DEED OF EXTRA-JUDICIAL SETTLEMENT OF REAL PROPERTY
WITH WAIVER AND PARTITION
KNOW ALL MEN BY THESE PRESENTS:
WHEREAS, SPOUSES GONZALO CAJUCOM and LEONARDA
CAJUCOM., died intestate at Barangay Bucot, Aliaga, Nueva Ecija on April 15, 1989
and January 24, 2003 respectively, leaving no will nor debts settled to date but
leaving a parcel of land;
WHEREAS, at the time of their death, they left as forced heirs, the following
and to wit:
LEODIGARIO F. CAJUCOM of legal age, Filipino, married, and with
residence and postal address at Barangay Bucot, Aliaga, Nueva Ecija;
PONCIANO F. CAJUCOM, legal age, Filipino, married, and with
residence and postal address at Barangay Bucot, Aliaga, Nueva Ecija;
ROMEO F. CAJUCOM, legal age, Filipino, married, and with residence
and postal address at 659 Int. B, Geronimo St. Sampaloc, Manila;
ANASTASIA CAJUCOM representing the late ALEJANDRO F.
CAJUCOM legal age, Filipino, widow, and with residence and postal address
at Barangay Bucot, Aliaga, Nueva Ecija;
MILAGROS C. CAJUCOM representing the late GREGORIO F.
CAJUCOM, legal age, Filipino, widow, and with residence and postal address
at 1950 Narra St., Tayuman, Tondo, Manila;
WITNESSETH:
THAT we are the legitimate children respectively, of GONZALO CAJUCOM,
who died on April 15, 1989in Aliaga, Nueva Ecija; copy of his death certificate is
hereto attached as Annex “A” and LEONARDA CAJUCOM, who died on January
24, 2003 in Aliaga, Nueva Ecija, copy of her Death Certificate is hereto attached as
Annex B;
THAT said deceased died without any will or testament and without any
outstanding debts in favor of any person or entity;
THAT said deceased, at the time of their deaths left a certain real property,
situated in Aliaga, Nueva Ecija and more particularly described as follows, to wit:

WHEREAS, in view of the above facts and circumstances, we are therefore
co-owners and to terminate co-ownership over the same, we hereby adjudicate over
the same in pro-indiviso sharing pursuant to Section 1, Rule 74 of the Rules of Court
of the Philippines, subject to the liabilities imposed by Section 4, of the same rule.
. WHEREAS the parties herein being all of age and full civil capacity,
they have agreed to divide as they do hereby divide and adjudicate, the real
properties, above-described as follows:

attached as ANNEXES “C”, “D” AND “E” respectively;
WAIVER OF RIGHTS
WHEREAS, We, ROMEO F. CAJUCOM , ANASTASIA CAJUCOM, and
MILAGROS C. CAJUCOM (whose personal circumstances are mentioned above)
has agreed and covenanted to CEDE, TRANSFER and CONVEY unto our co-heir
LEODIGARIO F. CAJUCOM and PONCIANO CAJUCOM (whose personal
circumstances are mentioned above) , their heirs and assigns the full ownership and
possession of the above-described property.
NOW, THEREFORE, for and in consideration of the foregoing premises, We
waived and renounced as by these presents, We hereby WAIVE and RENOUNCE
our share, right and participation over the above-described property and the parties
hereto have mutually and voluntarily agreed to PARTITION PLAN and adjudicate
their common property as above described in favor of LEODIGARIO F. CAJUCOM

and PONCIANO F, CAJUCOM their heirs and assigns the full ownership and
possession of the above-described property in the manner as follows:
1. Lot No. 5286-A in the name of LEODIGARIO F. CAJUCOM
3. Lot No. 5286-B in the name of PONCIANO F. CAJUCOM
