PLEB Primer

The People's Law Enforcement Board (PLEB) is a local special body under the supervision of the DILG that aims to improve law enforcement in the community. It is composed of: 1) one member from the Sangguniang Bayan appointed by resolution, 2) one member from the Liga ng mga Barangay chosen by resolution, and 3) three other members appointed by the MPOC, one of whom must be a woman and one a lawyer. Resolutions are needed from the SB, LnB, and MPOC regarding appointments. The mayor then issues an EO adopting the PLEB composition based on these resolutions.

STATUTORY BASIS

Section 43a of RA 6975 amended

NaPolCom MC 2016-02

PLEB is a local special body under the supervision and assistance of the DILG

COMPOSITION

What is needed: SB resolution creating the PLEB (after that, secure the resolutions of SB re their
representative, the Lnb and their representative, and the MPOC with their appointees)

Resolution creating PLEB is a one-time creation, only the composition may vary

1. SB Member representing the SB


(what is needed: resolution of SB appointing the SB member)
2. PB representing the LnB chosen by the Liga
(what is needed: resolution of LnB appointing the PB)
3. 3 other members chosen by MPOC from among the community (not necessarily member
of MPOC) with good background:

a. one must be a woman


b. one must be a lawyer (not suspended and/or should be a regular member of the Bar)
or (substitute in case there’s no lawyer) college grad or principal/supervisor of an
Elem. School

nb: a lawyer who is a woman can already comply the 2 requirements for the members
appointed by MPOC

If the SB rep or LnB rep is a woman, the slot for women is already appropriated as this
provision shall be construed collectively.

The 3 members are removable only for cause (admin case).

If there’s an appointed principal/supervisor, he/she must be the only government


employee among the 3 appointees by MPOC

(what is needed: resolution of MPOC appointing 3 members)

Summary of legal requirements (in order):


1. 1 Resolution of SB re creation of PLEB
2. 3 resolutions (from SB, LnB, and MPOC) for composition
3. 1 EO adopting/confirming the composition of PLEB based on the 3 resolutions

After, they can elect among themselves the chair (can be replaced anytime).

A secretariat can be designated per DBM circular entitled to per diem.

Principle of holdover applies (for vacancies).

Per NaPolCom opinion, Vice Mayor can sit as SB rep in PLEB

From Atty. Masnar: LnB representative who is LnB President cannot serve as SB representative

Oath of office is after the EO
