SUBJECT: Executive Summary of Results from the Review of Proposed Illinois State Toll
Highway Authority (ISTHA) Project Work Within and Adjacent to
Commonwealth in the Village (CITV)

This memorandum provides Patrick Engineering Inc.’s (Patrick) executive summary of the findings from
the review of the proposed Illinois State Toll Highway Project for the Central Tri-State (I-294) within and
adjacent to the CITV. Some of the findings in this memorandum were previously issued in the Patrick
memorandums listed below while other findings expressed herein were developed after the below
memorandums were completed.
• Review of Proposed Illinois State Toll Highway Authority (ISTHA) Project Work Within and
Adjacent to Commonwealth in the Village, dated April 2, 2021
• Review of Proposed Illinois State Toll Highway Authority (ISTHA) Project Work Within and
Adjacent to Commonwealth in the Village Bulletin 75 Review Detention Basin, dated October 19,
2021
• Review of Proposed Illinois State Toll Highway Authority (ISTHA) Project Work Within and
Adjacent to Commonwealth in the Village Bulletin 75 Review 49th Street Ditch, dated November
3, 2021
• Review of Proposed Illinois State Toll Highway Authority (ISTHA) Project Work Within and
Adjacent to Commonwealth in the Village Ditches East of the Tollway Proposed Sound Walls,
dated November 3, 2021

This summary memorandum reports Patrick’s findings after review of ISTHA documents, emailed
information, and meetings. This information was reviewed and discussed with ISTHA; and the findings,
recommendations, conclusions, and limitations regarding the effects of proposed ISTHA I-294 Tollway
widening to Commonwealth in the Village (CITV) property and concerns are summarized below.

Patrick was tasked specifically to review:


• ISTHA proposed streambank stabilization improvement to the 49th Street ditch.
• Construction of an ISTHA detention basin adjacent to an existing detention basin at 51st Street.
ISTHA had proposed two alternatives:
o Alternate 1 leaves the existing CITV concrete block retaining wall in place

o Alternate 2 includes removal of CITV existing concrete block retaining wall


• ISTHA proposed storm sewers and stormwater flows that may affect CITV.
• Small swales east of the Tollway proposed soundwalls.

Patrick and subconsultant Living Waters Consultants (LWC) review resulted in the following findings:

49th STREET DITCH IMPRVOMENTS

Flow within the 49th Street Ditch.


CITV concern was that the proposed ISTHA project would increase flow in the ditch. Based on review
of design information and calculations supplied by ISTHA, the flow in the 49th Street Ditch will be
reduced. Based on Patrick’s review, the flows from I-294 and its adjacent area to the 49th Street Ditch
will be reduced by approximately 22% for the 100-year storm event:
• Review of the ISTHA Pre-Final Drainage Report, the drainage area from the ISTHA Project to the
49th Street Ditch decreases from 173.66 acres under the existing conditions to 134.60 acres under
the proposed conditions. ISTHA’s proposed Detention Pond adjacent to the Commonwealth
Pond) will contain the critical duration (1-hr) 100-year storm and decrease the peak discharge to
the 49th Street Ditch. The onsite area (within ISTHA right-of-way) peak discharge to 49th Street
Ditch under existing conditions is 32.40 cfs for 2-year storm event and 133.40 cfs for 100-year
storm event, and under proposed conditions is reduced to 29.00 cfs for 2-year storm event and
103.80 cfs for 100-year storm event.
• ISTHA provided for review a HEC-RAS Model which was used for the ISTHA Concept Drainage
Report. The improvement of the 49th Street Ditch, the 8′ by 8′ box culvert underneath the I-294
Tollway discharging to 49th Street Ditch and the culvert underneath Creek Drive are designed
based on the HEC-RAS model result. The HEC-RAS model used channel flow of 283.9 cfs for 100-
year storm event, while the peak release rates for on-site plus off-site area under existing
conditions is 167.50 cfs and the peak release rate under proposed conditions is 122.40 cfs
according to the 95% Pre-Final Drainage Report. Therefore, the improvement based on the HEC-
RAS model is a conservative result.
• Patrick obtained and ran the Concept Drainage Report HEC-HMS and HEC-RAS models for more
frequent storm events (i.e. 0.5-year, 1-year, 2-year and 5-year frequency). The model results
indicate that the inverted siphon structure within the 49th Street Ditch is overtopped for all storm
events, indicating that that the structure does not provide any significant flow control or
detention. The impact of the siphon is the same under both existing and proposed conditions.
Streambank erosion is notably more severe downstream of the structure.
• Patrick performed additional stormwater review and analysis using ISTHA provided models and
information to determine the effect of the higher precipitation in Illinois Water Survey Bulletin
75. Patrick used the “original” model and ran conditions under Bulletin 75 precipitation data to
model stormwater flows into 49th Street Ditch and compare to the model results that used the
older Bulletin 70. Whether Bulletin 70 or 75 is used to compare existing and proposed conditions,
either case demonstrates that the Tollway project results in a 22% reduction to the tributary
drainage area as well as proposed flows to the 49th Street Ditch from the I-294 roadway and its
adjacent area. This is due to the proposed construction of new detention by ISTHA, and by the
ISTHA’s diversion of runoff away from the 49th Street Ditch to downstream areas of Flagg Creek
south of CITV. The LWC 49th Street Ditch revised stabilization plan is expected to provide long-

term stabilization improvements to the channel. The proposed improvements are expected to
reduce potential erosion that could otherwise occur due to rainfall.

Metropolitan Water Reclamation District of Greater Chicago (MWRD) Permitting.


The MWRD has been involved from the beginning of the project. A Watershed Management
Ordinance permit is required and has been submitted by ISTHA. MWRD accepts ISTHA practices for
capturing runoff for proposed roadway improvements. Reference attached TranSystems letter dated
December 16, 2022 for additional detail regarding the MWRD permitting and response regarding
efforts by ISTHA to manage stormwater.

49th Street Ditch Bank Stabilization.


Bank Stabilization Measures: Most of the existing 49th Street ditch channel exhibits relatively low
erosion between Commonwealth Avenue and the inverted siphon structure. More significant bank
and channel scour erosion is present between the inverted siphon and Flagg Creek, which requires
additional stabilization techniques. ISTHA proposed a simple concept for stabilization of the 49th
Street Ditch. Review of the proposed concept by Patrick and LWC deemed the concept was
incomplete and insufficient for the task. LWC had previously prepared plans for streambank
stabilization of the 49th Street Ditch. In conjunction with CITV attorney Mike Ryan, it was negotiated
that ISTHA would pay for the implementation of the LWC streambank stabilization plan along the 49th
Street Ditch. The stabilization work within the 49th Street Ditch includes rock toe protection, a rock
riffle, bank re-grading, and revegetation. The stabilization will include the removal of non-native and
invasive tree and shrub species, and planting of native grasses and shrubs to revegetate the channel
banks. While the Tollway Project reduces the proposed flows to the 49th Street Ditch due to
construction of new detention by ISTHA, and by the ISTHA diversion of runoff away from the 49th
Street Ditch to downstream areas of Flagg Creek south of CITV, LWC’s 49th Street Ditch revised
stabilization plan is expected to provide long-term stabilization improvements to the channel.

49th Street Ditch Maintenance: Following Installation of new bank stabilization measures. Regular
maintenance will be required for plantings and debris removal:
1) Native plant maintenance. In the past, little to no plant maintenance appears to have
occurred along the 49th Street Ditch. This has contributed to some streambank
degradation. In the proposed settlement with ISTHA, CITV would receive from ISTHA
$402,360.00 for stabilization of the 49th Street Ditch, which includes funds to cover the
first five (5) years of native plant maintenance required by permit. The estimated annual
native plant maintenance cost for the 49th Street Ditch is approximately $5,000 per year.
The cost to be paid by ISTHA includes $25,000 for 5 years of native plant maintenance.
Native plant maintenance is highly recommended to continue beyond that time annually
to protect and maintain the stabilized streambank areas.
2) In exchange for the $402,360.00 payment from ISTHA, CITV would be responsible for
“Routine Maintenance”, and ISTHA would be responsible for “Emergency Maintenance”
as defined in the agreement. “Routine Maintenance” refers to day-to-day plantings,
vegetation and landscape care, mowing of any grass, invasive tree and weed removal,
and removal of debris and litter from the 49th Street Ditch. “Emergency Maintenance”
refers to any maintenance activity which must be performed immediately in order to
avoid or repair a condition in the 49th Street Ditch which causes or threatens imminent
danger or destruction to I-294. The proposed ISTHA settlement cost of $402,360.00

would include funds to provide streambank stabilization through revegetation as well as


rock lining to stabilize the outfall of the siphon and to protect the channel adjacent to
and downstream of the siphon structure. A riffle structure would be installed
downstream of the siphon structure to enhance downstream channel stabilization. The
proposed ISTHA settlement of $402,360.00 would include funds to provide rock lining to
stabilize the outfall of the existing siphon structure.

ISTHA DETENTION BASIN

Regulatory Requirements.
Development that occurred prior to the enforcement date of any County stormwater ordinance,
including MWRD, is not subject to the ordinance. Only development or re-development that occurs
after the date of the MWRD ordinance is subject to the requirements of the stormwater ordinance.
The MWRD Watershed Management Ordinance (WMO) that regulates development became
effective May 1, 2014. Development that occurred prior to the date of the ordinance is
“grandfathered” in and is not subject to the new requirements of the current ordinance. This is in
part why there are few to no detention basins in older parts of Cook County. Most of the development
in the 49th Street Tributary sub-watershed occurred well before the ordinance became effective. This
is the case for much of Cook County. An exception is that redevelopment that causes new ground
disturbance exceeding a minimum area now becomes subject to the ordinance, but for most of the
460-acre watershed that drains to CITV, the development occurred prior to County stormwater
ordinances requiring detention basins. The Pre-Final Drainage Report, pg. 14, describes that the
maximum release rate is 0.15 cfs/acre for the 100-year flood and that it “must meet local
requirements if more restrictive.” The 100-year maximum allowable release rate is calculated by
multiplying the total added impervious area by 0.15 then adding that to the existing (non-impacted)
flowrate to determine the existing allowable release rate.

As noted above, ISTHA’s proposed Detention Pond adjacent to the Commonwealth Pond) will contain
the critical duration (1-hr) 100-year storm and decrease the peak discharge to the 49th Street Ditch.
After review of Bulletin 75 data, the top of berm elevation of the proposed ISTHA Detention basin is
sufficient.

EXISTING RETAINING WALL AT PROPOSED ISTHA BASIN

• Since the existing block wall appears to be in good condition, except some outward displacement,
and more significant outwards displacement at the southern end of the wall where it curves
around a tree and CITV detention storage appears to not be impacted under either of ISTHA’s
alternatives to remove the wall and replace with a berm or leave the wall in place, the primary
considerations are: (1) aesthetic value of the wall, (2) long-term operation and maintenance of
the wall and/or soil berm between the two basins. Neglecting aesthetics, Patrick and LWC
recommended CITV accept Alternative 2 with the wall to be removed and a soil berm to be
constructed as part of ISTHA improvements to reduce long-term liability and cost concerns to CITV
from wall failure or repairs.
• The ISTHA settlement will include ISTHA installation of landscaping on CITV property in the area
of the proposed ISTHA basin. CITV will be responsible for future maintenance of this landscaping.

Patrick and LWC provided comment and recommendations on the additional plantings proposed
by ISTHA in the area of the proposed ISTHA basin and CITV basin. Landscaping will consist of
removing several trees near I-294 and installing several trees in the vicinity of the proposed basin.
Some proposed landscaping appears to be on CITV property, and within the CITV’s detention
basin, and would require CITV agreement and approval. Landscaping placed within the CITV
detention basin should be vetted prior to approval to confirm it would not adversely impact basin
capacity or function. Patrick reviewed Village Ordinance Section 10-4-9-E-7 to evaluate the best
practices regarding the existing and proposed plantings within the Commonwealth basin.
According to the Ordinance, “Detention/retention basins and ponds shall be landscaped. Such
landscaping should include shade and ornamental trees, evergreens, shrubbery, hedges, and/or
other planting materials.” According to Ordinance 10-11-11-C, there is no specific opposition
against plantings within the wet/dry basins.
• As part of the settlement ISTHA is proposing to construct an 8-foot tall wood screening fence
along the east, north and south sides of the ISTHA detention basin. The fence would be on CITV
property, installed by ISTHA at its cost and maintained by CITV.

STORM SEWERS

• Storm sewers in the 95% Pre-Final plans are proposed from Sta. 1356+00 to 1364+50, and Sta.
1375+50 to 1386+00. ISHTA claimed that the storm sewers are capable to handle the 100-year
storm event and provided exhibits showing that the 100-year High Water Level is lower than the
rim elevations from Sta. 1375+50 to 1386+00, except Manhole S562, which is used to collect
overflow from Commonwealth Pond. A backflow restrictor is proposed to be placed on the
downstream end of pipe P559 from Commonwealth Pond to prevent backwater from 49th Street
Ditch from entering the detention basin. In storm events greater than the design storm that
causes overflowing of the storm sewers, where NB I-294 drains towards to the east
(approximate Sta. 1360+00 to 1363+00), the excess flows drain into existing detention ponds
between the Tollway and Commonwealth Avenue. Where NB I-294 drains towards the west
(north of Sta. 1363+00), the excess flows will drain towards the median and therefore not affect
the CITV local residential area.
• In summary, the stormwater sewers adjacent to Commonwealth Avenue are sized for the 100-
year storm event. Storm sewers under I-294 are sized for the 50-year storm and the overflow in
excess of the 50-year storm from the stormwater sewer under I-294 will not affect the CITV local
residential area because overflows will either drain to the I-294 median or to detention ponds.

SWALES/UNDERDRAINS

The 95% Pre-Final Report has a general statement that “roadside ditches and channels are designed
to convey runoff from the roadway, right-of-way, and storm sewers”. In most areas the Tollway
lanes are sloped towards the center of the roadway and many of the reviewed ditches do not carry
I-294 runoff according to the Pre-final Plan. The exceptions are between Sta. 1360+00 and 1365+00
where the roadway drains east to existing drainage ponds, and ditches between Sta. 1370+00 to
1375+50 and between Sta. 1379+00 to 1380+50, which will receive drainage overflowing from
Tollway storm sewers in storm events larger than the design storm which drain north and south to

the proposed Commonwealth Pond respectively. The storm sewers are not overtopped in 100-year
storm event, as stated in the previous section.

CITV communicated concerns that the swale between the sound wall and condos south of the
proposed detention pond as designed with shallow slopes may result in standing water. ISTHA said
that they are willing to revise the design to add an underdrain per CITV request in the meeting on
February 18, 2022. This was reconfirmed in the meeting on October 31, 2022. ISTHA provided plans
and cross sections showing the additional underdrain on January 12, 2023. Noted since the
underdrain is an addition to the ditch, and the invert elevation of the underdrain is lower than the
100-year High Water Level of Commonwealth Pond, it is possible water will stay for a short time in
the underdrain after large storm events until the pond drains down. Nevertheless, the underdrain
and swale modifications are expected to essentially eliminate visible standing water in the subject
swale system.

SUMMARY

• 49th Street Ditch will receive less runoff volume from the Tollway under proposed conditions,
approximately 22% less due to the diversion of stormwater to areas of Flagg Creek south of CITV.
• The ISTHA detention basin will store the 100-year critical duration storm
• The ISTHA detention basin will decrease the peak discharge to the 49th Street Ditch by 10% in the
2-year flood event and by 22% in the 100-year flood event.
• ISTHA proposed settlement with the CITV provides funding of $402,360 for construction
implementation as well as 5 years of maintenance of the LWC 49th Street Tributary Streambank
Stabilization Plan. Routine Maintenance of the vegetation within the 49th Street Ditch and clearing
of debris on the inverted siphon would be the responsibility of CITV under the proposed ISTHA
settlement.
• CITV will be responsible for routine maintenance, and ISTHA will be responsible for emergency
maintenance of the 49th Street Ditch.
• Tollway storm sewers are designed for the 100-year storm event and resulting flows are not
expected to impact homes in the CITV.
• ISTHA will add an underdrain below the swale between the proposed sound wall and CITV
buildings south of the proposed detention basin to aid in draining water from the swales to
essentially eliminate visible standing water and wet grass areas (see Attachment 3). Visible
standing water in the area of these swales is not expected to occur.

LIMITATIONS

• Standard engineering practice for subdivision design is that the storm sewer system contains at
least the 10-year storm event flows. Overflows are expected to occur in emergency overland /
overflow drainage routes. However, the proposed Tollway I-294 drainage design storm water
system will contain flows up to the 50-year storm event based on Bulletin 70 rainfall levels.
• ISTHA drainage design is based on Bulletin 70 precipitation data as required at the time of
permitting. The storm sewers next to the Commonwealth Avenue downstream of the detention
pond may be undersized to handle Bulletin 75 rainfall amounts. However, based on calculations
by Patrick, the proposed ISTHA detention basin is adequately sized to contain the 100-year

storm based on Bulletin 75 data with only a 0.7 foot increase in high water level compared to
the results from Bulletin 70 rainfall. With this increase the high water level is still below the
pond overflow elevation with freeboard of greater than two feet.
• Per Commonwealth Avenue Venture Plans (1992) and Commonwealth Avenue Venture Phase II
Plans (1997), portions of Commonwealth Development Phase I drain to the 49th Street Ditch (area
between 49th Street Ditch, Commonwealth Avenue and Flagg Creek). The inflow from the
Commonwealth development is not included in the ISTHA’s 49th Street Ditch model; therefore,
actual flow rates should be slightly greater than stated in Pre-Final Drainage Report. The
Commonwealth development area draining to Flagg Creek is approximately 1% of the drainage
area to Flagg Creek west of I-294 Tollway (5 acres vs. 460 acres). The runoff from the
Commonwealth property is controlled by existing detention ponds within the development.
Therefore, the additional inflow from the 5-acre Commonwealth development area to Flagg Creek
does not significantly impact flood flow results.
