RULE I - GENERAL PROVISIONS

1. BLDG. REQUIREMENTS

RULE II — ADMINISTRATION AND ENFORCEME NT

1. SECRETARY
« Vested to do Administration and enforcement of the provisions of the Cocle and IRR, including the imposition of penalties
for aclministrative violations thereof
« Functions:
Formulate policies, pla ns, standards ancI guiclelines
Issue ancl promulgate addiLonal rules and regulaLons in the form of Memorandum
Circulars Exercise appellate jurisdiction over the decisions a nd orders of the Builcling
Official
Evaluate, review, approve ancI/or take final action on changes a nd/or a menclments to existing Referral Codes as
well as on the incorporaLon of other referral cocles
Prescribe and impose the amount of fees a nd other
charges Appoint a Builcling Ofhcial

2. NATIONAL BUILDING CODE DEVELOPMENT OFFICE (NBCDO)


« Serves as Tech n ical Staff of
Secretary Functions:
Assist in the administration and enforcement of the provisions of the Code and its IRR.
Review, evaluate and take final action on various technical ancI legal problems
Conduct seminar/workshops on the Code, its IRR, and BP 344 (Accessibility Law).
Unclertake other dukes and tasks assigned by the Secretary.

3. BUILDING OFFICIALS
« appointed or designated other than by the Secretary
« responsible for carrying out the provisions of the Code
« enforcement of orders and decisions
Qualifications:

F ilipino ciLzen and of good moral


character. Registered architect or civil
engineer.
Member of accredited organization of his profession for 5 years minimum endorsed or recommendecl by the
accreditecl professional organization.
(5) years minimum of diversifiecl and professional experience in building clesign and construcLon.
Completed a seminar workshop on PD 1096 and its IRR conclucted by the DPWH
Duties:

Enforcement of the provisions of the Code and its IRR


Admin istraLve control and supervision of works percent to buildings/structures
Processing & issuance of all permit applicañons ancl cerLfcates
Changes, modificaLons, and alterations in design cl uring construction phase shall not start until the modified
clesign plan has been evaluated and the necessary a mendatory permit issued
Make annual inspections of all buildings/structures ancl keep an up-to-date record of their status

4. INCOME FROM FEES

5. EXEMPTION ON BLDG. PERMIT

a Light Violation — 5,000
a Less-Grave Violation — 8,000

• Penalty Surcharge:
10% of the huilcling permit fees - Excavation for foundation
25% of the huilcling permit fees - Foundation Construction (including pile driving and laying of reinf.
bars) 50% of the huilcling permit fees - Construction of superstructure up to (2) nuts.
100P« of the building permit fees - Construction of superstructure above 2.00 meters
a 25P« surcharge of the inspecLon fee - Failure to pay a n n ual inspecLon fee w/n (30) days from prescrihecl date

7. PENAL PROVISIONS — Any person, firm or 6orgorofion who shall violate airy o/the provisions of the Code
a Punishment: 20,000 Max. Fine / 2 years Max. Imprisonment / both

8. DANGEROUS BUILDINGS
are those declared structurally unsafe or not provicled with safe egress, or which constitute a fire hazard, or are
otherwise clangerous to h uman life, or which in relation to existing use, constitute a hazard to safety or health or public
welfare because of inadequate maintenance, dilapidation, obsolescence, or abandonment; or wliich otherwise contribute to
the pollution of the site or the community to an intolerable degree.

9. ENFORCING ADMINISTRATIVE SANCTIONS

RULE III — PERMIT & INSPECTION

BUILDING PERMITS
No person, firm or corporation, including any agency or instrumentality of the govern ment shall construct, alter, repair,
convert, use, occupy, move, demolish and acld any building/structure or any portion thereof or cause the same to be done,
without first ohtain ing a huilcling permit therefor from the Building Ofhcial.

SUPPLEMENTARY PERMITS

Ancillary Permits - duly signed and sealed plans and specifications by professionals and shall be submitted together with duly
notarized applicaLon for BuiIcl ing Permit. The BuiIcl ing Permit is null and voicl if not accompanied by the Ancillary Permits.

Accessory Permits - issuecl by BO for accessory parts of the project with very special functions/use which are incl icated in
the pla ns ancl specifcañons that acconip any the building permit applicañon.

Examples: Bank and records vauIts; swimming pools; firewalls separate from the buiIcl ing/structure; towers; silos;
smokestacks; ch imneys; commercial/industrial fixed ovens; incl ustrial kilns/furnaces; water/waste treatment tanks, sepñc
vaults; concrete and steel tanks; booths, kiosks and stages; and tombs, mausoleums and niches

EXEMPTION FROM BUILDING PERMITS

Minor Constructions
« Sheets, outhouses, green houses, children’s playhouses, aviaries, poultry houses a nd the like G m 2 max. &
completely detached from other building ancl are intencled for owner private use only.
« Adcl icon of open terraces/paños resting directly on ground - 20 m 2 max. exclusively for owner private use only
« InstallaLon of winclow grilles.
« Garden pools for habitation of water plants/aquarium fish - 500 mm Max. in depth ancl exclusively for private
use.
« Garden masonry walls other than party walls - 1.20 m. Max. height, footpaths, garden walks ancI/or driveways.

Repair Works
« Repair works not involving a ny st ructural member - replacement of deterioratecl roofing sheets or lies, gutters,
down spouts, fascias, ceilings and/or sidings.
« Repair ancI/or replacement of: non-Ioacl-bearing parLtion walls, any interior portion or a house not involving
adcl ition or alteration, doors and windows, perimeter fence and walls, flooring, plumbing fixtures, Stings or
pipings.

APPLICATION FOR PERMITS

Requirements:

• Application Forms
• Lot Ownership & Description
• If registered owner of lot - TCT/OCT, Tax Declaration, Current Real Property Tax Receipt
• If not registered owner of lot - Notarized copy of the Contract of Lease, or Deed of Absolute Sale
« 5 sets min. plans & specifications - signed and sealed over the printecl names of the duly licensed and
registered professionals
• Clearances from Other Agencies
• Locational Clearance - obtained by the owner/permittee from the City/Municipal Zon ing Aclministration
• 7 days from receipt of application - Application failure to receive reply shall be sulcient not to
cause further clelay in processing the building permit application by the BO.

ISSUANCE OF BUILDING PERMIT

« 15 days from payment of required fees - BO issues the building perniit


• Construction of Portions Permit
a Excavations more than 50 m’ and 2 m in depth
• Cash bond of P50,000.00 for the first 50.00 m*
• P300.00 for every m° in excess of 50 m3 until huilcling permit is issued
• Max. 100.00 m* or 3m in depth and shall not be left open w/o any work done in site for more than 120 days,
otherwise cash bond shall be forfeited

TERMS AND CONDITIONS OF PERMITS

« Article 1723 of the Civil Code of the Philippines - Engineer/Architect is liable for damages within fifteen (15) years

VALIDITY OF BUILDING PERMITS

« 1 year - null a ncl void if the building is not commenced


« 120 days — if suspendecl or abandoned

NON- ISSUANCE, SUSPENSION OR REVOCATION OF BUILDING PERMITS

« Errors fou nd in the plans and specifcañons


« Incorrect or inaccurate data or information supplied
« Non-compliance with the provisions of the Cocle or any rules or regulañons

APPEAL

• 15 days

« 30 days - BO issues Certificate of Occupancy after final inspecñon & submittal of CerLfcate of Completion, construction

sealed by the Owner’s duly licensed Architect or Civil Engineer who undertook the full Lme inspecñon a nd supervision
of the construction works
RULE IV — TYPES OF CONSTRUCTION

« Type I - woocl construct on.


« Type II - wood construction with protective fire-resista nt materials and 1-hr Are resistive throughout
« Type III - masonry and wood construction.
« Type IV - steel, iron, concrete, or masonry construction
« Type V - 4-hour fire-resistive throughout and the structural elements shall be of steel, iron, concrete, or
masonry construction.

• Types IV and V - 4-hr fire-resistive rat ng.

• Type V - 3-hr fire-resistive rating for bearing walls and 1-hr fire-resistive raLng for
vertical openings, floors and roofs.

• Types II ancl III Construction - 1-h r fire-resistive rating
• Type IV - 2-hr fire-resisLve rating
• Type V - 3-hr fire-resistive rating.
c.• Exterior doors ancl winclows shall have 1-hr fire-resistive rating for all Types.
