ኢኮኖሚያዊና ፖለቲካዊ እድገት ክፉኛ እንደሚገታ የታመነ
በመሆኑ፤
WHERE AS, it belived that corruption and
የክልሉን የልማትና የዲሞክራሲያዊ ስርዓት ግንባታ impropriety strongly hinder the social, economic and
ለማፋጠንና ቀጣይነቱን ለማረጋገጥ ሙስናንና ብልሹ political development of the Region;

control corruption and impropriety inorder to expedite
the building of the development and democratization
process of the region and to ensure the sustainability
of same;

NOW,THEREFORE, the Council of the Amhara

1. አጭር ርዕስ PART ONE
ይህ አዋጅ “የተሻሻለው የሥነ-ምግባርና ፀረ ሙስና ኮሚሽን General Provisions
እንደገና ማቋቋሚያ አዋጅ ቁጥር 237/2008 ዓ.ም” ተብሎ
1.Short Title
ሊጠቀስ ይችላል፡፡
This proclamation may be cited as “ the Revised Ethics

በዚህ አዋጅ ውስጥ፡-
2. Definition
1) “የመንግስት መስሪያ ቤት” ማለት ሙሉ በሙሉ ወይም Unless the context requires otherwise, in this

3) “Public Serevant” means any person that shall

General and Deputy Administrators as well as

ኦፊሰሮችና በትዩዩ የሚገኙትን ሌሎች ተሿሚዎች፣ Heads of the office, mayors of the urban
የክልሉን ዋናና ምክትል ኦዲተሮች፣ የዞን ከፍተኛ ፍርድ administration, members of the mayor
ቤት ፕሬዝዳንቶችን፣ ዳኞችንና አቃቢያነ-ህግን፣ committee, managers of city service office
የየዞኑን ዋናና ምክትል አስተዳዳሪዎች እንዲሁም and deputy appointees of same, judges and
የመምሪያ ሀላፊዎችን፣ የከተማ አስተዳደር presidents of the urban first instance and
ከንቲባዎችን፣ የከንቲባ ኮሚቴ አባላትን፣ የከተማ appealing courts, as well as, General

5) “ህዝባዊ ድርጅት” ማለት በክልሉ መንግስት
ተመዝግበው በማናቸውም አግባብ ከአባላት ወይም
ከህዝብ የተሠበሰበ ወይም ለክልሉ ህዝባዊ አገልግሎት
ታስቦ የተሰበሰበን ገንዘብ፣ ንብረት ወይም ሌላ ሀብት
5) “Public Enterprise”means a private sector
የሚያስተዳድር አካልንና አግባብነት ያለው የክልል
that include the body that shall administer the

collected money, property or other resource

that have been collected from members or
ሀ/ የሃይማኖት ተቋማት፤
public or considered the Regional Public

Service by any means, registered by the
ሐ/ ዕድሮችንና ተመሣሣይ ባህላዊ ወይም
Regional Government and the appropriate
ኃይማኖታዊ ይዘት ያላቸውን ሌሎች
Regional company and shall not include the

a/ institutions of religion;
b/ political parties; or
c/ ‘Edirs’ and other associations which
have similar traditional or religional
content.

6) “የህዝባዊ ድርጅት ሠራተኛ” ማለት በህዝባዊ ድርጅት 6) “Public Enterprise Employee” means any

ለማበረታታት የሚያገለግሉ ዘዴዎች፣ አካሎች፣ ሥርዓቶች 7) “Ethics Infrastructure” means mechanisms, bodies,
ወይም አስፈላጊ ሙያዎችና የመሣሠሉትን የሚያጠቃልል procedures or essential skills and the like that serve

8) “Serious Ethical Violations” means a violation

that may dismiss from work pursuant to the

appropriate code of Ethics;

9) “Serious Corruption Offence” means:

b/ the corruption offences concerning to the regional

government officials; and
c/ the corruption offences that shall create or may
create a large damage on the livelyhood of the
regional society.

10) ‘’Bank Account” means an account that shall

ላለው አካል ወይም ለሌላ የፍትህ አካል፣ ለመንግስት መስሪያ 11) ‘’Blower ’’ means any person that shall submit

ተግባሩ ሙስና መፈፀሙን ያጋለጠ ኦዲተርን እና ጥቆማን offence alleged by law or directives; eventhough
የሚያጣራ ወይም የሚመረምር ሰውን ይጨምራል፤ not alleged to bodies specified herein above, it
12) “የብሄረሰብ ምክር ቤት” ማለት በክልሉ ህገ መንግስት shall include aperson who audits a corruption

13) “ሰው“ ማለት የተፈጥሮ ሰው ወይም በህግ የሠውነት
መብት የተሠጠው አካል ነው፡፡

12) ‘’The Nationality Council ‘’ means referring to

nationality councils of Awi, Waghimra and
Oromya Zones, which are established pursuiant to
Article /73/, sub –article /2/ (a) of the regional
constitution;

13) “person” means a natural or juridical person.

ስለ ኮሚሽኑ እንደገና መቋቋም፣ ዓላማ፣ ሥልጣን፣

5.Objectives of the Commission

The commission shall have the following objectives,
pursuant to this proclamation:

1) to strive to create an aware society having

ethical values and where corruption shall not
condoned by promoting ethics and anti –
corruption education of the region, in
collaboration with the pertinent bodies of the
issue;

2) prevent and challenge the corruption crime and

እንደአስፈላጊነቱ በሌሎች የክልሉ አካባቢዎች

ሥልጣንና ተግባራት ይኖሩታል፡-
7. Powers and Duties of the Commission
1) በክልሉ የመንግስት መ/ቤቶች፣ በመንግስት የልማት
ድርጅቶች ወይም በክልሉ ውስጥ በሚንቀሳቀሱ The commission shall have the following particular
powers and dities:
ህዝባዊ ድርጅቶች ውስጥ ከባድ የሥነ-ምግባር ጥሰት
1) investigate or cause the investigation of any

complaints of alleged or suspected serious
ሲኖረው የማጣራት፣ የመከታተልና ተገቢው እርምጃ
breaches of ethics in the regional government

offices , public development enterprises or
2) በሙስና ወንጀሎች አዋጅና በሌሎች ህጐች ውስጥ
public organizations work in the region,
የተመለከቱት ወንጀሎች በክልሉ መንግስት መስሪያ
follow up and cause to take proper measures
ቤቶች፣ በልማት ድርጅቶች ወይም በህዝባዊ
thereof;
ድርጅቶች ውስጥ ስለመፈፀማቸው ጥቆማ
2) investigate or cause the investigation of any

alleged or suspected corruption offences

በማንኛውም ሠው ስለመፈፀማቸው ጥቆማ of the stipulated offences with various
ሲደርሠው ወይም በቂ ጥርጣሬ ሲኖረው Articles of this proclamation and the revised

ወይም በሀራጅ ተሽጦ ወይም ሳይሸጥ ለክልሉ መንግስት
10) to freeze by court order the assets of persons
ገቢ እንዲሆን የማድረግ፤
who may be under investigation for
corruption; and cause through court order,
the forfeiture of any assets and wealth
obtained in connection with corruption
offences or where it is found proportional the

ወይም መዘጋጀታቸውን የማረጋገጥና አፈፃፀማቸውን 15) apart from legislative and judicial bodies ,
በቅርብ የመከታተል፣ ከህግ አውጭና ከዳኝነት አካላቱ በኩል repare codes of ethics for the regional
ጥያቄዎች ሲቀርቡለት ደግሞ በሥነ-ምግባር ደንቦች government offices , developmental
ዝግጅት ረገድ የምክር አገልግሎት የመስጠት፣ የመደገፍ፤ organizations or public enterprises in the
region, ensure the preparation of same and
follow up closely their implementation;
provide, upon request, advice to legislative
and judicial bodies in preparing draft codes of
ethics ;

16) to facilitate condition of physical and job

ይኖሩታል፡-
The commission shall have the following bodies
1) በርዕሰ መስተዳድሩ አቅራቢነት በክልሉ ምክር ቤት
pursuant to this proclamation:
የሚሾሙ ኮሚሽነርና ምክትል ኮሚሽነር ፤
1) a commissioner and a deputy commissioner
2) ለሥራው የሚያስፈልጉ ሌሎች የበታች ስራ
appointed by the council of the region
ሀላፊዎች፣ ሙያተኞችና የስራ ክፍሎች::
proposed with the Head of the Region;
9. ስለ ኮሚሽኑ ዐቃቤያነ-ህግና መርማሪ ኦፊሰሮች
2) other subordinate heads, professionals and
የኮሚሽኑ ዐቃቢያነ-ህግና የወንጀል መርማሪ ኦፊሰሮች departments necessary for works.

9.Prosecutors and Investigative Officers of the

10. የኮሚሽነሩ ሥልጣንና ተግባር Prosecutors and investigative officers shall have

10.Powers and Duties of the Commissioner
የተመለከቱት ዝርዝር ስልጣንና ተግባራት
1) The commissioner, being accountable to the

2) Without prejudice to the generality provision of

shall have the following particular powers and

ሀ/ የኮሚሽኑ ዋና ሥራ አስፈፃሚ በመሆን የኮሚሽኑን a/ direct over and coordinate the works of the
ስራዎች በበላይነት ይመራል፣ ያስተባብራል፤ commission, being the chief executive body of the
ለ/ የዐቃቢያነ-ህግና የመርማሪ ኦፊሰሮች አደረጃጀት commission;

ያስተዳድራል፣ ያሠናብታል፤ and directives to be issued based on the general
ሐ/ የኮሚሽኑን አመታዊ የሥራ ፕሮግራምና በጀት principles of the regional civil service law;
ረቂቆች ያዘጋጃል፣ ሲፈቀድም በስራ ላይ ያውላል፤
መ/ ለኮሚሽኑ በተፈቀደለት በጀትና የስራ ፕሮግራም
መሠረት ገንዘብ ወጪ ያደርጋል፤ c/ prepare the annual work program and budget drafts

ሠ/ የኮሚሽኑ መርማሪ ኦፊሰሮችና ዐቃቢያነ-ህግ of the commission and implement same upon

በሙስና ወንጀል የተጠረጠሩ ሰዎችን በህግ መሠረት approval;

ለመመርመር፣ለመያዝ፣ለመክሰስ እንዲሁም ከክስ d/ effect expenditure based on the approved budget and
በመለስ ጉዳዩችን እንዲቋጩ ትእዛዝ ሊሰጥ program of the commission;

ይችላል፤ e/ the Commission invstigative officers and prosecuters

ረ/ ምርመራው በመካሄድ ወይም በክርክር ላይ ባለ may order to investigate, arrest, charge, as well as,

f/ may order any person’s bank account to be searched
ሰ/ የኮሚሽኑን ጠቅላላ የአሠራር ሂደት፣ የሥራ ግምገማ
and obtained the appropriate evidence, where it is
ውጤትና አስተያየት አስመልክቶ ለክልሉ ርዕሰ
found necessary on any case, that the investigation

is conducted or in pending cases;

g/ submit periodical report to the Head of the Regional
Government, concerning to the outcome and
recommendation of the entire performance process
of the commission;

h/ represent the commission in its all relations with

third parties;

ቀ/ ለኮሚሽኑ ሥራ ቅልጥፍና ባስፈለገ መጠን ሥልጣንና i/ the commissioner may delegate part of his powers
ተግባሩን በከፊል ለኮሚሽኑ ኃላፊዎችና ሠራተኞች and duties to other officials and employees of the

1) carry out tasks that shall be rendered isolating
with the commissioner;

1) Any employee of the commission is entitled to a

5) የትኛውም የኮሚሽኑ ሠራተኛ፡- 5)Any employee of the commission shall:

19. Ethics Liaison Units

1) There shall be established Ethics Liaison

which shall be to coordinate ethical issues or

developmental organizations or public
enterprises a responsibility to give prompt
response or elaboration to the professional
support requests submitted with the
 commission;

21. ቅጣት 21. Penalty

በሌላ ህግ የበለጠ የሚያሥቀጣ ሆኖ ካልተገኘ በስተቀር፡- Unless it is punishable with more severe penalty under

ወይም የቀጣ እንደሆነ ከሦስት ዓመት በማያንስ who gives information, witnesses or provides
ወይም ከአስራ አምስት አመት በማይበልጥ ፅኑ information relating to corruption offences to the

than one year or not exceeding five years; and
with fine not less than Birr three thousand or not
exceeding Birr ten thousand;

ከያዘው ክፍል ፈቃድ ውጭ መግለፅ፣ መፃፍ፣ ማሰራጨት with fine not less than Birr five thousand and

ከስድስት ወር በማያንስ ወይም ከአራት ዓመት not exceeding Birr twenty thousand . where
በማይበልጥ እስራትና ከአንድ ሺህ ብር በማያንስ ወይም the offence is accompanied by violence, the
ከአምስት ሽህ ብር በማይበልጥ መቀጮ ይቀጣል፤ maximum penalty prescribed in this sub-
article shall be imposed;

7) Whosoever publicize, disseminate, distribute

without the authorization of the investigator
of corruption offence is to commence or
underway, or about the act of corruption
knowing that the case is under investigation ,
shall be punishable with imprisonment not
less than six months or not exceeding four
years; and with fine not less than one
thousand Birr or not exceeding five thousand
Birr;

አካል በተፈፀሙ ጊዜ መቀጮው አምስት እጥፍ ይሆናል፡፡
22. የመሸጋገሪያ ድንጋጌ 9) Where the offences specified in sub-articles
/1/,/3/ /4/,/5/ or /6/ of this Article are committed by

22. Transitory Provisions

ዓ.ም ተሽሮ በዚህ አዋጅ ተተክቷል፡፡ prior to the coming into force of this proclamation.

2) ከዚህ አዋጅ ጋር የሚቃረን ማናቸውም ህግ፣ ደንብ፣

23. Repealed and Inapplicable Laws
መመሪያ ወይም የተለመደ አሰራር በዚህ አዋጅ ውስጥ
በተሸፈኑት ጉዳዩች ላይ ተፈፃሚነት አይኖረውም፡፡
1) The Amhara National Regional State Ethics and
Anti-Corruption Commission Establishment
Proclamation No. 93/2003 is hereby repealed and
replaced with this proclamation;
2) Any law, regulation, directives or customary
practices inconsistent with this proclamation shall
not be applicable on matters provided in this
proclamation.

24. ደንብና መመሪያ የማውጣት ሥልጣን 24. Power to Issue Regulations and Directives
1) የክልሉ መስተዳድር ምክር ቤት ይህንን አዋጅ በተሟላ The Regional Government Council may issue
ሁኔታ ለማስፈፀም የሚያስፈልጉትን ደንቦች ሊያወጣ regulations necessary for the full implementation of

2) ኮሚሽኑ ይህንን አዋጅና በዚህ አዋጅ መሠረት

This proclamation shall come into force as of the date

ጥር 10 ቀን 2008 ዓ.ም of its official publication on the Zikre-Hig Gazzeettee
