application to change
information concerning its accreditation such as its registered business address,

additional motor vehicle , etc. , and pay a fee amounting to One Thousand Pesos
(P 1,ooo.oq) per revision . .

2. Prior to effecting changes in the business address, the school shall be required
to undergo the mandatory inspection of its facilities. After passing the inspection ,
the school shall submit to the RAC all the documentary requirements
incorporating the new changes in the business address within five (5) days after
effecting such changes .

3. All accreditation requirements incorporating all the new changes in the


ownership or business name shall be submitted to the RAC within five (5) days.
The same shall be submitted to the CODIAC for reporting purposes and for the
issuance of appropriate certificate of accreditation, if necessary. The CODIAC
shall also update the registered information in the LTMS .

G. Re po rtori~I Requirements

The driving school shall submit the following reports to the RAC within five (5) days after
the end of ach mo?th:

1. List of graduates for the month and the dates of their attendance;

2. Summary of transactions for the month:

2.1 TDC

2.2 PDC per DL Code;

3. List of scholarship recipients for the month ;

4. Semestral report on drug tests conducted ; and

5. All other reports as may be required by the RAC.

The RAC srall submit a Consolidated Report to the CODIAC every 15111 of the succeeding
month using the template attached herein (Annex J).

ARTICLE V
ACCREDITATION OF INSTRUCTORS

Section 12. Driving School Instructors

A. General Provisions for Driving School Instructors

1. All driving instructors must be duly accredited by the LTO.

2. There shall be at least one (1) theoretical driving course instructor and one (1)
practical driving course instructor registered per driving school branch .

3. The instructor's accreditation shall be restricted to the driving school branch in


which he or she is affiliated . Instructors are not allowed under any circumstances
to lecture any component of TDC or conduct PDC and upload a Certificate of
Completion through the uploading facility of another branch or another driving
school.

4. The instructor's accreditation shall be valid for one (1) year reckoned from the
payment of accreditation fee . Based on the performance assessment during its
last accreditation period and upon the recommendation of the RAC and the
CODIAC , an instructor with good standing and no record of violation and
suspension shall be entitled to a renewal of accreditation valid for two (2) years.

5. Accredited instru ctors must wear an appropriate company uniform and
identification card while on duty an d while conducting classes or practical driving
lessons. The instructor's certificate of accreditation issued by the LTO must also
be exhibited at all times.

6. Prior to the renewal of accreditation, the driving instructor shall be required to
a~te nd a retooling program . A Two Hundred Pesos (P 200 .00) retooling fee shall
be collected .

B. Documentary Requirements for Initial Application for Accreditation


I
The documentary requirements for accreditation of Theoretical Driving Course Instructor
shall be as follows:

1. Duly accomplished application form (Annex K);

2. Payment of non-refundable application fee amounting to Five Hundred Pesos


(PS00.00) ;

3. Payment of non-refundable examination fee amounting to Two Hundred Pesos


(P 200 .00);

4. A certified true copy of the following :

4.1 Diploma; and

4.2 Valid TE SDA National TVET Trainer's Certificate (NTTC) in Drivi ng NC


II; or

Automotive Vocational Training Certificate and whichever of the following


is applicable;

4.3.1 Valid NC I in Automotive Servicing (for the Theoretical Driving


Course Instructor); or

4.3.2 Valid NC II in Automotive Servicing - Engine Repair (for th e


Practical Driving Course Instructor) ;

5. Trainer's Training Certificate (TESDA Trainer's Methodology I I Method of


Teaching I any equivalent private trainer's training);

6. Copy of valid professional driver's license;

7. Original Certificate of neuropsychiatric test result;

8. Original copy of a valid certification from a DOH-accredited drug testing center


that the applicant has undergone a mandatory drug test, and that he/she is free
from the use of dangerous drugs ;

9. Copy of valid National Bureau of Investigation (NB I) Clearance;

10. Valid Certificate of No Apprehension;

11. b ertificate of Driver's License History; and

12. Payment of non-refundable accreditation fee amounting to One Thousand Pesos


(P1 ,000) .

In addition, the following shall also be submitted for the application for Practical Driving
Course Instructor, to wit:

C. General Qualifications of Driving School Instructors

1. Must be at least twenty-three (23) years of age;

2. Must be a graduate of any four-year course;

3. Must be a holder of a TESDA National TVET Trainer's Certificate (NTTC) in


Driving NC II or an Automotive Vocational Training Course. If an applicant is a
graduate of an Automotive Vocational Training Course, he/she must likewise be
a holder of Automotive Vocational Training Certificate and whichever of the
following is applicable:

3.1 Valid NC I in Automotive Servicing (for the Theoretical Driving Course


Instructor); and

3.2 Valid NC II in Automotive Servicing - Engine Repair (for the Practical


Driving Course Instructor);

4. Must have undergone a Trainer's Training from TESDA I Method of Teaching or


any equivalent private trainer's training;

5. Must be a holder of a valid professional driver's license allowed to operate a


motor vehicle with manual transmission. The DL Code must also correspond to
the vehicle category being offered by his/her driving school. The applicant must
have held a driver's license for the last five (5) years, regardless of when his/her
professional driver's license was acquired.

6. Must not have any traffic violations for the past twelve (12) months prior to
application as an instructor;

7. Must not have a history of suspension or revocation of driver's license for any
cause ;

8. Must take and pass the neuropsychiatric test from a government-accredited


entity ;

9.
.
Must have undergone a mandatory drug test performed by a DOH-accredited
drug testing center, and results must show that he/she is free from the use of
dangerous drugs;

10. Must have passed a written examination given by the LTO; and

11. Must have completed the LTO Trainer's Training for the conduct of TDC.

Additional Qualifications for PDC Instructors:

12. PDC Instructor for motorcycle/tricycle must be a holder of valid TESDA


Motorcycle/Small Engine Servicing NC 11;

13. PJJC Instructor for light vehicles must be a holder of valid NC II in Automotive
SeNicing;

14. PDC Instructor for heavy vehicles must be a holder of valid TESDA National
TVET Trainer Certificate (NTTC) in Driving NC 11, NC Ill in Driving and NC Ill in
Automotive SeNicing; and
I

15. ~ust not ihave been convicted by final judgment of a crime involving moral
turpitude, or of a crime punishable by prison correctional under the Revised
Penal Code.

D. Application for Initial Accreditation

1. An applicant for accreditation as a driving school instructor shall file an


application with the Office of the Regional Director through the RAC using the
prescribed form (Annex K) together with the complete accreditation
requirements and payment of a non-refundable application fee amounting to Five
Hundred Pesos (P500.00). Applications with incomplete documents shall not be
accepted . The application form may be secured from the RAC Secretariat or may
be downloaded from the LTO website (www.lto.gov .ph).

2. The RAC Secretariat shall evaluate the submitted documents as to its


completeness and compliance with this Memorandum Circular within fifteen (15)
working days upon receipt of the complete documentary requirements.

In case of disapproval, the applicant shall be notified in writing stating therein the
grounds why the application was disapproved. Consequently, the RAC shall
forward to the CODIAC within five (5) working days the original complete
application documents including the results of the evaluation and written
examination and to retain a copy of the submitted documents with the RAC
Secretariat.

3. The RAC shall administer the written examination for instructors in accordance
with the following:

3.1 Theoretical examinations shall be administered by the RAC depending


on the number of applicants or as needed;

3.2 The applicant shall pay a fee of Two Hundred Pesos (P200.00) per
examination;

3.3 The qualifying examinations shall be administered by the nominated


proctor of the regional office. The driving school instructor must pass the
written examination by obtaining 85% correct answers;

.3.4 Within three (3) working days from the date of the qualifying examination,
the Regional Proctor shall check the answer sheets and immediately
notify the instructors of the results. The results of the qualifying
examinations shall be uploaded to the LTO LTMS Proctor Facility. The
applicant shall then be issued an Instructor's Qualifying Examination
Certificate after passing the required examination;

3.5 Instructors who failed the first examination shall be allowed to take the
examination to a maximum of three (3) times following the schedule set
by the RAC . After the fourth (41h) failed examination, the applicant shall
be disqualified to apply as an instructor nationwide and shall be issued a
Rejection Letter, a copy of which shall be provided to the CODIAC. The
list of failed examinees shall be uploaded to a viewing facility after every
examination which may be accessed by all Regional Proctors for the
counterchecking of the number of attempts on the same examination ;
and

3.6 For further monitoring and supervision, the Regional Proctors shall be
giv,en a facility under the LTO System for this purpose .

4. Instructors who passed the examination shall undergo the mandatory Trainer's
Training for the conduct of the Theoretical Driving Course which shall be
spheduled by the RAC depending on the number of participants. A Trainer's
Training Certificate of Completion shall be issued by the RAC after the conduct
of the training.

5. After a favorable evaluation, the RAC shall endorse to the CODIAC the complete
accreditation requirements and the proof of payment of the instructor's
accreditation fee amounting to One Thousand Pesos (P1 ,000.00) .

6. Within five (5) working days from receipt , the CODI AC shall evaluate the
application as to its completeness and compliance with th is Memorand um
Circular. The CODIAC Secretariat shall prepare a Certificate of Accreditation ,
and the CODIAC Vice Chairperson shall then recommend for the approval of the
same to the Assistant Secretary.

In case the CODIAC finds a deficiency or nonconformity in the submitted


requirements, the CODIAC Vice Chairperson shall immediately notify in writing
tl:le applicant, through the RAC, stating the grounds for disapproval.

7. The Assistant Secretary, within fifteen (15) working days upon receipt in his
office, shall approve or disapprove the applications for accreditation as endorsed
by the CODIAC. If the Assistant Secretary failed to do so, the said application
shall be deemed approved provided that all required documents have been
submitted and all required fees and charges have been paid (Sec. 10 of the R.A.
No. 11032, otherwise known as the Ease of Doing Business and Efficient
Government Service Delivery Act of 2018).

8. The CODIAC Secretariat shall register the instructor's details to the LTMS
immediately upon receipt of the approved Certificate of Accreditation. The same
Certificate will be forwarded to the RAC for dissemination to the accredited
instructor. No Instructor shall conduct any driving course without the possession
of any valid certificate of accreditation .

9. The RAC, upon receipt of the approved certificate of accreditation, shall notify
the instructor for the biometrics capturing to the LTMS.

E. Documentary Requirements for Renewal of Accreditation

Th e documentary requirements for the renewal of accreditation of Theoretical and


Practical Driving Course Instructor shall be as follows:

1. Duly accomplished application form (Annex L);

2. Payment of non-refundable application fee amounting to Five Hundred Pesos


~P500.00);

3. Copy of valid professional driver's license;

4. Copy of the company ID;

5. Copy of valid National Bureau of Investigation (NBI) Clearance;

6. Valid Certificate of No Apprehension;

7. Previous Certificate of Accreditation ; and

8. ayment of non-refundable retooling fee amounting to Two Hundred Pesos
(1?200.00);

9. Retooling Program Certificate of Completion; and

10. P1ayment c;>f non-refundable renewal accreditation fee amounting to Five Hundred
Pesos (PS00.00). For late renewal , a fee of One Thousand Pesos (P1 ,000.00).

F. Application for Renewal of Accreditation

1. A period of thirty (30) working days is given to the applicant to file for renewal of
a·ccreditation as a driving school instructor. The last day of filing shall be twenty
(20) working days prior to the expiration of the certificate of accreditation. The
applicant shall file with the Office of the Regional Director throug h the RAC a
renewal application (Annex L) together with the complete accreditation
requirements and payment of a non-refundable application fee amounting to Five
Hundred Pesos (P500.00) . Applications with incomplete documents shall not be
accepted.' Moreover, the renewal application of a suspended instructor shall not
be accepted by the RAC unless the said period of suspension has been fully
served. The application form may be secured from the RAC Secretariat or may
be downloaded from the LTO website (www.lto.gov.ph).

2. The applicant shall pay Two Hundred Pesos (P200 .00) for the Retooling
Program which is a mandatory requirement for their renewal of accreditation as
~ driving school instructor to be scheduled by the RAC. A Retooling Program
Certificate of Completion shall be issued after the conduct of the program.

3. The RAC shall endorse the complete documentary requirements and the proof
of payment of the instructor's renewal accreditation amounting to Five Hundred
Pesos (PS00.00) to the LTO Assistant Secretary through the CODIAC for
approval and issuance of a renewed certificate of accreditation.

1h case of disapproval , the applicant shall be notified in writing stating therein the
grounds why the application was disapproved. Consequently, the RAC shall
forward to the CODIAC within five (5) working days the original complete
application documents, including the results of the evaluation and to retain a copy
of the submitted documents with the RAC Secretariat.

A late renewal fee of One Thousand Pesos (P1 ,000 .00) shall be charged from
the instructor for late filing of the renewal of accreditation .

4. Within five (5) working days from receipt, the CODIAC shall evaluate the
application as to its completeness and compliance with this Memorandum
yircular. The CODIAC Secretariat shall prepare a renewal Certificate of
Accreditation and the CODIAC Vice Chairperson shall then recommend for the
approval of the same to the Assistant Secretary.

In case the CODIAC finds a deficiency or nonconformity in the submitted


requirements , the CODIAC Vice Chairperson shall immediately notify in writing
the applicant, through the RAC, stating the grounds for disapproval.

5. The Assistant Secretary, within fifteen (15) working upon receipt in his office,
shall approve or disapprove the applications for accreditation as endorsed by the
CODIAC. If the Assistant Secretary failed to do so, the said application shall be
deemed approved provided that all required documents have been submitted
and all required fees and charges have been paid (Sec. 1O of the RA No. 11032,
otherwise known as the Ease of Doing Business and Efficient Government
Service Delivery Act of 2018) .

6. The CODIAC Secretariat shall renew the instructor's accred itation to the LTMS
immediately upon receipt of the approved Certificate of Accreditation. The same
Certificate will be forwarded to the RAC for dissemination to the accredited

in structor. No Instructor shall conduct any driving course without th e possession
of any valid certificate of accreditation.

7. The RAC may update the captured biometrics of the instructor when necessary.

G. Change in the Type of Accreditation

A driving school instructor may apply for additional or change in the type of their
accreditati0n from theoretical to practical driving course instructor by filing a letter of intent
to the RAC, complying with the requirem~nts specified in Section 12(8), Article V, of this
Memorandum Circular, and paying a non-refundable fee amounting to Five Hundred
Pesos (PS00.00).

H. Change or Instructor's Registered Affiliation

An Instructor who desires to change his/her affiliation, whether from one driving school to
another, o from on~ branch to another branch of the same driving school, shall file to the
RAC having jurisdiction over the driving school where he/she is currently and previously
affiliated , a letter of intent together with the following:

1. Payment of a non-refundable Five Hundred Pesos (PS00.00) for the change of


instructor's registered affiliation ;

2. Val id professional driver's license;

3. Valid Certificate of No Apprehension ;

4. Valid NBI Clearance;

5. Endorsement from the driving school ;

6. Certificate of Accreditation ; and

7. If the transfer is from one driving school to another, a clearance certificate issued
by his/her previous driving school.

Under no circumstances shall a driving instructor be allowed to transfer from one driving
school to another driving school within one (1) year from his/her enrollment in the current
school where he/she is employed. Further, all requests to transfer from one branch to
another branch of the same driving school shall be allowed after six (6) months from
his/her enrollment in the current school where he/she is employed. All requests to change
the registered affiliation shall be forwarded to the CODIAC for approval and issuance of
appropriate certificate , if necessary.

REGULATION OF DRIVER'S EDUCATION FEES

Section 14. Autho·· ity of th'e LTO

The LTO shall alw~ys ens~re d~iver's


the availability of education at reasonable prices without
denying its accredited driving schools a fair return on their investment.

In the absence of ,a statute stating otherwise, the power of the LTO to exercise control and
su pervision over the operations of motor vehicle driving schools and to promulgate rules and
regu lations for the guidance of accredited driving schools , as granted by Executive Order No.
248, s. 1970 and Executive Order No. 1011 , s. 1985, necessarily includes the power to prescri be
fees charged by such institutions. Considering that no other government agency has been vested
with the authority to regulate the driver's education fees charged by private driving institutions,
the power is considered lodged with the LTO so as to properly and effectively discharge its
fun ctions and duties under the law, and to discourage the collection of exorbitant and
un reasonable fees.

Section 15. Prescribed Fees

For purposes of standardization and for the guidance of all concerned , the following amounts are
prescribed as the maximum permissible fees or charges that may be imposed or collected by
private driving institutions:

The above-mentioned fees must not be bundled with other items and services not provided by
th e driving school! such as, but not limited to, medical examination fee, LTO application ,
examination , student-driver's . permit, and license fees . Driving schools may offer promotional
bund les for different driving cou rses and additional hours for the PDC on a pro-rated basis . Th e
receipt must itemize the cost of each driving course included in such promotional bundle as well
as the additional hdurs for PDC , if any . In no case shall the individual prices exceed the prescribed
fees above.

Section 16. Review of Fees

The LTO Assistant Secretary, upon the recommendation of the concerned Reg ional Director, and
in consultation with the concerned stakeholders, may increase or adjust the maximum permissible
fees or charges for driver's education , taking into consideration the followin g factors:

A. Regional Inflation Rate (RIR) as may be determined by NEDA (Prevailing economi c
conditions as shown by various economic indicators such as the consumer price index ,
incidence of poverty);

B. Financial standing of the driving school;

C. Financial capacity of the average driver-applicant;

D. Impact of force majeure or calamities; and

E. Quality tracf record of the driving school.

ARTICLE VII
CERTIFICATE OF DRIVING COURSE COMPLETION

Section 17. Issuance and Contents

After the satisfactory completion by a student-driver of the prescribed driving course, a driving
school shall issue a Certificate of Driving Course Completion to show that he/she has completed
the theoretical an d/or practical instruction.

A. The certificate of completion for the TDC and CTC (Annex M and N) shall contain th e
following : •

1. NJ me, address, logo, and accreditation control number of the issuing driving
institution;

2. Name, signature and accreditation control number of instructor;

3. LliO Client ID of the applicant;

4. Name , address, date of birth, nationality , age, sex, civil status, and electronically
captured picture of the applicant;

5. Certificate Control Number;

6. Date the course has been started and completed ;

7. Total number of hours ; and

8. System-gene rated timestamp indicating the date and time of transmittal.

B. In addition ,. the following shall also be indicated in the certificate of completion for the
Practical Driving Course: (Annex OJ:

9. Student-driyer's Permit Number/Driver's License Number;

10. Training Purpose (New Driver's License/Additional DL Code);

11. DI.'.. Codes applied for;

12. Motor vehicle transmission (Manual or Automatic); and

13. License plate of the motor vehicle used for practical instruction.

C. On the othe r hand, the following shall also be indicated in the issuance of a COE and DRC
certificate of completion: (Annex P and Q) :

1. L10 logo or letterhead of the regional office;

2. Name and ,s ignature of DEC lecturer;

3. Client ID of the applicant;

4. Name, address, date of birth, nationality, age, sex, civil status , and electronically
captured picture of the applicant;

9. Training purpose (COE or DRC); and

10. System-generated timestamp indicating the date and time of transmittal.

D. T he system shall provide a summary of reports for TDC , PDC per DL Code , CDE , CTC ,
and DRC, issued by each driving institution branch , region , per month, per day format
following the template attached herein as Annex J.

Section 18. Interconnectivity and Monitoring

A. Profiles of driving institutions and instructors shall be registered to the LTMS .

B. The Certificate of Course Completion as mentioned in Section 17 of this Memorandum


Circular shall be electronically transmitted in real-time to the LTMS through the Driving
Institution (DI) Portal.

C. A biometric1sign-off of the driving instructor/s who conducted the driver education shall be
required prior to the electronic transmission of the Certificate of Driving Course Completion
with the approval of the driving institution administrator. The date and time of transmittal
of certificates shall be indicated in the Certificate of Completion.

In addition, the uploading of Certificates of Completion to the L TO System shall be limited


to a pre-determined number of uploads every week. The formula for the computation of
the maximum uploads for Certificates of Completion of the TDC shall be as follows:

lllustrativ~ example:
A driving school has 2 driving instructors for TDC and has 1 classroom having a floor area
of 36 sq. m. The said driving school holds its TDC lectures in 3 batches per week (Monday
and Tuesday, Wednesday and Thursday, Friday and Saturday; 8 AM to 12 NN and 1 PM
to 4 PM on the first day, and 8 AM to 12 NN and 1 PM to 5 PM on the second day).

As such, the driving school's maximum weekly limit for TDC shall be 72 uploads based on
the following computation:

The system shall only allow uploading of TDC Certificates every Monday to Saturday. The
system shall deny the uploading after the maximum weekly cap has been reached.

1. The LTO system shall limit the number of PDC Certificates of Completion fo r DL
Codes A and A 1 to five (5) uploads per day for every authorized motorcycle or
tricycle per instructor, per branch whichever is lower.

D. Driving schools shall be required to have the IT equipment and facilities necessary for the
successful transmission of the Certificates of Course Completion using the DI Portal.

E. The main office of a driving institution and any of its branches shall be treated as separate
entities. The uploading facility of the main office shall not, in any manner, be connected to
any of its branches.

F. The CODIAC and RAC shall monitor, evaluate and give performance ratings to driving
schools based on the previous operations and community relation s. The system shall
provide the CODIAC and RACs with the report of the applicants who have failed th e LTO
theoretical examination and practical driving test.

ARTICLE VIII
MISCELLANEOUS PROVISIONS

Section 19. Drug-Free Workplace

The driving institution, regardless .of the number of employees, shall develop and implement a
drug abuse preven ion program in the workplace. The said program shall include the adoption of
company policies against drug use in the workplace, a drug testing and rehabilitation program,
and policies on work resumption .

Employers shall re~uire all their driving instructors to undergo drug testing at least twice every
year with the preserce and supervision of a RAC representative. For this purpose, the RAC shall
schedule when the random drug test will be conducted. The driving institution shall bear all the
expenses for drug testing. To ensure the safety of students , driving instructors who test positive
for drug use shall not be allowed to perform their duties and functions. Strict confidentiality shall
be observed with regard to the testing and the test results . Driving institutions shall submit the
resu lts to the RAC within three (3) days from their receipt.

Section 20. Corporate Social Responsibility

Driving institutions shall institute a scholarship program for indigent and deserving students as
part of its community road safety advocacy. For every twenty (20) graduates of a particular driving
course, the covered driving institution must give a free driving course of the same kind to at least
one ( 1) qualified individual. The selection of recipients shall be based on clear criteria set by the
covered driving institutions. A list of recipients shall be submitted to the RAC every month .

Section 21. Conduct of Outreach Program

Outreach programs shall only be conducted by the LTO Driver's Education Centers (DECs) and
TESDA Technology Institutions (TTls) free of charge.

Section 22. Com~liance v.rith Other Related Laws, Rules, and Regulations

It shall be the duty 1of the duly-accredited institutions to comply with this Memorandum Circular
and other rules and regulations, laws, and policies in relation to their operations, such as but not
limited to the following:

A. Provision of educational assistance to senior citizens to pursue techni cal education by


providi ng scholarships , subsidies , financial aid , or grants under R.A. No. 9994 (Expanded
Senior Citizens Act of 201 O);

8 . Provision of access to quality education and ample opportunities to develop their skills
under R.A. No. 7277 (Magna Carta for Disabled Persons) for persons with disabilities who
may be per itted to operate motor vehicles;

C. Protection of clients' personal information under R.A. No. 10173 (Data Privacy Act of
2012) ;

D. Prohibition against "fixing" under R.A. No. 11032 (Ease of Doing Business and Efficient
Governmen Service Delivery Act of 2018);

E. Adoption of zero-tol~rance policies on gender-based sexual harassment in business

establishments and posting of hotline numbers in bold letters of designated anti-sexual


harassment officers of the driving institutions under R.A. No. 11313 (Safe Spaces Act) ;
and

F. Ru les and regulations under local ordinances not inconsistent with these guidelines.

Section 23. Driving Institutions Under Community Quarantine

The status of ope,ration of the driving institutions shall comply with the latest issuances of rules
and regulations relative to the implementation of the community quarantine and other restrictions
nationwide set by the Inter-Agency Task Force (IATF) for the Management of Emerging Infectious
Diseases , Department of Trade and Industry (DTI), Local Government Units (LGUs), and other
implementing agencies.

Under the new normal , the latest IATF Omnibus Guidelines on the Implementation of Community
Quarantine shall be adhered to.

ARTICLE IX
PROHIBITED ACTS AND PENAL TIES

As a general prohibition, no LTO personnel and those having financial interest in existing LTO-
accredited medical clinics, his/her spouse, or his relative by consanguinity or affinity within the
third civil degree, •shall have ownership of, or beneficial or financial interest in any driving school.

Section 24. Pro ibitions for Driving Institutions

The following penalties shall be imposed on driving institutions that have committed the acts
prohibited under this Section . The Assistant Secretary shall permanently revoke the accreditation
of the driving sch?ol on the third offense.

Section 26. Prohibitions for LTO Officials and Employees

Without prejudice' to the filing of criminal and/or civil actions under existing laws, rules and
regulations , any LTO official or employee who has committed a violation of any of the provisions
of this Memorandum Circular shall be held administratively liable pursuant to the 2017 Rules on
Administrative Cases in the Civil Service (2017 RACCS).

Section 27. Preventive suspension and hearing


I
A. If upon evaluation of a complaint received there exists a prima facie evidence that a
violation has been committed by a driving institution or instructor or both, the RAC shall
recommend to the LTO Regional Director the issuance of a show-cause order and the
immediate imposition of a preventive suspension of not more than thirty (30) days pending
the outcome of the investigation . However, in the case of actual inspection, audit, or
monitoring visits, the LTO Regional Director may authorize the RAC Chairman to issue a
show-cause order and impose the preventive suspension immediately upon reasonable
belief that a violation under this issuance has been committed;

B. The concerned driving institution and/or instructor shall be given five (5) days to file an
answer under oath with the necessary supporting evidence or attachments. Failure to file
an answer under oath shall be deemed a waiver of its right to heard and shall authorize
the RAC to resolve the case based on available records;

C. Should it deem necessary , the RAC may , within seven (7) days from the submission of
the answ.er, conduct a hearing on the grounds raised in the answer or require the
submission of a supplemental answer. Due notice must be given to the concerned driving
institution and/or instructor;

D. The RAC shall submit its findings on the case within the 30-day period of the preventive
suspen sion of the concerned driving institution or instructor to the LTO Regional Director,
who shall recommend to the LTO Assistant Secretary the imposition of the proper penalty.
Failure of the RAC and the LTO Regional Director to submit a recommendation to the LTO

Assistant Secretary within the aforementioned period shall result in the reactivation of the
driving institution's and/or instructor's accreditation in the LTO system ;

E. The concerned driving school or driving instructor shall be notified of the decision of the
LTO Assistnt Secretary through the RAC.

Section 28. Additional Rules on Suspension and Revocation

The following rulet on suspension and revocatiori shall likewise be observed :

A. For the imposition of penalties, branches of the same driving institution are treated as
distinct and separate from their main office and of each other. The suspension of either
the main office or any of its branches does not affect the accreditation of other branches;

B. The instructors' accreditation under the main office or branch with suspended or revoked
accreditation shall also be deactivated;

C. The uploading facility of a suspended institution main office or branch shall be disabled ;

D. The revocation of the accreditation of the institution and/or instructors shall only be done
by the CODIAC with the approval of the Assistant Secretary.

Section 29. Motion for Reconsideration

An applicant aggrieved by the decision of the LTO Assistant Secretary may, within fifteen (15)
days from the rec ipt of the decision , file a motion for reconsideration to the Assistant Secretary.
Such motion for reconsideration may be entertained only on any of the following grounds:

1. If there is prima fac1e evidence of abuse of discretion on the part of the Regional Director;
I

2. If the decision, order or award was secured through fraud or coercion, including graft and
corruption;

3. If there is a violation of the fundamental rules of administrative due process;

4. If made purely on questions of law; and

5. If serious errors in the findings of facts are raised which would cause grave or irreparable
damage or injury to the appellant.

The decision of the Assistant Secretary shall be final and unappealable.

ARTICLE X
TRANSITORY PROVISIONS

Section 30. Status of Driving Schools upon the Effectivity of this Memorandum Circular

Pursuant to Sec ion 11 (A)(2) of this Memorandum Circular, all driving institutions with valid
Certificates of Accreditation upon the effectivity of this Memorandum Circular shall continue to
operate for the remaining period of validity of their accreditation . The renewal of their accreditation
shall be subject td the requirements and procedures provided under Sections 11 (8)(2) and 11 (E)
hereof. I

Moreover, all driving institutions whose certificates of accreditation have expired without pending
renewal applications during the va lidity of the accreditation shall be treated as new driving schools
and may only operate upon complying with the requirements and procedures under Sections
11 (8)(1 ), 11 (C) , and 11 (D) of this Memorandum Circular.

Meanwhile , those whose certificates of accreditation have expired but have pending renewal
applications during the validity of the accreditation shall be subject to the renewal requirements
and procedures in ?ections 11 (8)(2) and 11 (E) of this Memorandum Circular, Provided, that
should the driving school's accreditation expire during the renewal process, its account shall be

Section 31. Status


Circular
~f Driving School Instructors upon the Effectivity of this Memorandum

All driving instructors with · valid Certificates of Accreditation upon the effectivity of this
Memorandum Circular shall continue to be accredited within the remaining period of validity of
their accreditation. The renewal of their accreditation shall be subject to the requirements and
proced ures provided under Sections 12(E) and 12(F) hereof.

Moreover, all driving instructors whose certificates of accreditation have expired without
submitting renewal 9pplications upon the expiration of the same shall be treated as new driving
instructors and may only be authorized to conduct instruction upon complying with the
require ments and procedures under Sections 12(8), 12(C) , and 12(0) of this Memorandum
Circular.

Meanwhile, those whose certificates of accreditation have expired but have pending renewal
applications during the validity of the accreditation shall be subject to the renewal requirements
and procedures in Sections 12(E) and 12(F), provided, that should the driving instructor's
accreditation expire puring the renewal process, his/her account shall be deactivated pending the
approval of the Assistant Secretary. The approval of the Assistant Secretary shall be subject to
th e deemed approv d provision under Section 12(F)(5) of this Memorandum Circular.

Section 32. lnteril Solutions to Address Limitations in the LTMS

Until the limitations of the LTMS in implementing the features introduced in this Memorandum
Circular have been' sufficiently addressed, the following interim solutions shall be carried out:

A. In lieu of the biometric sign-off of TDC students for attendance purposes under Section
4(0), the ariving schools must maintain a manual logbook where the student's date and
time of attendance shall be recorded ;

B. For driving institutions without fingerprint scanners with liveness detection feature, the
Management Information Division (MID) ·shall temporarily install a username-password
sign-on mechanism, in lieu of the biometric sign-off of instructors and administrators for
the purpose of real-time electronic transmission of TDC and PDC Certificates of
Completion under Sections 4(H), 5(C), and 18(C), which shall be used for the first thirty
(30) days:after the eftectivity of this Memorandum Circular, extendible for another thirty
(30) days;for meritorious cases;

C. Until the rk al-time transmission of DRC and CTC Certificates of Completion pursuant to
Sections ~(8)(4) is available, the MID shall allow the DECs to scan and upload printed
certificates during the transaction process to the LTMS.

D. Driver's license renewal applicants shall continue to use the existing E-Learning Module
in the LTMS Public Portal for their COE pending the development by the MID of an
improved 1version pursuant to Section 6(A)(4) which is configured in such a manner that
the instructional videos cannot be skipped or bypassed by any applicant before taking
the COE Validation Examination;

E. A driver's license renewal applicant shall either take a pencil-and-paper test at any LTO
office where he/she intends to renew his license or an online validation examination
currently available at the E-Learning Module under the LTMS Public Portal while an
online CDE examination facility is being developed by the MID pursuant to Section
6(A)(7), a facility capable of generating an onsite accessibility code to access the CDE
Validation Examination onsite upon completion of the COE Learning Module;

F. In lieu of the viewing facility for the counter-checking of the number of exam re-takes of
instructors under Sections 12(0)(3.5) and 12(0)(3.6), the CODIAC shall prepare a file
accessible to all regional proctors via a cloud-based storage service detailing the
number of times an instructor has taken the written examination ; and

G. Pending the creation of the online facility for the generation of driving course summary
reports a~d reports on the performance of driver's license applicants in the theoretical
and pracfcal tests,in the LTMS pursuant to Sections 17(D) and 18(F) respectively, the
MID shall send th~se reports to the CODIAC and the RA Cs upon the request of these
committeTs.

Section 33. Transition from LTO-ACES to LTMS

All historical data pertinent to the accreditation of driving schools and instructors and the conduct
of driving courses shall be migrated from the LTO-ACES to the LTMS, hence, the need to verify
certificates with the former will no longer be necessary.

However, in case the migration of the historical data has not yet been completed , all TDC and
PDC Certificates of Completion transmitted through the LTO-ACES not yet used to secure
student-driver permits

Section 35. Repealing Clause

Memorandum Circular Nos. 2021-2282, 2021-2284, 2021-2286, 2021-2293, and 2022-2324 are
hereby repealed. All other 'existing circulars, memoranda, orders, and other prior issuances and
admin istrative reg~lations that are inconsistent with the provisions of this Memorandum Circular,

if any, are hereby modified, superseded and/or repealed accordingly.

Section 36. Separability Clause


I
If any part or provision of this Memorandum Circular is subsequently declared or held invalid,
unenforceable, illegal or unconstitutional, the remaining parts or provisions which are not affected
or impaired thereby shall continue to remain in full force and effect.

Section 37. Effectivity

This MemoranduT Circular shall take effect on 15 April 2023 after publication in the Official
Gazette or in a n wspaper of general circulation , and after its registration with the Office of the
National Administrative Register at the University of the Philippines Law Center, U.P. Diliman ,
Quezon City.
