‘As proposed and recommended by you vide your letter/loan proposal dated
07.04.2023, we are pleased to inform you that ROCAC at ours has sanctioned the
term loan (Housing) of Rs.80,00,000/- (Rupees Eighty Lakh only) under “Housing
Loan Scheme for Members of Staff’, as per the terms and conditions mentioned in
“Annexure - A’.
‘As per the request of Shri Anoop Kumar, Loan account is to be opened at and
be disbursed through your Branch, i.e. BO: Nalagarh, as the property is
located near BO Nalagarh.
You are advised to open new account in the CBS under staff scheme as per the
terms of sanction.
In case any discrepancy is observed in the sanction, please bring to our notice
immediately for modification/rectification
STIPULATIONS
1. BM to ensure that Terms and conditions of sanction be conveyed to the
party and acceptance of the same should be taken from the party and kept
with the loan documents.
2. Tripartite Agreement to be executed among the borrower, seller and the
bank.
3. Following documents to be obtained before disbursement:
a) Jamabandi for the year 2014-15 issued in the name of Smt Saroj Sharma
b) Jamabandi for the last 16 years,
c) Non encumbrance certificate issued by sub registrar Kharar.
d) Sale Deed No. 5692 dtd 11/12/2015 executed in favor of Smt. Saroj

concerned revenue authority be got done in favour of Smt. Saroj W/o Shri
Anoop Kumar.
BM to ensure that Equitable mortgage in favour of the bank to secure the
proposed housing loan of Rs.80,00,000/- (Rupees Eighty Lakh only) be
created at notified centers only, after obtaining the original documents as
per list given in Advocate opinion. List of documents to be obtained for
creation of Equitable Mortgage (as suggested by the Advocate) is as
under:
a) Original Sale Deed which is yet to be executed in favour of Smt. Saroj Wio
Shri Anoop Kumar
b) Original Jamabandi for the year 2014-15 which is to be issued showing the

sanctioned for construction of House should be done after creation of
Equitable Mortgage and noting of charge (mutation) in favour of HPGB, BO
Nalagarh with concerned revenue authority.
14. BM to ensure that construction of the house is done as per approved map
and required margin is to be contributed on each stage of disbursement.
Before release of next loan disbursement BM to visit the site and ensure
that amount of loan earlier released has been utilized for
and record thereof be kept with the loan documents.
42. PDC of Salary/saving accounts of borrowers must be obtained.
43. Flat for full value be got insured from the approved company of the bank
and policy thereof be held with the loan documents.
44. After disbursement and completion of all the above documents, Legal
Compliance Certificate be submitted to our office along with vetting of
documents from the approved advocate of the bank.
45. All the above stipulations along with terms and conditions mentioned in
“Annexure — A” are to be complied with.

General terms and conditions 1
1. |The applicant should bring in their entire contribution before release of the Loan or rin the
manner otherwise provided in the sanction, Further, it should also be ensured that margin |
stipulated is maintained / provided at each stage of disbursement
BM to ensure that disbursement is made in stages keeping in view the progress of work and
margin stipulated in the sanction is maintained/provided at each stage of disbursement
2. The rate of interest shall be subject to change from time to time as per Banks /RBI |
guidelines.
In the event of revision of interest in interest rate to be charged in the account, the borrower
shall have the option to pay increased amount of EMI or continue to pay the existing amount |
of EMI with a condition that the balance outstanding in the account shall be paid in one go
with the last EMI of the originally applicable repayment tenor, failing which the applicable rate |
| of interest shall be charged for the appropriate repayment tenor from the date of original
| sanction.
Customers have been explained the repayment process of the loan in respect of, tenure, |
periodicity, amount and mode of repayment of the loan and informed that Borrower is obliged |
to pay the EMI Installment regularly on due date. Notwithstanding what is stated herein, it
shall be the liability of the customer to ensure that the EMls/ Installments are regularly paid
| ‘on the due dates
‘4. |Minimum 24 Advance Cheques signed by borrower towards repayment of monthly |
installments along with Letter of Deposit to be obtained from the both the applicants.
However, when the number of cheques with the branch reaches six (6), the borrower to give
additional 24 cheques duly signed. This system of giving additional cheques shall continue till
the adjustment of the loan. The guidelines for safe custody of advance cheques circularized
by Inspection & Audit Division to be followed.
The Bank shall have the right to avail the benefit of Sections 138-142 of the NI Act against
the borrower in case of dishonour of the ECS/RECS/NACH (debit) mandate on account of
insufficiency of funds.

charged from the applicant as per sanction before release of credit facilities

> —_ Non-payment of any installment of principal and/or interest, costs and other charges

> Any irregularity in the Loan account; or

>» Diversion or siphoning of the Loan amount; or
> Default in creation of security within the stipulated time; or
> Non-compliance of any of the terms & conditions of this Agreement, or
> __ Any other case as the Bank may deem fit
40. The borrower shall submit all relevant documents as mentioned in the Sanction Letter/Loan
| Agreement before disbursement
14. The loan will be secured by mortgage off hypothecation off charge on assets purchased
through bank funds in case of primary security and/or assets in case of collateral security,
| within the stipulated time period as specified in the sanction, Personal guarantee, if any, will
be obtained as per sanction.
12. | The bank will always be at liberty to stop making further advance or cancel the credit facility
at any time without previous notice and without assigning any reason even though the said
__ credit facility has not been fully availed of _|
Pre-Disbursement Conditions:
4. | BM to ensure that terms & conditions of sanction have been got accepted from the |
| borrower as well as co- borrowers and such acceptance to be kept on record as a
| part of loaning documents.

3. All other terms and conditions as applicable to such type of advance as contained in the
“HO Loan Cir No. 13/2021 dated 03.03.2021 and subsequent amendments thereon from

c) Non encumbrance certificate issued by sub registrar Kharar.

While disbursing the loan, Incumbent In-charge should full
genuineness of the borrower's credit requirement as well as adequacy. For this purpose
he may call additional information from the borrower as he deem necessary. The amount
to be actually advanced should not exceed the limit sanctioned above or the actual |
requirements of the borrower, whichever is lower. BM is advised to ensure that the amount
of loan together with margin money should be utilized for construction of house/ purchase |
of plot as per map plan/ abstract of cost submitted and no deviation as well as |
diversification of Bank fund be allowed and it should be ensured that the construction is
taking place on the land mortgaged in favour of the Bank, =
BM (Br) to explore for Life Insurance policy on the borrowers, as available at the option of
the applicant borrower from PNB Metlife under loan insurance scheme in terms of |
guidelines issued in this respect from Head Office |
An Affidavit-cum-undertaking be obtained from the borrower that: |
> In case of upward revision in interest rate I/we undertake to deposit the excess
amount of EMI for entire tenure of loan. |
» Ihe agree to the fact that Post retirement, EMls/Installments shall be reviewed by the |
Bank based on the cash flows and in case cash flows are inadequate, we undertakes
to deposit the proceeds of terminal dues/retirement benefits to the extent as required |
by the Bank so that EMis/Installments are in line with eligibility criteria
> — liwe give my/our consent to receive SMS alert/Email from the bank, as soon as the
account becomes irregular to be obtained from borrower
> We will meet out the margin/ any escalation in the cost of the course from their own |
sources
> — lhwe undertake that if any portion of house is rented out, the rent so received would
be first utilized toward payment of house tax ete. as per rules and 50% of the balance
| amount would be deposited in borrower's loan account, in addition to the usual
installment payable towards the adjustment of the loan. we also undertake that rent
to be received from the tenants will be directly credit to the saving account in which |
standing instructions has been given to recover the loan installment.
> | undertake that | shall not violate the sanctioned plan; construction shall be strictly as |
per the sanctioned plan
> | undertake that if that any wrong information/dectaration given by me/us will be
my/our responsibility in case of any liability arising out of the same against the bank
> Undertake to intimate the Bank of any change in his employmentcontacvaddress |

bank will get the same insured and cost recovered from me/us

8. | The borrowing member of the staff should give an undertaking to start construction on plot
within maximum period of one year from the date of disbursement of loan for the purchase
of the plot, failing which penal Rate of Interest as per applicable Bank guidelines to be
charges in the account.
In case the construction is not started by the borrowing employee on the plot of land
financed by the Bank within the stipulated period of one year, unless there are justifiable
reasons (for which prior approval of sanctioning authority to be obtained), penal interest @
1% above the applicable interest rate be charged from the date of disbursement
9. On completion of house/fiat construction, a certificate be obtained from approved |
architect/qualified engineer, certifying the end use of funds granted by the Bank
