CASE BRIEF

CASE NAME AND CASE LAW:


Jaspreet Singh v. Gurleen Kaur ( CRM-M-36522-2019 (O&M))
(Section 9 of Hindu Marriage Act and Protection of women from
Domestic Violence Act)

FACTS:
An appeal has been filed by the respondent (wife) seeking
maintance from her husband(petitioner). The petitioner moved
an application seeking insurance on the direction to be issued
to the respondent for admission or denial or certain facts
relating to the time period wherein she was employed. The trial
court issued a direction to the respondent in order to clarify the
facts pertaining to the period of her employment.

ISSUE:
Whether the respondent is liable for maintance for the time
period when she was not employed?

JUDGEMENT:
The high court of Punjab and Haryana in its judgment dated 6 th
January, 2020 by the bench consisting of Justice Gurvinder
Singh Gill directed all the family courts to insist on Affidavit of
assets, income and expenditure in all matrimony cases. Further
he stated that in cases of maintance there is a colossal delay in
disposal as in the present case the petition was filed in 2015.
Further the court also gave many directions to be followed by
the Punjab and Haryana high courts while dealing with
matrimony cases.
