This Membership Agreement (“Agreement” or “Membership Agreement”) is entered into between HamNa, LLC, d/b/a
Midtown Fitness, located at 1405 Cedar Street, Helena, MT 59601 (“Midtown Fitness”), and you the member. Midtown
Fitness is a fitness center offering access to all manner of exercise equipment, as well as personal training, which is
available for a separate fee. This Agreement entitles members access to the fitness facility, its equipment, and other
amenities, including lockers and changing rooms.
Please review this Agreement, and the addendum thoroughly as it is a legal contract between Midtown Fitness and you as
a member. By using the services offered at Midtown Fitness, members agree to the terms of this Agreement.
By signing up for membership for Midtown Fitness and using the premises, facilities, and equipment, you hereby
acknowledge on behalf of yourself, your heirs, personal representatives and/or assigns, that there are certain inherent
risks and dangers associated with the use of exercise equipment and facilities and that some of those risks cannot be
eliminated regardless of the care taken to avoid injuries. You also acknowledge that risks range from minor injuries such
as scratches, bruises, and sprains, to major injuries including, but not limited to injuries to back, muscles, joints, skeletal
system, cardiovascular system, or the nervous system. By signing this Agreement, you voluntarily agree to assume all of
the foregoing risks and accept sole responsibility for any injury to yourself (including, but not limited to, personal injury,
disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that you may experience or incur in
connection with your membership in Midtown Fitness (“Claims”).
By signing this Agreement, you understand and agree that Midtown Fitness is not responsible for your personal property
that may be lost, stolen, or damaged while in, on, or about the premises.
You may cancel this Membership Agreement at any time. You must provide Midtown Fitness written notice, via
electronic mail or a letter mailed first-class, of your intent to cancel, not less than ten (10) business days prior to the due
date of your next billing payment. Failure to provide timely notice will result in a charge for the full amount of your next
billing payment. If you are an Annual Member and cancel your membership early, the cancellation fee is fifty percent
(50%) of the remaining membership balance on your account.
In the event that you fail to pay outstanding amounts owed, your membership will be considered suspended, and Midtown
Fitness reserves the right to pursue additional avenues or means to receive monies owed.
ACKNOWLEDGMENT
I acknowledge that I have read and do understand each and every provision of the foregoing Midtown Fitness
Membership Agreement and the Addendum thereto, which I have initialed.
