INTRODUCTION
The Kerala State Youth Commission is a statutory body established by law with quasi-judicial powers to
formulate and implement schemes for the education and empowerment of women and youth and to act
as guardians of the youth. Kerala State Youth Commission is formed for the purpose of evolving and
implementing programs in order to educate and empower the youth. Its function is to act as the
protector of their rights. The youth of this country has immense potential and if channelized properly,
could bring forward excellent results in achieving the goals set for the welfare of the country. It is
needless to point out that the youth of the state are facing innumerable problems which also require
immediate attention. It is necessary to create and increase opportunities for the youth for their
personality development, to improve their functional capacity and also to preserve their legitimate
rights, avoiding any possible exploitation. The Kerala State Youth Commission is a quasi-judicial body
started functioning through ordinance promulgated by the government. Steps were taken to replace the
ordinance through enactment of the Legislature thereby bringing into force the State Youth Commission
Act, 2014

OBJECTIVES
• Act as a defender for the rights of the youth Coordinate the Government departments for better
education and employment.

• Undertake research to find ways for young women and men to find employment opportunities

• Provide guidance in planning measures for the socio-economic development of the weaker sections and
tribes.

• Enable young people to develop their creativity and skills and to achieve high levels of achievement.

•Report occupational distress faced by youth in the unorganized sectors.

•Men and women between the ages of 18 and 40 are considered young by this commission.

•The talents and abilities of the youth of a country play a vital role in advancing the progress and
development of a country.

KERALA STATE YOUTH COMMISSION ACT,2014


The Commission was constituted on the basis of the Kerala State Youth Commission Ordinance issued in
2012. The said Ordinance was passed by the Kerala State Youth Commission Act, 2014. By law, the
commission has a chairman and no more than 13 members. It stipulates that one of them should be a
qualified legal practitioner, one should be a Scheduled Caste, at least three should be women and one of
the women should be a Scheduled Tribe.
AREAS OF OPERATION OF COMMISSION
•Since its inception, the Commission has dealt with a number of issues affecting the youth Legal action
has been taken.
•The Commission has been conducting awareness campaigns against the increasing use of alcohol,
drugs, tobacco products and cybercrimes among the youth.

•The Commission has taken effective steps to address the various problems faced by tribal and plantation
workers in Agasthyavanam, Attappadi, Parambikulam, Peermede and Thirunelli.

•The Commission is working to raise awareness about the rights of Adivasis and Scheduled Tribes and the
benefits and services available to them from the Government.

•In order for the Commission to directly intervene in the problems of women workers who are
continuously working without permission to sit in business establishments etc. and to resolve their
problems.

CONSTITUTION OF THE COMMISSION


The commission has been constituted in accordance with the gazette notification published, to perform
the functions assigned to it under the Kerala State Youth Commission Act,2014. The Commission shall
consist of,

(a) a Chairperson; and

(b) Not more than thirteen members, of which one shall be a qualified legal practitioner, one shall be
a person belonging to the Scheduled Caste and at least three shall be women and one among the
shall belong to the Scheduled Tribe.

• The Chairperson and the members when appointed to the Commission shall be youths.
• The Chairperson and the members shall be appointed by the Government.
• The Government shall appoint a person who is, or has held, a post not below the rank of an
Additional Secretary to Government as the Secretary of the Commission.
• The headquarters of the Commission shall be at Thiruvananthapuram.

SOME OF THE CONSTANT INTERVENTIONS OVER THE PAST 5 YEARS


The Youth Commission has been actively involved in various issues related to the youth of Kerala for the
last 5 years. The Commission took action on complaints of youth rights violations and voluntarily on the
basis of media reports. The Youth Commission has been able to take action on behalf of the youth on a
number of issues, including employment, education, mental health, legal protection and protection of
democratic rights, and to make recommendations to the Government in this regard. The following are
the important interventions made by the Youth Commission during the last 5 years.

•Following the intervention of the commission in the case of the death of a young mother while
undergoing treatment in Kasargod district, Rs7,50,000 was sanctioned as compensation for the care of
the child.

• Commission has directed to include a third column in the application forms for equal opportunity for
persons of different genders in educational and employment institutions.

•The Commission has issued an order to grant appointment to those who have been recommended for
appointment in the post of Conductor in KSRTC on the complaint of non-issuance of appointment order.

•PSC appointments of various posts- The report was also submitted for expeditious appointment of
those included in the rank list.

Free PSC Coaching for Teenage Adivasi’s living in the hinterland of Athirappilly forest in Thrissur district.

•It was recommended to organize a special camp to issue various identity cards to transgender people.

•A recommendation has been submitted to the Election Commission to take steps to change the words
'gender' and 'heterosexual' in the identity card.

•A recommendation has been submitted to the Department of Health to provide risk allowance to nurses.

•An order has been issued to ensure that the teachers of the self-financing colleges are paid properly and
to pay the non-teachers' salary scale.

•An order has been issued to provide employment opportunities to those who have graduated in Library
Science through distance education.

•Recommended funding for the surgery of transgender people.

•Recommended for Constructing ramps in public libraries for easy access to persons with disabilities

THE ACTIONS TAKEN BY THE COMMISSION IN THE CONTEXT OF THE LOCKDOWN


The Youth Commission has taken precautionary measures to ensure that people's lives are not made
difficult in the wake of the lockdown in Kerala following the spread of the corona virus across the globe.
The Youth Defense Force has registered and deployed volunteers through the Google form. Later, the
state government decided to expand the existing volunteer portal and added it to the Youth Defense
Force. The areas of work were planned with a long-term view of the problems that Kerala may
experience during the Lockdown.

Depending on the nature of the problems that arose at that time from these areas, new activities had to
be undertaken. With the guidance of the Chairperson and members, the State Coordinators, District
Coordinators and Volunteers are organized 24 hours a day during the lockdown. The details of the
activities were compiled by a video conference of the coordinators in the Zoom app on the morning of
the day the lockdown was announced. Subsequent review meetings were convened and arranged with
the help of technical systems. Below are the areas and details of the activities.

• Volunteer service to deliver essentials and medicines due to lockdown.


• Delivering medicines to the patients in all the 14 districts under treatment at Thiruvananthapuram
RCC with the help of Fire Force.
• Providing essential medicines to the needy in all the 4 districts which are not available in the local
medical stores.
• "PUSTHAKAKOODU" a book-giving activity for those who are in isolation to read.
• Delivering books from local libraries to homes for relaxation and reading at home during the lockdown
in the state.
• Ensuring volunteers for blood donation.
• Delivery of medicines to the mentally ill from the Thiruvananthapuram Mental Health Medical Centre.
• Assist in delivery of medicine to other states and foreign countries.
• Dissemination of government news through social media in a transparent manner.
• Cleaning of isolation wards and other public places.

PROCEDURE

A complaint received through mail/letter will be registered and numbered by the confidential assistant,
which is then forwarded to section A2 and cover draft will be prepared after examination, pointing out
clearly the facts of the complaint and will be forwarded to the Administrative officer without date. This
is then verified and dated, then submitted to the Secretary, Kerala State Youth Commission. Commission
may request for reports to the required authorities with respect to the complaint received. Both parties
may be called for mediation. Any of the party if not appeared for mediation, legal notice will be send to
the party. If they don’t appear before the commission even after two legal notices summons will be
issued.

CASES REFERRED

1412/A2/2021/KSYC

The aforesaid complaint is given by candidates in the rank list of Police Officer post for 3 years and
waiting and to increase the women representation in the Police Force. Their request is to raise the
women participation to 25% from the current 8.37%.The commission recommended to the Additional
Chief Secretary of Home Department to report vacancies immediately and to raise women
representation to 25% as soon as possible. Regarding this, the secretary directed the State Superintend
of Police to submit a report as soon as possible.

281/A2/2021/KSYC

The aforesaid complaint was given by a parent for the sanctioning of loan from the bank for her daughter’s
MBBS education. The commission sought for a report from the Canara Bank Manager. The report says
that the bank has not rejected the education loan and only insisted to produce a valid mortgage. With the
submission of valid mortgage the loan will be sanctioned.

1395/A2/2021/KSYC

In the aforesaid complaint, the complainant lost his job due to COVID-19.He was promised job by a
minister but his complaint was stuck in District Collectorate.He requested the commission to intervene
for further actions. The commission sought report from the Wayanad District Collector and in the report
the collector assured to consider him for Wayanad DTOC temporarily.

1179/A2/2020/KSYC

The aforesaid complaint is regarding the delay of practical test of Police Constable Driver List due to
COVID.Due to this the publishing of rank list also got delayed.The complainant enquire whether it is
possible to publish rank list without practical test.Regarding the matter the commission sought report
from the Secretary, PSC and also from State Police Chief.The report from the State Police Chief said that
they cannot intervene in matters of recruitment since it comes within the ambit of PSC.Later,The Secretary
of PSC replied that the practical test has been done and the recruitment process is ongoing.

873/A2/2021/KSYC

In the aforesaid complaint,the complainant who is an MBA student alleges that she was harmed by his
relative. The commission sought a report from the District Police Chief and the report says that after the
investigation, a case has been registered and indictment has been submitted to the court.
101/A2/2021/KSYC

In the aforesaid complaint,the complainants request the commission to intervene in the re-evaluation of
the file regarding the creation of LD -Typist post in Grama panchayats. The commission sought report from
the Secretary of the Local Self Government Department .The Local Self Government Department assigned
Panchayat Director for this and the report says it is suitable to create LD -Typist post in panchayats.

275/A2/2021/KSYC

In the aforesaid complaint the complainant when she got admission in another college for BBA LLB
cancelled her admission from the defendant college but didn’t get a refund. The commission sought report
from the Principal of the institute and District Police Chief. In the report it is said that the case is
compromised and the complaint is disposed off.

1279/A2/2021/KSYC

In the aforesaid complaint,the original certificates of the complainant that were given to an agent for BSc
nursing admission got withheld by him , even after rejecting the offer of admission in a college in Mysore.
Later she got admission in another college in Andra Pradesh with scholarship. She was in a dilemma by
not being able to submit original certificates. This case was also recommended to the commission to be
taken into consideration by DHISH,a social organisation for marginalized sections in the society. The
commission sought report from the District Police Chief. In the report it is said that she later collected the
certificates from the college and hence the complaint is disposed off.

676/A2/2020/KSYC

The aforesaid complaint is regarding the Probationary Office post appointment. The complainant request
the commission to intervene to increase the cader strength 5:1 for Probationary Officer Grade 2. The
commission sought report from the Director of the Social Justice Department and was replied that it is not
possible to increase the cader strength under the current circumstances. The commission recommended
to the Secretary of the Social Justice Department to consider the request during the special rule formation.

1542/A2/2020/KSYC

In the aforesaid complaint,the complainant who belongs to Vishwakarma section happens to be in List II
of Assistant Lecturer post. Since there was no one who belongs to Vishwakarma section in List I, he claims
that List II should be considered.The commission sought report from the Secretary of PSC and got replied
that there is no provision for that and List II can only be considered after the expiry/exhaustion of List I.
The court order was also provided along with the report.

1135/A2/2020/KSYC

In the aforesaid complaint,the plaintiff alleged that his neighbour, who is the defendant stopped him on
the way and harmed and threatened with death and seeks help from the commission. The commission
sought a report from the District Police Chief and as per the report the complaint was found to against the
facts.
FRESH CASES

The Commission provided us with two fresh cases and provided us with insights on how to draft a cover
letter for submission and consideration of the commission. We have written and submitted the draft cover
letter under the guidance of the section officer. The cases are as follows:

1906/A2/2022/KSYC

The aforesaid complaint is from three households about the non availability of water from the pipe for
two months consecutively and wants the commission to intervene. The commission sought a report from
the Water Authority of the complainant’s region.

1908/A2/2022/KSYC

The aforesaid complaint mentions about the misbehaviour from an Assistant Professor College in
Palakkad towards a differently abled student and his parent. The complaint is from a student union of the
respective college. The commission sought report from the District Police Chief.

1992/A2/2022/KSYC

The aforesaid complaint is against a college for not providing TC to the students even after the completion
of studies. The students are in urgent need of TC for their PG application. The students had to face the
rude behaviour from the college staff towards the students for questioning upon the delay .The complaint
also mentions the plight of the students who are given receipts of lesser amount than what they actually
paid for admission. The commission sought a report from the college authorities regarding the matter.
CONCLUSION
The Kerala State Youth Commission has been in operation for seven years. It is a matter of pride that the
activities of the Youth Commission have been all-round since 2016 as a quasi-judicial body and as a
governmental body working for the protection of the rights of the youth. One of the basic rationalities of
development is to consider the human resources of a country as its primary asset. Young people are one
step ahead of other human beings, not only in production and consumption, but also in their enthusiasm
for free thought, social interaction and their response to progressive political change. The youth of Kerala
have left their mark on the deepening social change in the Kerala public sphere with their hard working
lives. TS Thirumumpu, the beloved poet of Malayalam, wrote, Youth is an active and committed mind-set
about Kerala youth. Evidence of this is the Kerala Renaissance and the socio-political movements that
have exploded in us and the role of youth of all ages in it.

The Commission shall, while performing its functions under section 9, have all the powers of a Civil Court
trying a suit under the Code of Civil Procedure, 1908 (Central Act 5 of 1908) in respect of the following
matters, namely summoning and enforcing the attendance of any person and examining him on oath
requiring the discovery and production of any document, receiving evidence on affidavits, requisitioning
any public record or copy thereof from any court or office, Issuing commissions for the examination of
witnesses or documents, any other matter, which may be prescribed. The Commission while conducting
the enquiry under section 9, shall afford opportunity to all parties to present their views by themselves or
by their authorized representatives. The finding of the commission on any enquiry conducted under this
Ordinance shall be communicated to the Government with its recommendation for appropriate action or
relief to the parties to the dispute.

The Youth Commission is moving forward with a variety of action plans to ensure the holistic development
of the youth. The Youth Commission seeks to create a democratic youth who are not overwhelmed by
disasters and revivalist values. The long-term goal of the Kerala State Youth Commission is to transform
our youth into leading fighters in the process of social construction by ensuring a worthy representation
of the transgender community as well.
