Consultants’ Terms of Reference

CONSTRUCTION SUPERVISION CONSULTANT

1. Introduction

1. The Asian Development Bank (ADB) approved Loan 3963/3965-UZB: CAREC Corridor 2
Karakalpakstan Road (A380 Kungrad to Daut-Ata Section) Project. The project involves the
road with asphalt concrete pavement with a total length of 240 km, with its conversion to the
2-lane cement concrete pavement. ADB approved the Government of Uzbekistan's (the
government) request to use savings from Loan 3965-UZB for the additional scope to finance
(i) the upgrading and widening of a 25-kilometer (km) section (673-698 km) of the A380
highway and (ii) upgrading a 4 km section of the 4P180 road from 0-4 km adjacent to A380
including reallocation between loan categories for Loan 3965-UZB which needed to be done
due to the project scope change.

2. The “Avtoyulinvest” Agency with Committee for Roads as the Executing Agency (EA) of this
project. The EA intends to hire a consulting firm to conduct construction supervision using
the QCBS procedures (quality and cost based selection) “specified in the applicable
Guidelines on use of Consultants by the Asian Development Bank and its Borrowers” with
“specified in the “ADB’s Procurement Policy and ADB Procurement Regulations for ADB
Borrowers for Goods, Works, Nonconsulting and Consulting Services (2017, as amended
from time to time)”. Consulting services will include, but are not limited to, review of the
detailed design and assessment of the final drawings “approved for construction”,
supervision of all works under construction contracts and certification of works in terms of
their quality and quantity, management of construction contracts, as well as monitoring and
benefit assessment.

Project’s Brief Summary

3. The public international road A-380 "Guzar-Bukhara-Nukus-Beyneu", as part of the Uzbek


national highway, forms part of the east-west transport corridor, which allows efficient
integration into the international transport system along the north and north-west directions
to the CIS and Europe, in the southwest and south direction - to the ports of the Persian Gulf
and the Black Sea. The highway has a total length of 1204 km, providing reliable
intraregional, interregional and international transport connection, passes through the
territories of four regions of the country: 150 km through the territory of Kashkadarya region,
289 km through the territory of Bukhara region, 113 km through the territory of Khorezm
region, 652 km through the territory of Karakalpakstan. It is an important section providing
access to the north and north-west, is part of international transport corridors, such as E-40,
E-60, E-003, E-004, Traceka-27, Traceka-28 AN-63, CAREC 2a and CAREC 6a.
4. The project consists in (i) reconstructing the road with a total length of 25 km on the section
between 673-698 km of A-380 highway (herein hereafter referred to as the Section A-380 25
km) during the years 2023-2025 with its conversion from the existing 2-lane asphalt concrete
pavement to a 4-lane cement concrete pavement, and (ii) upgrading a 4 km section from the
existing 2-lane asphalt concrete pavement of the 4P180 road from 0-4 km adjacent to А380
(herein hereafter referred to as Section 4P180 4 km) during the years 2023-2025 to a 2-lane
cement concrete pavement.
5. For the Section 4P180 4 km the Works Contract is a lump-sum type of a contract, and it is
based on the ADB SDB Works-Small, December 2021. The scope of works under the Works

Contract includes the preparation of detailed designs as the responsibility of a Contractor.
This contract modality is considered as a pilot and if successful it will be further used for
future similar projects
6. The implementation of the project helps to ensure effective and safe internal and regional
connections, sustainable economic growth of domestic and foreign trade, will allow for the
passage of constantly growing volumes of road transport, reduce the time of delivery of goods
and passengers, as well as improve road safety and improve the environmental situation in
the region.

2. Objective

7. The selected Engineer will assist the Committee for Roads in ensuring that the construction
and installation works meet the required standards, implemented in accordance with the
schedules and the contract’s prices.
8. The primary objectives of the consulting services are to:

(i) Function as the Engineer in administering the construction works on the two road
sections (the Section A-380 25 km and the Section 4P180 4 km) under the contracts.
(ii) For the Section A-380 25 km administration of the Contract should be conducted in
accordance with the General and Particular Conditions on the basis of Conditions of
Contract for Construction “building and engineering works designed by the Employer”
of the International Federation of Consultant Engineers (FIDIC), International
Development Bank, 2017 edition.
(iii) For the Section 4P180 4 km, administration of the Contract should be conducted in
accordance with the Contract Conditions based on ADB SBD Works-Small,
December 2021;
(iv) Review and approve the detailed design of the Contractor (cost estimates,
specifications) and, if necessary, instruct the Contractor to make appropriate
adjustments, for the Section 4P180 4 km:
- Ensure that the designs prepared by the Contractorcontractor are in conformity
with the defined specifications and/or meet the required performance criteria as
appropriate.
(v) Approve the digital terrain model and shop drawings for road construction by the civil
works contractor (the Contractor) for both road sections;
(vi) Ensure that the permanent and temporary works have been designed and are
constructed in accordance with the Contracts technical specifications and standards;
(vii) Advise the EA on all matters concerning implementation of the contracts including
quality control, work progress, implementation issues, dispute resolution, and
arbitration or litigation, amendments to the contracts, contract termination,
certification of payments;
(viii) Ensure compliance with environment and social protection measures, including
environment management plans and traffic management plans;
(ix) Provision of training for the EA personnel on Contracts implementation supervision
and other procedures related to control of the construction site and administration of
contracts; and
(x) Any other functions laid upon the Engineer under the Contracts.

3. Scope of services, tasks (components) and anticipated reporting documentation

9. The EA intends to conduct separate bidding processes for the Sections A-380 25 km and
4P180 4 km and award two civil works contracts. Procurement of these contracts shall be
performed simultaneously, and the contracts are planned to be awarded at the same time.
10. The Consultant shall administer and supervise the implementation of construction contracts.
Performing these functions, the Consultant shall monitor the minimization of environmental
impact and the implementation of measures to reduce greenhouse gas emissions.
11. The Consultant will be entrusted with all the functions and responsibilities of the "Engineer"
in accordance with the General and Particular Conditions of the Contracts for the Section
A380 25 km and the “Project Manager” for the Section 4P180 4 km.

1. Verification and approval of design documents

The Consultant shall review the detailed design documentations for 2 civil works contracts and, if
necessary(i) propose amendments within the first 45 days after the Consultant is mobilized for 25
km section Contract, (ii) instruct the Contractor to revise its design for 4 km section Contract.
Provides a periodic report on the status of the project to the EA and ADB on the reviewed design
documentation, shall reflect any problems and difficulties and proposed solutions.

2. Administration of contracts and construction supervision

12. General provisions:

(i) Construction works will be carried out in accordance with the General and Particular
Conditions of the Contract. Accordingly, the EA will act as the “Employer”, and the
Consultant will perform the functions of the “Engineer”, in connection with which, the
Engineer will receive the approval of the Employer before taking any action, in
accordance with the specific conditions of the Contracts;
(ii) The Consultant shall supervise the construction works under the contracts and carry
out daily supervision of the construction works on the sites, following the construction
supervision procedures based on international practice: (i) ensure the construction
of the project in accordance with the provisions of the construction contracts; (ii)
monitor implementation of the project within the agreed schedule and budget and in
accordance with the quality standards and protective measures established in the
Contracts; (iii) monitor compliance with protective measures and ensure the
implementation of appropriate measures to minimize impact during the
implementation of the Project; (iv) liaise with local residents and assist in identifying
and resolving issues and complaints; and (v) advise the EA on issues related to the
implementation of the Project;
(iii) The Consultant shall report to the EA and ADB on issues related to the project
implementation. The Consultant shall also participate in ADB review missions on
construction sites, and, together with the EA, shall take necessary measures for
solution of all arising issues;
(iv) The Consultant shall assign the Engineer’s representative which shall constantly
work on the project area;
(v) The Consultant should use a control system that will manage his own actions. The
quality plan must comply with the latest requirements published by the International
Organization for Standardization (ISO). Within one month after the commencement
of provision of services, the Consultant must submit a draft Quality Plan, covering
the various functions that should be carried out during studying the design

documentation and supervising the implementation of construction contracts. The
Consultant should amend the draft Quality Plan to the extent agreed with the EA.
Additionally, the Consultant must work throughout his appointment in accordance
with the procedures and requirements of the Quality Plan.

13. Construction Supervision: Consultant, as the Engineer, is responsible for performance of all
tasks, defined in the General and Particular Conditions of the Contracts. The Engineer’s
functions shall include, but not limited to, the following:

(i) Ensure that the Notice of Commencement is issued to the Contractor with clearly
specified date of the project commencement;
(ii) Monitor the land acquisition process and resettlement measures, performed by the
Employer, and render necessary assistance when needed;
(iii) Cooperate with the local authorities to ensure that all affected utilities are promptly
relocated, in order to avoid any work disruption;
(iv) Ensure that the construction site / right of way, free of any encumbrances, are
handed over to the Contractor in accordance with the agreed schedule, or inform
the Contractor of possible delays in handing over the project construction site;
(v) Ensure that the Contractor provides all required bank guarantees (performance
securities, advance payment security and securities to release the withheld
amount, if any), as well as insurance policies required under the contracts;
(vi) Review the Contractor’s work program (or revised work program) and approve so
that the Contractor starts their implementation. Where necessary, to facilitate
agreement between the Employer and the Contractor regarding the work program
and to ensure that construction works are carried out in accordance with the
approved work program. The Engineer will keep the Employer informed of any
delays or possible delays in the schedule of work under the contracts, and will take
all necessary measures to prevent possible delays;
(vii) Ensure that all construction equipment is mobilized by the Contractor in
accordance with the work program / Contracts and check the equipment of the
Contractor;
(viii) Review the detailed design documentations and drawings for 2 civil works
contracts and, if necessary(i) propose amendments for 25 km section Contract, (ii)
instruct the Contractor to revise its design for 4 km section Contract in accordance
with the specifications of the Contracts and the Contractor's quality control plan;
(ix) Provide explanations and issue additional drawings to the Contractor and / or
approve alternative drawings, provide the Contractor with all necessary survey
data to facilitate its work and avoid possible delays in its implementation and, if
necessary, issue additional drawings for 25 km road section contract;
(x) Examine and approve all material sources revealed by the Contractor;
(xi) Examine the test results of materials and soil to ensure compliance with the
specifications and notify the Contractor immediately if such materials and work do
not comply with the specifications;
(xii) Keep record of all test works, including cross-reference to work items to which
each test relates and where the test samples were received;
(xiii) Supervise the work of the Contractor on all matters relating to the safety of
personnel and the local population, ensure the safety of construction works,
including the provision of personal protective equipment, lights, railings, fences
and security. The Consultant should develop written safety monitoring and
reporting procedures;

(xiv) Regularly monitor and inspect the implementation of quality control by the
Contractor and quality assurance programs to ensure that the quality of the
finished works complies with the standards and technical provisions of the
contract. This includes regular examination of the material testing program;
(xv) Conduct regular inspections of the quality system of the Contractor and
Subcontractors to ensure that the system requirements and quality objectives of
the EA are complied with. Quality checks should be carried out at least on a
semiannual basis. The Consultant shall report all nonconformities to the Executing
Agency after each check and explain what actions the Contractor should take to
eliminate each nonconformity;
(xvi) Assess and verify laboratory and field tests carried out by the Contractor and
conduct independent tests;
(xvii) Prepare reports on nonconformities and proposals on their elimination;
(xviii) Monitor the progress of construction works based on project management
computer technologies;
(xix) Convene regular field meetings with the Contractor to discuss issues and problems
affecting the progress of works, and inform the Employer;
(xx) Coordinate actions with relevant local authorities / institutions in order to minimize
disruption to the program;
(xxi) Consider and comment on the monthly reports submitted by the Contractor, with
detailed description of the works completed over the past month according to the
approved schedule, issues and difficulties encountered by the Contractor and
other issues, at the request of the Employer;
(xxii) Assist the EA in the consideration of Contractor's applications for subcontracting
part of the works, and in eliminating ambiguities in the Contracts documentation, if
any;
(xxiii) Take measurements of completed work and keep detailed records of them;
(xxiv) Constantly keep records, which should include the following, but not limited to:
correspondence with the construction site, survey data, work program, test results
of materials, quality acceptance data, daily logs of the construction site, records of
used equipment, labor and materials, measurement and certification, minutes of
meetings, and records of all data / reports / certificates / reporting, etc., under the
Contracts;
(xxv) These data must be submitted to the EA after expiration of the Contracts for
consulting services;
(xxvi) Prepare quarterly cash flow forecasts for the Employer in an acceptable format in
which cash flow should determine the budget estimate for all outstanding works;
(xxvii) Measure quantities of works and verify the intermediate and final payment
certificates for submission to the Employer;
(xxviii) Evaluate and make necessary recommendations to the Executing Agency at the
request of the Contractor to extend the deadline for completion of the works,
applications for additional payment, amendments to the contract, changes in the
scope of works, any disputes, etc;
(xxix) Review all requirements presented by the Contractor and advise the Employer on
the validity of the claim, the impact of such claim on the construction period and
cost of the project;
(xxx) Advise and assist the Employer with respect to arbitration or litigation relating to
the project, if necessary;
(xxxi) Issue acceptance certificates for satisfactory completion of works in accordance
with conditions of the contract;

(xxxii) Upon completion of works, check the Contractor’s as-built drawings as real
evidence of construction works, and ensure that the works were performed in
accordance with all provisions of the Contract, including those related to the
qualifications of workers, safety measures and compliance with protective
measures;
(xxxiii) Conduct environmental monitoring, including all the requirements of the project’s
Initial Environmental Impact Survey (IEIS), in order to ensure that the construction
methods proposed by the Contractor are satisfactory, with particular specifications
of environmental standards based on the ADB’s Safeguard Policy Statement
(SPS) 2009;
(xxxiv) Prepare, together with the Contractor, an environmental management plan for
construction sites. This task must be completed before construction commences;
(xxxv) Ensure that construction works are carried out on the basis of environmental
management plans to minimize environmental impact, as described in the IEIS.
The status of the implementation of environmental management plans and
environmental monitoring reports are described in the Engineer's reports to the EA
and ADB;
(xxxvi) Preparation of internal land acquisition and resettlement reports (including
restoration of livelihoods and monitoring the employment of members of affected
and vulnerable households) in accordance with the land acquisition and
resettlement plan (LARP) prepared by the EA in accordance with the ADB
Safeguard Policy Statement (SPS) 2009;
(xxxvii) Ensure minimal negative impact on local communities when approving the
Contractor’s work program, including monitoring the impact of construction works
on local communities, as well as reporting on impact monitoring for the Employer;
(xxxviii) Ensure that child labor is not used for construction works or other activities related
to the project;
(xxxix) Ensure that women have access to skilled labor;
(xl) Monitor the implementation of the health and safety program on the territory of the
work camp, including the awareness-raising campaign on sexually transmitted
diseases and HIV/AIDS (human immunodeficiency virus / acquired
immunodeficiency syndrome), which should be gender-sensitive, which is required
in compliance with the construction Contracts (for example, the Contractor must
provide HIV prevention training for his workers); and
(xli) Provide training on construction supervision for EA personnel on the job at the
construction site, Contracts administration, quality control and quality assurance,
protection measures, monitoring and evaluation, and other activities.

14. Monitoring the project performance / Benefit monitoring and evaluation: the Consultant
should create a system for monitoring the project performance in accordance with the project
implementation period. In this case, the Consultant shall:

(i) Determine, on the basis of the project, performance indicators and target indicators
to be monitored during the implementation of the project, and create a data and
statistics collection system for such monitoring;
(ii) Conduct a baseline study on performance indicators and establish a set of baseline
data, based on which the project impact will be reviewed;
(iii) Collect the necessary data and conduct other relevant surveys before the start of
construction, after the 1st and 2nd year from the start of the project and
immediately after the completion of the project;

(iv) Assess the socio-economic impacts and environmental sustainability of the project;
(v) Incorporate findings and supporting data into the project completion report; and
(vi) Provide training on operational methods of social research and build the EA’s
capacity.

15. Actions requiring the Employer’s special approval: The Consultant will be required to obtain
prior approval of the Employer in the following cases:

(i) Approving subletting of any part of the works;


(ii) Certifying additional cost;
(iii) Determining an extension of time;
(iv) Issuing a variation order for the quantities of works, which cause financial
implications, and;
(v) Fixing rates or prices under any work item.

Assignment Duration

16. The services of construction supervision consultants will be provided for 24 calendar months for
25 km section, 18 calendar months for 4 km section and 12 calendar months (with a reduced
number of personnel) during the defect identification period under both construction contracts.
The consulting services Contract is expected to start in June 2023 in both sections.

Consultant’s team composition and required qualifications of the key specialists

17. It is estimated that the Executing Agency will require 88 man-months of international consultant
services and 133 man-months of national key consultant services to complete the tasks. The
need for various specialists and duration of their engagement is indicated below. However,
consultants may offer additional personnel without going beyond the budget that may be
required to complete the tasks.

15. The personnel indicated above should be assisted by the Consultant with the appropriate
number of translators and support staff to properly perform their functions, and the expenditures
should be indicated in the costs at their own expense. The hiring of such personnel, including
non-key specialists, does not require approval.

Reporting Requirements for 25 km and 4 km sections

16. The Consultant will prepare and submit the following reports, three copies in English and three
copies in Russian to the “Avtoyulinvest” Agency and two copies to ADB. All reports will also be
submitted electronically by email.

(i) Inception report including the report on the performance indicators to be monitored
during and at the end of the implementation of the Project, to be submitted within
1 month of mobilization. This report will also include a review of the design
specifications and estimates;
(ii) Report on the data-collection system and the baseline survey for the Project
Performance Monitoring/Benefit Monitoring and Evaluation, to be submitted within
3 months of mobilization;
(iii) A weekly one-page report on the progress of works and any issues related to
works;
(iv) A daily one-page report on the progress of works (submitted by email to
“Avtoyulinvest” Agency Program Management Unit (PMU) on a daily basis);
(v) Monthly reports, to be submitted within 7 days after the end of each month, to
include schedules of Contracts payments and variation orders, graphical
representations of progress against program based on the approved Contracts
schedules, charts of physical progress on major items, relevant photographs, and
details of impediments to the works and proposals for overcoming them. Further
details of the monthly report are provided in subsequent section;

(vi) Quarterly progress reports covering all aspects such as progress monitoring,
quality assurance/quality control, status of any delays, contractual requirements,
and details of all financial projections, to be submitted within 14 days of the end of
each quarter;
(vii) Environmental monitoring reports (semi-annually during construction and annually
during operation);
(viii) LARP update and corrective action plan (if required), LARP implementation
completion report, semi-annual social monitoring reports and benefit monitoring
report during project implementation;
(ix) Annual appraisal reports covering all aspects such as progress monitoring, quality
assurance/quality control, status of any delays, contractual claims, and details of
all financial projections, to be submitted within 14 days of the end of each year;
(x) Project completion report, within 3 months of substantial completion of the civil
works contracts (not included the Defects Liability Period);
(xi) Maintenance Manual detailing routine and periodic maintenance tasks that will be
required to maintain the completed Project, to be submitted within 12 months of
commencing services;
(xii) In case of any accident related to occupational and community health and safety,
assist the “Avtoyulinvest” Agency to (i) report to ADB within 72 hours, and (ii)
prepare and submit an incident report with action plan within 7 days of the
occurrence.

Performance of Duties of the Engineer/Project Manager

17. The Consultant shall perform the duties and authority of the Engineer (25 km Section) or
Project Manager (4 km road Section) as specified in or necessarily implied from the Contracts
as well as administer the Contracts, dealing with situations in accordance with the contracts,
taking due regard of all relevant circumstances; the Engineer shall perform his duties or act:

(i) proactively, where the initiative lies with the Engineer in administering the
Contracts;
(ii) reactively, in response to the Contractor’s or the Employer’s requests; and
(iii) passively, in observing the requirements of the Contract.

18. Wherever appropriate and not in conflict with the Contract, the Consultant shall exercise
every reasonable care to protect the interests of the Employer.

19. The Engineer shall have the following reporting obligations during supervision of the Works.

Inception Report

20. The Inception Report will illustrate the planning process that the Consultant has established
for the assignment. It will describe the staffing and remarks of the Consultant regarding the
assignment as deemed appropriate. This Report will outline how the Consultant intends to
implement the project, clearly differentiating between the activities for supervision of the
construction. The Inception report will also include the report on the performance indicators
to be monitored during and at the end of the implementation of the Project, as well as a report
on a review of the design specifications and estimates. The Consultant will provide templates
for the Monthly Reports and Quarterly Progress Reports for the Employer’s consideration.

The Consultant’s Work Program Report

21. Within 28 days of issuance of the Engineer’s consent to the Contractor’s Work Program, the
Engineer shall submit a report to the Employer (Engineer’s Work Program Report), which
shall include:

(i) copy of the Contractor’s detailed cash flow estimate, in monthly periods, of all
payments to which the Contractor will be entitled under the Contracts;
(ii) copy of the Contractor’s detailed time program showing the order in which the
Contractor intends to carry out the Works, including general description of the
methods which the Contractor intends to adopt, and of the major stages, in the
execution of the Works and other information as may be deemed necessary and
appropriate by the Engineer;
(iii) a supporting report which shall include:
 a list of critical path items and the related Contractor’s estimate of delivery
periods, accompanied with the Engineer’s estimate of the latest delivery periods
for each critical path item to warrant the completion in accordance with the
Contract;
 for the manufacture of each main item of Plant and Materials, the name of the
manufacturer, manufacture location and the expected dates of:

(i) Commencement of manufacture;


(ii) Contractor’s and/or the Engineer’s inspections and tests; and
(iii) Shipment and arrival at the Site.

 the materials and plant selected by the Engineer for inspections and tests
including an appropriate specification of the tests to be carried out and the
associated arrangements;
 the names and particulars of the Contractor’s representative and other
superintendence personnel approved by the Engineer in accordance with the
Contract;
 the names of Subcontractors consented by the Engineer in accordance with the
Contracts and for each Subcontractor the cost and quantity of the subcontracted
Works. This section shall include a brief justification for the Engineer’s consent;
 copies of all notices, consents, approvals, certificates or determinations given
or issued by the Engineer within the reported period; and
 other information as may be required by the Employer.
Monthly Progress Reports

22. The Engineer shall prepare and submit to the Employer monthly progress reports. The first
report shall cover the period up to the end of the first calendar month following the Engineer’s
Work Program Report. Each monthly progress report shall include:

(i) brief summary information about any events or circumstances which, in the
Engineer’s opinion, may create sufficient grounds for any time and/or cost overrun
under the Contracts and the Engineer’s recommendation of the measures being
(or to be) adopted to overcome such events or circumstances and the contractual
basis therefore;
(ii) comparison in the form of a chart showing the Contractor’s original cumulative
cash flow estimate, in monthly periods, of all payments to which the Contractor will

be entitled under the Contracts and the actual payments certified by the Engineer
up to the end of the reporting period. In the event of the cumulative amount of the
actual monthly payment certificates being lower than the Contractor’s estimate, the
Engineer shall accompany the chart with a supporting report and provide:

 details of any events or circumstances that have caused the discrepancy;


 an assessment of the significance of such events or circumstances, including
the Engineer’s opinion, on whether these may jeopardize the physical
completion of relevant works in accordance with the Contract;
 a report on the measures being (or to be) adopted to overcome delays in
respect of each event or circumstances and the contractual basis therefore.

(iii) comparison of the actual percentage completion of delivery compared with the
planned for each critical path item identified in the Engineer’s Work Program
Report. Where any delivery is behind the program, the Engineer shall give
comments on the likely consequences and state the remedial action being (or to
be) taken;
(iv) comparison of the actual percentage completion of delivery compared with the
planned for each main item of Plant and Materials, if not included in the list of
critical path items;
(v) information about the use of provisional sums and an appropriate justification
therefore;
(vi) photographs showing the status of manufacture and of progress on the Site;
(vii) copies of quality assurance documents, test results and certificates of materials;
(viii) safety statistics, including details of any hazardous incidents and activities relating
to environmental aspects and public relations;
(ix) copies of all notices, consents, approvals, certificates or determinations given or
issued by the Engineer within the reported period; and
(x) other information, as may be required by the Employer.

Quarterly Progress Reports

23. The Consultant will prepare a comprehensive report summarizing all supervision activities at
the end of each quarter, including the progress of the Contract, Contracts variations and
change orders, ESHS and training activities, the status of Contractor claims, if any, brief
descriptions of problems encountered and other relevant information. Quarterly progress
reports will cover all aspects such as progress monitoring, quality assurance/quality control,
status of any delays, contractual requirements, and details of all financial projections, to be
submitted within 14 days of the end of each quarter.

Variations

The Engineer shall note that the Employer should obtain ADB's prior approval for any variation to
the terms and conditions of the contract which, in aggregate, will exceeds 15% of the original
Contract price.
24. The Engineer shall ensure that the Employer shall comply with the procedures agreed with
ADB. Unless, in the opinion of the Engineer, an emergency occurs affecting the safety of life
or of the Works or of adjoining property, the Engineer shall provide a preliminary report to the
Employer on any prospective variation which shall outline the basis for the Engineer’s
valuation of the variation including but not limited to the following:

(i) The Engineer’s opinion on the extent, if any, of applicability to the varied Works of
the rates and prices set out in the Contract. When expressing his/her opinion, the
Engineer shall take into account the actual or expected currencies of cost (and the
proportions thereof) of the inputs of the varied work without regard to the
proportions of various currencies set out in the Contract;
(ii) The quantity and the value of the varied Works that can be determined using the
rates and prices set out in the contract;
(iii) The quantity and the Engineer’s estimate of the value of the varied Works, which
can be determined using the rates and prices set out in the Contracts as the basis
for valuation: the Engineer shall provide a detailed breakdown of the rates and
prices set out in the Contracts and identify the price components that the Engineer
used or intends to use for the valuation of the varied works;
(iv) The quantity and the Engineer’s estimate of the value of the varied Works, which
can only be determined using the rates and prices agreed to be agreed upon
between the Engineer and the Contractor: The Engineer shall provide to the
Employer an appropriate justification of the basis for the agreement.

Contractor’s Claims

25. In the event of receipt of a notice of claim from the Contractor, the Engineer may monitor the
record-keeping and/or instruct the Contractor to keep further contemporary records. The
Contractor shall permit the Engineer to inspect all these records, and shall (if instructed)
submit copies to the Engineer.
26. Within 42 days after receiving a claim or any further particulars supporting a previous claim,
or within such other period as may be proposed by the Engineer and approved by the
Contractor, the Engineer shall respond with approval, or with disapproval and detailed
comments. He may also request any necessary further particulars, but shall nevertheless
give his response on the principles of the claim within the above defined time period.
27. Within the above defined period of 42 days, the Engineer shall proceed to agree or determine
(i) the extension (if any) of the Time for Completion (before or after its expiry), and/or (ii) the
additional payment (if any) to which the Contractor is entitled under the Contract.

Qualification Requirements and Responsibilities of Key Personnel for 25 km and 4 km sections


a. International Consultants

1. Team Leader / Chief Resident Engineer / Highway Engineer (The Engineer’s


representative)

Qualification Requirements

Education:

Bachelor’s Degree in Civil Engineering with a post-graduate in highways/construction


management or related fields.

Experience:

No less than 15 years’ road project related experience with 10 years’ latest experience on similar
projects involving reviewing of designs and supervision in cement concrete pavement
construction as Resident Engineer/Project Manager. Minimum 5 years of international experience

on similar projects and 5 years in administration of contracts with ADB/World Bank assistance.
The Team Leader should be familiar with various international construction standards, and
preferably be a permanent employee of a consulting firm that implements this consulting package.
The Team Leader should also have an experience of working in similar projects administered
under the FIDIC Conditions of Contract, including Red Book (2017). Fluency in Russian will be
an advantage.

Responsibilities:

a. Function as the Engineer in administering the civil works Contract in accordance with the
conditions of Contract;
b. Review and approve the detailed design prepared by the “Avtoyulinvest” Agency for
construction of the road in accordance with the technical specifications and Uzbekistan’s
Road Construction Standards;
c. Ensure that the permanent and temporary works are constructed in accordance with the
provisions of the Contracts; and
d. The duties of the Consultant shall include, but not be limited to:

(i) ensuring that the Notices to commence have been issued;


(ii) reviewing and agreeing with the Employer, the Contractors’ work programs and
subsequently monitoring the construction progress in accordance with Contracts
requirement;
(iii) ensuring with the assistance of Resident Engineers that the contractors are
granted Possession of site in accordance with the agreed programs or otherwise
providing advance notice to the Employer of possible delays due to lack of
possession;
(iv) reviewing with the assistance of Resident Engineer all surveys, field investigations,
designs, drawings and specifications, recommending any changes needed to
provide more cost-effective solutions, and approving the design, drawings and
changes in the specification;
(v) throughout the services, consulting and maintaining close liaison with the
“Avtoyulinvest” Agency, Khokimiyats other relevant agencies, including the GAI
(State Traffic Police) State Committee for Natural Protection, Uzbeknefttgaz,
Uzbekenergo, Uzbek Telecom, Irrigation System Authority, and other Government
and regional authorities, and local stakeholders;
(vi) measuring the works with the assistance of Resident Engineers, agreeing and
certifying interim and final payment certificates for submission to the employer, and
assisting the Employer in preparing withdrawal documentation to ADB;
(vii) administrating, assessing and, where appropriate, making recommendations on
applications for extension of time, claims for additional payment and other
contractual disputes;
(viii) issuing site instructions, technical instructions, variation orders, provisional sum
order and day works orders, as appropriate;
(ix) monitoring with the assistance of Resident Engineers the Contractors’ laboratory
testing and carrying out Independent testing as required;
(x) checking the Contractors’ working and “as built” drawings;
(xi) preparing a final report, which will be a compilation and condensation of data
presented in regular monthly progress reports, together with copies of as built-
drawings;

(xii) develop training programs for the “Avtoyulinvest” Agency staff and providing on-
the-job training for the “Avtoyulinvest” Agency’s staff in carrying out construction
supervision, including Contracts administration, quality control, monitoring and
evaluation, and other relevant activities. The on-the-job training will also cover the
operation of the environmental monitoring system and the project performance
monitoring system;
(xiii) assist with the help of Chief Resident Engineer land acquisition and resettlement
activities being undertaken by the Government and the provincial authorities, and
include reports on these activities in the monthly progress reports, assist
“Avtoyulinvest” Agency and other authorities in the administration of any
resettlement activities, including arranging consultation with local people, as well
as affected people, preparation and serving of notices to affected people, liaising
with affected people and ensuring that any communications and grievances raised
by affected people are promptly passed onto the relevant authorities;
(xiv) developing and operating a quantitative and qualitative project performance
monitoring system (PPMS) in consultation with ADB and “Avtoyulinvest” Agency to
monitor and evaluate the performance of the project in relation to its goals,
purposes and outputs, Base line value shall be established for (a) traffic Volumes
and journey times; (b) freight tariffs and bus fares,(c) environmental impact
indicators,(d) socio-economic indicators and (e) social and poverty reduction
impact indicators, Where relevant , and evaluation monitoring indicators would be
measured at the necessary agreed frequency during the project. Measurements of
these indicators, together with relevant comments would be included in the
quarterly progress reports as well as the final completion report;
(xv) updating detailed social screening and mitigation plans prepared by the
“Avtoyulinvest” Agency with the help of Social Specialist, if necessary, and develop
poverty monitoring impact monitoring systems;
(xvi) ensure with the help of Environmental Specialist that the construction methods as
proposed by the contractor for carrying out the works are satisfactory, with
particular references to the technical requirements of sound environmental
standards on the basis of ADB Environment Source Book and World Bank Group’s
Environment, Health and Safety Guidelines, as referenced in ADB’s Safeguards
Policy Statement inspection of contractors’ construction equipment, safety of the
works, property, personal and general public and the recommendations of the initial
environmental examination (IEE) and summary IEE;
(xvii) updating with the assistance of Environmental Specialist, environmental
monitoring plan and implementing this plan as part of project implementation
project implementation report, and carry out environmental management seminars
for contractors and “Avtoyulinvest” Agency staff;
(xviii) in case resettlements impacts are found during implementation, prepare
resettlement plans with the assistance of Resettlement Specialist as per ADB’s
Safeguards Policy Statement;
(xix) monitor the implementation of the health and safety program at camp site including
the information and education campaign on assistance of Resident Engineer
sexually-transmitted diseases and HIV/AIDS (human immunodeficiency
virus/acquired immunodeficiency syndrome) as required by the civil works
contracts;
(xx) preparing monthly progress reports, in a form agreed with the Employer and ADB
and submitting these within 7 days after the end of the reported month.
(xxi) preparing quarterly progress reports, in form agreed with the Employer and ADB
and submit these within 14 days after the end of the reporting periods, these

reports are to cover physical progress, financial progress, loan withdrawal,
compliance with the environmental mitigation requirements, results of the project
performance monitoring system and result of other environmental monitoring;
(xxii) assist the Employer in the interpretation of civil works contracts and provide
practical assistance to resolving any claims arising from the Contracts.
e. Advise the “Avtoyulinvest” Agency on all matters concerning implementation of the
Contracts including quality control, work progress, implementation issues, and arbitration
or litigation etc.

2. International Bridge Specialist /Structural Engineer

Qualification Requirements

Education:

The Bridge Specialist/Structural Engineer shall have at least a bachelor’s degree in Bridge
Design/Bridge Construction.

Experience:

10 years of experience as a Bridge Engineer on highway design projects. Knowledge of the


Russian at the working level and experience in the CIS countries are desirable.

Responsibilities:

The duties of the Bridge and structural engineer shall include, but not limited to:

(i) Supervise construction and installation work on bridges and structures:


(ii) Determine schedule, methods, and procedures for review of detailed working documents
and drawings for bridges, culverts, and other artificial structures as part of the project;
(iii) Review and coordinate contractors' construction methods and program for both temporary
and permanent structures;
(iv) Verify that the load capacity or rating of existing bridges has been evaluated to ensure that
the design axle load is safe to pass;
(v) Examine general arrangement drawings (GAD) and alignment plan showing the major
features of bridges and structures proposed to be built/reconstructed on the project site;
(vi) Analysis of overall length, span location, cross-section, deck level, base level, type of
bridge components (superstructure, substructure, foundations, supports, expansion joints,
etc.);
(vii) Verify executive documents in accordance with the design standards, criteria, and
conceptual design provided in the Contract;
(viii) Ensure that technical specifications in the bidding documents and road construction
standards are properly considered in the preparation of design documents;
(ix) Provide periodic status reports in accordance with the approved schedule;
(x) Identify any difficulties and propose solutions;
(xi) Assist the Consultant Team Leader in establishing effective implementation procedures;
(xii) Standardize testing and quality requirements for all geotechnical and material surveys for
bridges and structures;

(xiii) Maintain communication with all members of the Engineering team for the design and
construction of bridges and structures.

3. International Material Engineer

Qualification Requirements

Education:

Civil Engineering Degree, preferably with post-graduation in geotechnical engineering or material


engineering.

Experience:

Preferably ten (10) years of similar experience in the field of quality control of construction
materials, laboratory and field testing of cement concrete materials according to ASTM (American
Society for Testing and Materials), AASHTO (American Association of State Highway and
Transportation Officials), including 5 years of international experience. Knowledge of the Russian
/ Uzbek language at the working level and experience in the CIS countries are desirable.

Responsibilities:

The duties of the Consultant shall include, but not limited to:

(i) Finalize specifications of various construction materials for pavement construction and
standard tests on construction materials as well as on completed works;
(ii) Assist the Team Leader in establishing effective implementation procedures;
(iii) Provide certification of the due quantity and quality of all works, based on cross-checking of
on-site approvals by the Site Engineers;
(iv) Supervise the standardization of tests and quality requirement for all geo-technical and
material exploration (both soil and rock) for bridges and drainage crossings, high
embankment, cut slope susceptible to erosion/ land slide; various laboratory testing of soil
samples;
(v) Review and approve the mix design of base course and subsequent courses submitted by the
contractor, and ensure that they meet the requirements of the contract;
(vi) Review geotechnical investigation requirements of the project;
(vii) Advise in geotechnical matter during construction supervision.

4. International Procurement/Contract Specialist

Qualification Requirements

Education:

Degree in civil engineering, law, procurement or relevant discipline.

Experience:

Recent experience of at least 15 years as a procurement and Contract specialist in road projects;
at least 5 years of international experience as a Contract specialist in various road projects carried
out in accordance with the conditions of the FIDIC contract, should have experience in conducting

arbitration cases, amending the contract, providing extension of time, claims and solutions, etc.
The International Procurement/Contract Specialist shall have a thorough understanding of the
civil works contracts under the FIDIC Conditions of Contract for Construction, Red Book (2017th
edition).

Responsibilities:

The duties of the Consultant shall include, but not limited to:

The scope of works includes but not limited to the following:

(i) Review of all detailed designs (roads and bridges) prior to commencement of the
construction activities services for 25 km and during the construction period for 4
km section;
(ii) Determination of the obligations of the Employer, Contractor and Consultant under
the conditions of the Contracts for their compliance by all parties;
(iii) ensuring the submission of the Contractor's insurance policies and providing
general advice on this policy in connection with the requirements of the Contract;
(iv) assist the team leader in the administration of the Contracts agreement in
accordance with the conditions of the Contract, subject to fulfilling certain
requirements specified for the Engineer for ensuring approval of the Employer,
before taking measures in accordance with the specified clauses of the Conditions
of the Contract;
(v) assist the team leader in evaluating and, if necessary, making recommendations
on applications for extending the time of requirements for additional payment and
other contractual difference;
(vi) assist the Employer in the interpretation of civil works contracts and addressing
the claims for additional payment, works and extension of time by the
Contractor(s);
(vii) assist in formalizing changes to the volumes of the contract, as the case may be;
and
(viii) advise and assist the Employer in arbitration and court cases, if necessary,
participate in such meetings as a representative of the Engineer (as a third
person).

5. International Design Engineer

Qualification Requirements

Education:

Must be a certified civil engineer, with minimum BSc degree from recognized University.

Experience:

The International Design Engineer must be familiar with the design of urban and rural
highways/arterial roads and interchanges/ intersections using cement and asphalt type of
pavements at least in 3 similar projects, with minimum 15 years of relevant experience, of which
preferably 7 or more years international experience (at least 3 countries outside his/her home-
country) in environments similar to that of the project. He/she will have an excellent knowledge of
English language. Knowledge of Russian will be advantageous.

Responsibilities:

The duties of the Consultant shall include, but not limited to:

(i) Review of all detailed designs (roads and bridges) prior to commencement of the construction
activities services for 25 km and 4 km section;
(ii) Approval of drawings for construction;
(iii) Examine and review detailed design drawings (roads and bridges) to identify any significant
aspects that may require modifications prior to construction and inform the Consultant's Team
Leader;
(iv) Verification of executive documents in accordance with the design standards, criteria, and
conceptual design provided for in the Contract;
(v) Ensuring that the contractors' topographic surveys and cross sections to be used for the shop
drawings meet the requirements of the specifications;
(vi) Review of work drawings, particularly for bridges and interchanges, recommending
improvements or changes if necessary;
(vii) Development of construction drawings (As-built drawings).

6. International Environmental Specialist

Qualification Requirements

Education:

Degree in environmental science or equivalent, with post-graduate degree in environmental


studies.

Experience:

No less than 10 years’ latest experience in management of environment mitigation plan / in


establishing procedure for Environmental Mitigation Management system in similar size road
projects funded by the Asian Development Bank/World Bank. International experience as the
Environmental specialist on road projects. Familiarity with ADB’s Safeguards Policy Statement is
mandatory.

Responsibilities:

The duties of the Consultant shall include, but not be limited to:

(i) ensure that the construction methods as proposed by the contractor for carrying
out the works are satisfactory, with particular references to the technical
requirements of sound environmental standards on the basis of ADB Environment
Source Book and World Bank Group’s Environment, Health and Safety Guidelines,
as referenced in ADB Safeguards Policy Statement; inspection of contractors’
construction equipment , safety of the works, property, personal and general public
and the recommendations of the initial environmental examination (IEE) and
summary IEE; (IEIS)
(ii) Supervise field work including collection of samples for environment assessment,
assess environmental impacts directly caused by construction activities, and
indirectly caused by the change in the traffic conditions;

(iii) Prepare and run a standardized model for monitoring greenhouse gas emissions.
Such model will be prepared in consultation with the Employer and ADB;
(iv) Updating initial environmental examination (IEE) report and, if necessary,
implementing this plan as part of project implementation project, and carry out
environmental management seminars for contractors and the “Avtoyulinvest”
Agency staff;
(v) Render assistance to the Employer in any required matters regarding preparing
environmental management reports for submission to the state authorities and
ADB;
(vi) During the final stage of the project, the consultant will carry out a detailed impact
assessment (separate report), which will contribute to the preparation of the project
completion report.

7. International Social / Resettlement / Gender / Benefit Monitoring Specialist

Qualification Requirements

Education:

Degree in social sciences or equivalent, with post-graduate degree in anthropology, sociology,


and development studies will be preferred. Familiarity with ADB’s Safeguards Policy Statement
is mandatory.

Experience:

No less than 10 years’ latest experience in resettlement programs for road / infrastructure projects
in developing countries. International experience in preparing land acquisition and resettlement
plans, and monitoring the implementation of such plans covering all aspects of potential social
impacts.

Responsibilities:

The duties of the Consultant shall include, but not be limited to:

(i) Assess the land acquisition and resettlement plan prepared by the Employer;
(ii) Reviewing the implementation of the plan in terms of payment of compensation
and management of any grievances. Assist land acquisition and resettlement
activities being undertaken by the Government and the local authorities, and
include reports on these activities in the monthly progress reports;
(iii) In consultation with the local government authorities, complete the remaining
implementation of the resettlement plan, before the start of construction works;
(iv) assist the “Avtoyulinvest” Agency and other authorities in managing any
resettlement and gender-related activities, including arranging consultations with
the local population as well as affected people, women's societies, preparing and
submitting applications for the affected people, maintaining contact with people
and ensuring that any messages and complaints filed by affected households are
immediately transmitted to the relevant authorities;
(v) Review detailed social screening and mitigation plan for implementation;
(vi) Ensure minimum disruption of local settlement, monitoring impact and reporting to
the Employer;
(vii) Ensure no child labor used in the construction contract;

(viii) Identify performance indicators to be monitored during implementation;
(ix) Identify performance indicators to be monitored during implementation, carry out
baseline survey on poverty, socio-economic survey, gender development and
employment generation;
(x) Collect required data and undertake other relevant surveys;
(xi) Supervise the construction activities such that unintended impacts are minimized;
(xii) Ensure that the contractor is familiar with the resettlement plan and no deviation
from the plan takes place;
(xiii) In case land is acquired outside the resettlement plan, the consultant will
immediately call for halt of construction works, report to the Employer and ADB,
and put in place mitigation plan for resolving any potential conflicts or complaints;
(xiv) Ensure the grievance-redressed mechanism is operational and provide regular
updates to the “Avtoyulinvest” Agency and ADB. Any new grievances or complaints
will be brought to the attention of the Employer and ADB;
(xv) Maintain close liaison with the “Avtoyulinvest” Agency, other relevant agencies,
regional authorities, and local stakeholders during the implementation of the
resettlement plan;
(xvi) Prepare detailed social screening and mitigation plans, if necessary, and develop
poverty impact monitoring systems; in case new resettlements impacts are found
during implementation, prepare resettlement plans as per ADB Policy on
Involuntary Resettlement;
(xvii) At the end of the project, the consultant will provide a detailed impact assessment
of the resettlement activities, which will contribute to the project completion report.

8. Road Pavement and Quality Assurance Engineer/ Cement Concrete Pavement


Specialist

Qualification Requirements

Education:

Civil Engineering Degree with post-graduate degree in pavement engineering.

Experience:

At least 12 years’ latest international experience in construction of roads, especially cement


concrete pavements.

Responsibilities:

The duties of the Consultant shall include, but not limited to:

(i) Review the contractors’ quality assurance systems - supervision and internal
control system;
(ii) Carry out periodic checks of the pavement quality and report to the Employer and
ADB;
(iii) Verify the contractor’s mix design for concrete pavement, control and inspect the
contractor’s quality control program;
(iv) Ensure compliance of the quality of the finished works with the standards and
technical provisions specified in the contract. This includes regular testing of the
material testing program; conducting regular inspections of the quality systems of

the Contractor and subcontractors to ensure that they meet the Employer's
requirements in terms of quality. The specialist will evaluate and verify laboratory
and field tests performed by the Contractor and conduct independent tests;
(v) Based on the final detailed design, ensure that the contractor’s concrete mix and
concrete tensile strengths fulfill the technical specifications of the contract;
(vi) Suggest international best practices for improving the quality of the pavement
including associated facilities such as the pavement joints;
(vii) Conduct seminars and training sessions for the “Avtoyulinvest” Agency staff to
create knowledge about cement concrete maintenance procedures.

9. International Occupational Health and Safety Specialist

Qualification Requirements

Education:

Bachelor Degree in Liberal Arts / Civil Engineering / any related degree.

Experience:

At least 10 years of general experience in Occupational Health and Safety. Latest experience of
at least 5 years in construction projects, including road construction projects, at least 3 years in
international projects in the CIS countries. Knowledge of national laws and regulations on health
and safety.

Responsibilities:

(i) include but not be limited to the following: Development and implementation of local
instructions and rules for labor protection and safety at the construction site;
(ii) strictly monitor the implementation of the developed instructions on labor protection and
safety at the construction site; preparation of presentations and seminars on labor
protection for the personnel of the Engineer and the Contractor;
(iii) organization of medical examinations of the Contractor and Engineer personnel, as well
as control of their timely implementation; investigation of accidents at the construction site
(if necessary), take all necessary measures to prevent them, as well as report such cases
to the Employer in writing.

b. National Consultants

1. Deputy Resident Engineer/National Highway Engineer

Qualification Requirements

Education:

Degree in Civil engineering with postgraduate in highways.

Experience:

No less than 10-year experience in road construction projects, with a minimum of 10-year latest
experience in similar projects involving review of designs and supervision in pavement

rehabilitation road projects, as Resident Engineer/Assistant Resident Engineer/Project Manager.
Experience of at least one project funded by ADB/WB or international organizations. Knowledge
of GOST standards.

Responsibilities:

The duties of the Consultant shall include, but not be limited to:

(i) Ensuring that the contractors are granted Possession of site in accordance with
the agreed programs;
(ii) Establish the schedule, methods and procedures in consultation with the Team
Leader for the review of detailed engineering design and construction drawings of
the civil works, submitted by the contractor;
(iii) Review the submitted documents in accordance with the design standards, criteria
and conceptual design provided in the Contract. Ensure the hydrological and
hydraulic studies are carried out in accordance with GOST, and other related
standards using in Uzbekistan, and these investigations are carried out for all
drainage structures along the road sections;
(iv) Ensure the contractor carry out detailed analysis and design for all embankments
of height greater than 6 m, the design of embankments should include the
requirements for protection works and traffic safety features;
(v) Ensure that the sections with geometric deficiencies, if any, are identified and
suitable measures for improvement have been suggested for implementation;
(vi) Ensure that the contractor while applying pavement considers specific aspects
relevant to hill regions like terrain & topographic conditions, weather conditions,
altitude effects etc. so that pavement is able to perform well for the design traffic
and service life;
(vii) Ensure that the contractor while designing pavement has considered the effects of
factors like heavy rainfall, frost action, intensive snow and avalanche activity,
thermal stresses due to temperature difference in day and night, damage by
tracked vehicles during snow clearance operations etc. have been considered
along with traffic intensity, its growth, axle loads and design life;
(viii) Ensure that the Technical Specifications in the Bid Documents have been duly
accounted for in the documents submitted by the Contractor;
(ix) Provide periodic status reports of the design and review activities as measured
against the approved schedule, identify any problems and difficulties encountered
and propose solutions;
(x) Liaising with the appropriate authorities to ensure that all affected utility services
are promptly relocated;
(xi) Carrying out checks on the Contractors’ setting out and ensuring that the Works
are carried out in accordance with the drawings and other design details;
(xii) Monitoring the Contractors’ laboratory testing and carrying out Independent testing
as required;
(xiii) Ensuring that Works are executed in accordance with all provisions of the
Contracts, including those relating to standards of workmanship, other safety
requirements and environmental protection requirements;
(xiv) Measuring the works, agreeing and certifying interim and final payment certificates
for submission to the employer in consultation with the Team Leader, and assisting
the Employer in preparing loan withdrawal documentation to ADB;

(xv) Assist Team leader in administrating , assessing and, where appropriate, making
recommendations on applications for extension of time, claims for additional
payment and other contractual disputes in consultation with the Team Leader;
(xvi) Maintaining regular estimates of the cost to completion and time to completion for
the Contracts;
(xvii) Maintaining full and detailed permanent site records, which include site
correspondence, survey data, quality acceptance data, site diaries, measurement
and certification, minutes of meetings and records of all other contractually relevant
matters;
(xviii) Reviewing the Contractors’ proposed program and technical recourses for routine,
emergency and winter maintenance and provide training to staff of the Committee
for Roads who will take over quality control and administration of the maintenance;
(xix) Ensure with the assistance of Environmental Specialist that the construction
methods as proposed by the contractor for carrying out the works are satisfactory,
with particular references to the technical requirements of sound environmental
standards on the basis of ADB environmental guidelines for selected infrastructure
Development project (Highway & Roads) inspection of contractors’ contraction
equipment , safety of the works, property, personal and general public and the
recommendations of the initial environmental examination (IEE) and summary IEE;
(xx) Prepare with the assistance of Environmental Specialist environmental monitoring
and annual report of implementing this plan as part of project implementation
project implementation report, and carry out environmental management seminars
for contractors and “Avtoyulinvest” Agency staff;

2. National Bridge Specialist /Structural Engineer

Qualification Requirements

Education:

The Bridge Specialist/Structural Engineer shall have at least a bachelor’s degree in Bridge
Design/Bridge Construction.

Experience:

10 years of experience as a Bridge Engineer on highway design projects. Knowledge of the


Russian at the working level will be advantageous.

Responsibilities:

The duties of the Bridge and structural engineer shall include, but not limited to:

(xiv) Supervise construction and installation work on bridges and structures:


(xv) Determine schedule, methods, and procedures for review of detailed working documents
and drawings for bridges, culverts, and other artificial structures as part of the project;
(xvi) Review and coordinate contractors' construction methods and program for both temporary
and permanent structures;
(xvii) Verify that the load capacity or rating of existing bridges has been evaluated to ensure that
the design axle load is safe to pass;
(xviii) Examine general arrangement drawings (GAD) and alignment plan showing the major
features of bridges and structures proposed to be built/reconstructed on the project site;

(xix) Analysis of overall length, span location, cross-section, deck level, base level, type of
bridge components (superstructure, substructure, foundations, supports, expansion joints,
etc.);
(xx) Verify executive documents in accordance with the design standards, criteria, and
conceptual design provided in the Contract;
(xxi) Ensure that technical specifications in the bidding documents and road construction
standards are properly considered in the preparation of design documents;
(xxii) Provide periodic status reports in accordance with the approved schedule;
(xxiii) Identify any difficulties and propose solutions;
(xxiv) Assist the Consultant Team Leader in establishing effective implementation procedures;
(xxv) Standardize testing and quality requirements for all geotechnical and material surveys for
bridges and structures;
(xxvi) Liaison with the International Bridge Specialist/ Structural Engineer;
(xxvii) Maintain communication with all members of the Engineering team for the design and
construction of bridges and structures.

3. National Material Engineer

Qualification Requirements

Education:

Civil Engineering Degree, preferably with post-grade in geotechnical engineering.

Experience:

At Least 7 years’ latest experience in construction of roads, quality control for


road/bridges/building working in similar road construction projects. Experience in review of
pavement designs, establishing QA/QC procedures, setting up laboratories, mix designs and
testing procedures. Knowledge of GOST standards.

Responsibilities:

The duties of the Consultant shall include assisting the Team Leader, International Materials
Engineer and Resident Engineer in the following areas, but not be limited to:

(i) Develop specifications of various construction materials for pavement construction


and standard tests on construction materials as well as on completed works;
(ii) Assist the Team Leader in establishing effective implementation procedures;
(iii) Assist Team Leader/Resident Engineer with the certification of the due quantity
and quality of all works, based on on-site cross-checking, considering all aspects,
including thickness of cement concrete pavement;
(iv) Standardization of tests and quality requirement for all geo-technical and material
exploration (both soil and rock) for bridges and drainage crossings, high
embankment, cut slope susceptible to erosion/ land slide; various laboratory
testing of soil samples;
(v) Review and ensure that the pavement design meets the Contracts specifications;
(vi) Review and approve the mix design of pavement courses submitted by the
contractor, in accordance with the Contracts requirements;
(vii) Review geotechnical survey requirements of the project;

(viii) Liaise with all members of the Engineer’s team on the geotechnical requirements
for bridge design; and
(ix) Advise the specialists on geotechnical matters during construction supervision;

4. National Environmental Specialist

Qualification Requirements

Education:

Degree in environmental studies.

Experience:

No less than 7-year experience in preparation and management of environment mitigation plans.
Familiarity with ADB’s Safeguards Policy Statement will be advantageous.

Responsibilities:

The duties of the Consultant shall include assisting the Team Leader, International Environment
Specialist and Resident Engineers in the following areas, but not be limited to:

(i) Assist the international consultant in ensuring that the construction methods as
proposed by the contractor for carrying out the works are satisfactory, with
particular references to the technical requirements of sound environmental
standards on the basis of ADB environmental guidelines for selected infrastructure
Development project (Highway & Roads) inspection of contractors’ construction
equipment, safety of the works, property, personal and general public and the
recommendations of the initial environmental examination (IEE) and summary IEE;
(ii) Carry out field work including collection of samples for environment assessment,
assess environmental impacts directly caused by construction activities, and
indirectly caused by the change in the traffic conditions;
(iii) Collect data for monitoring the greenhouse gas emissions using a standardized
model prepared in consultation with the Employer and ADB;
(iv) Updating initial environmental examination (IEE) report, if necessary, of
implementing this plan as part of project implementation project, and carry out
environmental management seminars for contractors and ADB staff; and
(i) At the final stage of the project, the consultant will carry out a detailed impact
assessment, which will contribute to the preparation of the project completion
report.

5. National Social Monitoring / Resettlement / Benefit Monitoring Specialist

Qualification Requirements

Education:

Degree in social sciences including anthropology, sociology, and development studies.

Experience:

No less than 7 years’ experience in preparing land acquisition and involuntary resettlement plans,
and monitoring the implementation of such plans. Familiarity with ADB’s Safeguards Policy
Statement will be advantageous.

Responsibilities:

The duties of the Consultant shall include assisting the Team Leader, International Resettlement
Specialist and Resident Engineer in the following areas, but not be limited to:

(i) Assess the land acquisition and resettlement plan prepared by the Employer;
(ii) Reviewing the implementation of the plan in terms of payment of compensation
and handling of any grievances. Assist land acquisition and resettlement activities
being undertaken by the Government and the local authorities, and include reports
on these activities in the monthly progress reports;
(iii) In consultation with the local government authorities, complete the remaining
implementation of the resettlement plan, before the start of construction works;
(iv) Assist “Avtoyulinvest” Agency and other authorities in the administration of any
resettlement activities, including arranging consultation with local people, as well
as affected people, preparation and serving of notices to affected people, liaising
with affected people and ensuring that any communications and grievances raised
by affected people are promptly passed onto the relevant authorities;
(v) Ensure minimum disruption of local settlement, impact monitoring and reporting to
the Employer;
(vi) Ensure no child labor is used in the construction contract;
(vii) Identify performance indicators to be monitored during implementation;
(viii) Identify performance indicators to be monitored during implementation, carry out
baseline survey on poverty, socio-economic survey, gender development and
employment generation;
(ix) Collect required data and undertake other relevant surveys as instructed by the
Employer;
(x) Supervise the construction activities so the unintended impacts are minimized;
(xi) Ensure that the contractor is familiar with the resettlement plan and no deviation
from the plan takes place;
(xii) In case land is acquired outside the resettlement plan, the consultant will
immediately call for halt of construction works, report to the Employer and ADB,
and put in place mitigation plan for resolving any potential conflicts or complaints;
(xiii) Ensure the grievance-redressed mechanism is operational and provide regular
updates to the “Avtoyulinvest” Agency and ADB. Any new grievances or complaints
will be brought to the attention of the Employer and ADB;
(xiv) Maintain close liaison with the “Avtoyulinvest” Agency, other relevant agencies,
regional authorities, and local stakeholders during the implementation of the
resettlement plan;
(xv) Prepare detailed social screening and mitigation plans, if necessary, and develop
poverty impact monitoring systems; in case new resettlements impacts are found
during implementation, prepare resettlement plans as per ADB Policy on
Involuntary Resettlement; and
(x) At the end of the project, the consultant will provide a detailed impact assessment
of the resettlement activities, which will contribute to the project completion report.

6. Quantity Surveyor

Qualification Requirements

Education:

Civil Engineering Degree, preferably with post-grade.

Experience:

No less than 5 years’ experience as the quantity surveyor for road construction projects,
implemented on the basis of FIDIC contracts.

Responsibilities:

The duties of the Consultant shall include assisting the Team Leader, International Engineers in
daily supervision, quality control and changes of quantities, justification and comparative check
of the Engineer’s certificates in the following areas, but not be limited to:

(i) establish schedule, methods and procedures for reviewing the Contractor’s
quantities submitted for approval;
(ii) if any errors are found in the submitted quantities, the consultant will provide a
detailed report of the “Avtoyulinvest” Agency to correct these errors;
(iii) review the submitted documents within 28 days, as well as their compliance with
the quantities prescribed by the contract.

During construction:

(iv) Establish a schedule, methods and procedures for reviewing the construction of
all items of the Bill of Quantities (BOP) by the contractor;
(v) Evaluate any cost-effective development methods or other design changes
proposed by the contractor.

7. Road Safety Specialist

Qualification Requirements

Education:

Civil Engineering Degree.

Experience:

At least 6 years’ latest national experience in road construction projects including traffic safety.
Knowledge of GOST standards.

Responsibilities:

The duties of the Consultant shall include, but not limited to:

(i) taking into account the current traffic conditions, the consultant will review the
design from the road safety point of view to ensure that the design complies with
international road safety standards;
(ii) if any errors are noticed in the detailed design, the consultant will provide a detailed
report to the “Avtoyulinvest” Agency to rectify these errors and supervise the
necessary change in the detailed design;
(iii) ensure that the Technical Specifications in the Bidding Documents and
Uzbekistan’s Road Construction Standards have been duly taken into account in
preparation of the design documents; and
(iv) provide periodic status reports of the design and review activities as measured
against the approved schedule, identify any problems and difficulties encountered
and propose solutions.

7. National Occupational Health and Safety Specialist

Qualification Requirements

Education:

Bachelor Degree in Liberal Arts / Civil Engineering.

Experience:

At least 6 years of general experience Latest national experience of at least 3 years in construction
projects, including road construction projects, at least 3 years in international projects in the CIS
countries. Knowledge of national laws and regulations on health and safety is mandatory.

Responsibilities:
include but not be limited to the following:
(i) Development and implementation of local instructions and rules for labor protection and
safety at the construction site;
(ii) strictly monitor the implementation of the developed instructions on labor protection and
safety at the construction site; preparation of presentations and seminars on labor
protection for the personnel of the Engineer and the Contractor;
(iii) organization of medical examinations of the Contractor and Engineer personnel, as well
as control of their timely implementation; investigation of accidents at the construction site
(if necessary), take all necessary measures to prevent them, as well as report such cases
to the Employer in writing.

8. Road Design Engineer

Qualification Requirements

Education:

Degree in Civil engineering with postgraduate in highways.

Experience:

No less than 7-year experience in road construction projects, with a minimum of 7-year latest
experience in similar projects involving examine and review detailed design drawings in road

reconstruction and rehabilitation road projects, as Resident Engineer/Assistant Resident
Engineer/Project Manager. Experience of at least one project funded by ADB/WB or international
organizations. Knowledge of GOST standards.

Responsibilities:

The duties of the Consultant shall include, but not be limited to:

(i) Examine and review detailed design drawings (roads and bridges) to identify any significant
aspects that may require modifications prior to construction and inform the Consultant's
Team Leader;
(ii) Approve drawings as suitable for construction based on their review;
(iii) Verification of executive documents in accordance with the design standards, criteria, and
conceptual design provided for in the Contract;
(iv) Ensuring that the contractors' topographic surveys and cross sections to be used for the
shop drawings meet the requirements of the specifications;
(v) Review of work drawings, particularly for bridges and interchanges, recommending
improvements or changes if necessary;
(vi) Development of construction drawings (As-built drawings).

Non-Key Specialists
All non-key specialists must have sound qualification requirements and experience in their fields,
and comply with the Contracts requirements.

Employer’s Contribution and Counterpart Personnel

1. EA personnel involved in the implementation of the project will serve as a liaison between the
Executing Agency, consultants and contractors, and will also be responsible for the overall
management of the project.

2. The contractor, under the Contracts for construction works, will provide fully furnished offices
on the site and accommodation for consultant staff, including provision of equipment, laboratory
equipment, vehicles, etc. The EA will also provide all relevant project reports, documents, etc.,
relevant to the project and qualified counterpart personnel to work closely with the consultant.

3. Equipment, accommodation and other facilities for the consultant: The consultant will be
provided with logistical support in the form of equipment, vehicles and office space, which will be
purchased under work contracts. The contractor will be directly responsible for this. Logistical
support will include:
(i) Offices at the construction site, including buildings, maintenance and insurance, utilities,
furniture, air conditioning, computer equipment, printers, scanners and copying equipment;
(ii) Vehicles, including vehicles appropriate to the number of construction supervision personnel,
maintenance, taxes and vehicle insurance;
(iii) Equipment, including equipment for examination and inspection;
(iv) Location in the area of the construction site corresponding to the number of construction
supervision personnel, including maintenance, insurance and utilities;
(v) Support staff consisting of surveyor assistants for land surveying and laboratory assistants.

4. The Employer will provide the following initial project data and reports to facilitate the
preparation of the bids:
(i) Request for Proposal

(ii) A pre-bid conference will be held as shown in paragraph 2.3 of the RFP table
(iii) Further clarifications may be requested no later than 21 days before the bid submission
deadline.
