Acknowledgement

As a part of curriculum, as prescribed by Bar Council Of India, I got an


opportunity to know practices of how suit is filed, how court operates and
also seen court proceedings in wide variety of cases. The one month
internship programme has been extremely fruitful and has given an insight
to the kind of types of cases receive at court and how advocates practically
prepare and present their case in front of honourable judges. This period
encompasses practical lessons of academics and helps in adapting me for
better half after academics. An Endeavour over a period can be successful
only with the advice as well as support of advocate and his assistance.

I take this opportunity to express my profound gratitude and deep regards


to my Advocate Shri.Hemanth K.Thakkar for his exemplary guidance,
monitoring and constant encouragement throughout the internship and
providing with the necessary information regarding the law & order.

I want to express our gratitude Shri.Neerav Bariya, advocate, District


Court, Vadodara, who is assisting Shr.H.K.Thakkar & has given his
support in making this one month internship a magnificent experience.

I am deeply indebted to our Dean Ms.Uma Iyer ma’am for providing us with
an opportunity to purse internship.

I am obliged to honorable district court for allowing us to court rooms to


witness the proceedings. I am grateful for their cooperation during the
period of my internship.
Preface
As a part of the curriculum for Students, The Bar Council of India has
prescribed minimum of 12 weeks internship for three year Course stream
during the entire period of legal studies.

This report is an outcome of the one month internship Programme at


District court, Vadodara for the students of Forth semester. The main
constituents of the internship are to learn from Practicing Sr.Advocate either
in civil or criminal matter. Looking at the rising trend of crime cases in
India, I have chosen internship at criminal lawyer at Vadodara.

As expected, I could see and learn wide variety of Criminal cases, some of
them are very old and few are registered during internship period, which
gave greater exposure to the kind of criminal case. I could also see some
family dispute cases. I tried to jot down, hierarchy of courts, jurisdiction,
variety of courts in Nyay Mandir-Vadodara, No.of Judges, No.of cases dealt
by Judges per day. E-courts.gov.in portal and mobile app extensively used
by advocates and parties for better communication,

I have presented some statistics in my report. This internship report will


also include brief about court complex arrangement, history of the court
establishment along with few images. I have made an attempt to prepare
this report with a clear intention guide a new and your advocate get’s into
courts complex, he/she get to know about the arrangement, verifying
schedules cases, rescheduling, browsing history of the cases, little
understanding of court proceedings.

Criminal Advocate, District & Session Court, Vadodara

Advocate Shri. Hemanth K.Thakkar sir, who has been practicing as an


Advocate for the last 12 years, is one of the senior advocates in the vadodara
district.

He is practicing mainly in district court. He has specialized in criminal cases


but He is well versed with other laws also. He is hard working and very
systematic in his work and never keeps any work pending.

The best thing in doing internship under him was to attend multiple court
rooms on daily basis.
Information of the Vadodara District & Session Court

This magnificent historic building commonly known as ‘Nyay Mandir’ was


built in the year 1896 by His Highness Maharaja Sayajirao Gaekwad III. In
the year 1949 this court was formed under the provision of Sec. 3 and 4 of
the Bombay Civil Courts Act.

Shri B.C.Vakil was the first District and Sessions judge of Vadodara court.
This historical building of ‘Nyay Mandir’ was built in the loving memory of
Shrimati Maharani Chimanabai wife of Maharaja Sayajirao

Gaekwad III and it was known as ‘Chimanabai Nyay Mandir’. But during
later period it became famous by the name ‘Nyay Mandir’
Information of the Vadodara District & Session Court

The Judicial District of Vadodara comprising of the Revenue District of


Vadodara was formed covering major part of the territory of the erstwhile
State of Baroda by the Government of Bombay, Political and Sendees
Department vide Notification No.3198/46-P-III dated 31st July 1949 under
the provisions of Secs.3 and 4 of the Bombay Civil Courts Act, 1869.

Shri B.C.Vakil presided over as the first District & Sessions Judge on the
establishment of District & Sessions Court, Vadodara.The District &
Sessions Court, Vadodara started functioning in the magnificent historical
building commonly known as "Nyay Mandir" built in the year 1896 by His
Highness Maharaja Sayajirao Gaekwad III.
In Vadodara District, Appellate Courts, Courts of Senior Civil Judges,
Courts of Small Causes and Courts of Judicial Magistrate First Class are
housed in three buildings known as "Nyay Mandir", "Lai Court" and "Fast
Track Court".

The "Nyay Mandir" was built in the loving memory of Shrimant Maharani
Chimanabai, wife of Maharaja Sayajirao Gaekwad III, and it was named as
"Chimanabai Nyay Mandir". At the passage of time, the said buildingis now
known as "Nyay Mandir".

The said historical building was built by Maharaja Sayajirao Gaekwad III for
housing the Courts of Law functioning at the time of Baroda State, and at
present also, the same is being used for housing the District & Sessions
Court of Vadodara. In this building, some of the Appellate Courts of the
district are housed; other appellate courts are functioning in the building
known as "Fast Track Court Complex" situated beside Central Jail,
Vadodara.

Courts of Small Causes and some Courts of Senior Civil Judges are also
housed in the "Nyay Mandir". For the Construction of New District and
Sessions Court Building Government has allotted 55,000/- sq. meter Land.
After the planning of map and construction of New Court Building,
government has made a provision of fund of Rs. 1,30,00,00,000/-(130
crores)."Bhoomi Pujan" of the New Court building was done in the month of
October 2012.

In the New District Court Building, there is an arrangement of total 76


courts. Old Nyay Mandir , Lal Court, PTC Building , Fast Track Court
building and Family Court are shifted to the new court building after the
inauguration function on date 17/03/2018.
All the above mentioned courts are shifted and working in New District &
Sessions Court Building from 19/03/2018, which is situated at Diwalipura,
Old Padra Road, Vadodara.

New District court Building has a facility of 76 fully furnished courts, 2


Video Courts, 1 Conference Hall, 1 Training Hall and Mediation Rooms.
All the Court Rooms having separate chamber/ rooms for Judicial Officer,
Staff Members and Stenographers. New District Court Building also have a
facility of Mediation Center.

There is a separate Central Filing of each establishment at different floor of


the building. i.e. Central filing of J.M.F.C. Courts on Ground Floor, Central
Filing Room for Appellate Courts On First Floor, Central Filing room for Civil
Courts on Second Floor, Central Filing for Family Courts on third Floor and
Small Cause Court Central Filing situated at Fourth Floor. All the Central
Filing Section works for easy case filing , case inquiry and for Certified
Copies.
There is a separate building constructed for Ld. Advocates in 9000 sq. feet,
having 4 big hall which has a capacity of seating around 1000 to 1200 Ld.
Advocates. Advocate wing has a facility of tables, chairs and lockers. Two
separate Hall has been provided for Bar Library and there is a facility of
Canteen for Ld. Advocates. Banking facility is also provided within new court
building.

There is a separate rooms available for Bank and Post Office Branch. In near
future that will be functional and Court fee Stamps facility will be available
for Litigants and Ld. Advocates.

There is a facility of separate parking for Judicial Officers and there is a vast
parking space available in front of Court Building for Staff Members, Ld.

COURTS AND THEIR FUNCTIONING

Apart from the above structure, there are also two branches of the legal
system, which are:
1. Criminal Law: this deal with the committing of a crime by any
citizen/entity. A criminal case starts when the local police file a crime
report. The court finally decides on the matter.
2. Civil Law: These deal with disputes over the violation of the
Fundamental Rights of a citizen.

SOME PERFORMANCE FIGURS OF JUDICIARY


Above information is published on portal by District and Session court,
Vadodara, it is an excellent and transparent exercise by Judiciary to
promote the faith in judiciary.

Above two screen shots of Virtual justice clock of District Courts were taken
on 24.12.2024. First table indicates no.of cases disposed in different
intervals of time. The second table indicates, how long cases pending in
different time intervals. These kinds of reports are also published for Family
courts. This voluntary disclosure of courts will also keep judiciary
accountable for pendency of cases apart from gaining faith from public.

Study undertaken & observations

Some of the following Studies undertaken by me during the span of my


internship: 1. Learn the hierarchy and jurisdiction Sir gave us a brief
knowledge regarding the seating of judges and hierarchy of Criminal Court:-
The Supreme Court of India being the apex court the Constitution of India.
The High court governs under Article 141 of the constitution of India and
bound by the judgment of the apex court.

2. Stages Of Criminal Cases In India Under Criminal Procedure Code, 1973
A. Pre-trial stage
B. Trial stage
C. Post-trial stage
Now, each stage requires some steps to be fulfilled they are:-
A. Pre-trial Stage
1. Commission of an offence (cognizable or non cognizable)
2. A. Information to police.
B. Complaint to magistrate.
2(A). Information to police :
a. Information of cognizable offence.
b. Information of non cognizable offence.
a. Information of cognizable offence :
Under Section 154 of the Code of Criminal Procedure, a FIR or First
Information Report is registered. FIR puts the case into motion. A FIR
is information given by someone (aggrieved) to the police relating to
the commitment of an offense.
b. Information of non-cognizable offence :
In case of non-cognizable offence N.C.R (non-cognizable report) is
registered by police under section 155 of Cr.P.C. but the police cannot
start investigation or arrest the accused without the order of a
Magistrate having power to try such case.
2 (B). Complaint to magistrate –
Section 2 (d) of the Code of Criminal Procedure defines the term
'complaint as any allegation made orally or in writing to a Magistrate,
with a view to his taking action under this Code, that some person,
whether known or unknown, has committed an offence, but does not
include a police report. On receipt of a complaint a Magistrate has
several courses open to him.

He may take cognizance of the offence and proceed to record the


statements of the complainant and the witnesses present under
Section 200, Cr Thereafter if in his opinion there is no sufficient
ground for proceeding he may dismiss the complaint under Section
203, Cr PC. If in his opinion there is sufficient ground for proceeding
he may issue process under Section 204, Cr PC. However, if he thinks
fit, he may postpone the issue of process and either inquire into the
case himself or direct an investigation to be made by a police officer or
such other person as he thinks fit for the purpose of deciding whether
or not there is sufficient ground for proceeding. SECTION 202 CRPC

He may then issue process if in his opinion there is sufficient ground


for proceeding or dismiss the complaint if there is no sufficient ground
for proceeding.
Investigation by Police:- Police conduct investigation for
1) For collection of evidence;
2) Interrogation statement of accused;
3) Statement of witnesses;
4) Scientific analysis / opinion if required. During this time, at any
stage decided by investigating agency, accused persons can be
arrested.
In case of cognizable offence police can start investigation after the
registration of FIR, no prior approval of magistrate is necessary. But
in case of non-cognizable offence, prior approval of magistrate is
necessary to start investigation.
4. Anticipatory Bail:- Upon registration of FIR for cognizable criminal
offence the accused may make an application for anticipatory bail in
session court or high court. If anticipatory bail is granted then the
accused cannot be arrested. If anticipatory bail is rejected then the
accused can be arrested without warrant.

5. Arrest of the Accused:- In case of cognizable offence police can arrest


the accused without warrant. However in case of non- cognizable
offence prior approval of magistrate is necessary.
6. Production of accused to magistrate:- Within 24 hours of the arrest
the accused shall be produced before a magistrate having jurisdiction
to try such cases.

7. Remand:- Whenever an accused is arrested for any offence and police


cannot complete investigation within 24 hours then such person is
produced before a magistrate for seeking extension of police or
magisterial custody.

8. After investigation is completed:- If investigating agency feels a


prima facie case is made out, charge sheet is filed in Court through
the public prosecutor. If police feels that no prima facie case is made
out, a final report filed in Court.

9. Cognizance of Offence by Magistrate:- After filling of charge sheet


the next stage is taking cognizance of offence by magistrate under
section 190 of the Criminal Procedure Code. In the language of the
Hon'ble Apex Court employed in its earliest decision R.R.Chari v. State
of U.P AIR 1951 SC 207 “taking cognizance does not involve any
formal action or indeed action of any kind but occurs as soon as a
Magistrate as such applies his mind to the suspected commission of
offence"

10. Service of summons/warrant to accused and Process to


compel appearance under chapter 6 of Cr.P.C.

11. Appearance of accused before court & engagement of advocate.

12. Filing bail application/ furnishing surety.

13. Decision is taken by the Court after hearing the public


prosecutor and the counsel for defence:
A. On question of Charge sheet:
a. Court can reject charge sheet, in which case the accused is discharged.
Or,
b. Court can accept that a prima facie case is made out, frame the charges,
and post the case for trial. Case goes to next stage.
a. Court can accept the final report- case is closed and accused is
discharged. Or,
b. Court can reject the final report, and direct the police to further
investigate the case. Case goes back to the Stage of Investigation. Or,
c. If the Court direct the case to be posted for trial. Case goes to next
stage.
14. Framing Of Charge:- After considering the police report and other
important documents the accused is not discharged then the court frames
charges under which he is to be trialed.

My Experience

I was very excited on the first day of my internship; I was introduced to few
other advocates and many other interns working with different advocates in
the court premises. My advocate on the first day and introduced to the
nature of work and briefing on the work that would be given to the interns.

I got a deep and inspiring insight in the work at court. I tried my level best
to gain more and more knowledge in this period. I always tempted to stay
back for longer hours in court premises for greater learning.
Best thing is amazing experience at the District court of city; my internship
is filled with enthusiasm and learning that pays well in practice. I got to
meet and interact with ample of interns from different colleges; we shared
our experiences with each other and had useful interaction. Name and fame
of Sir in City and getting to work with such a great person, helped me to
increase my networking, which is the very purpose of internship.

I learnt the court manners and rules, learned to explore the city
independently and acquired ideas knowledge from different interns. Had the
opportunity of interacting personally with some of the learned judges and
eminent personalities of Vadodara.

Best part is we get to gain experience in the court and as well as in the
office. I have also interacted with few accused, to know their sentiment being
there in court premises, it was really enlightening opportunity.
