Monthly report ; of one month internship

I went to the District Court in Nalagarh, I saw the two types of Courts following Judicial
Magistrate First Class (JMIC), Additional Chief Judicial Magistrate (ACJM) after that we enter
in the court and find/watch the proceedings a case take up by the judge and call by
Peon/pyada . After that the accused /respondent or advocate on the behalf of the client
appearing in front of the judge.
Other side I see that stenography Their job is to upload the judge who is speaking or
passing an order and whoever is giving the judgment should also type it. And we also learn
that the district judges deal with the civil cases and Sessions judges deal with the criminal
cases.
During this week I heard and see more cases in case but few cases are liked by me and I
thought this cases was very internshing and knowledgeable cases for me.
In which of them I told about first case this case was realated with accidentally case and this
case was civil case because I kearnt that all cases those are related with motor vehicle act
that cases are civil cases.
Procedure for filling a civil suit : ist step : filling a suit plaint - it is a written complaint and
allegations given by plaintiff.
Second step : Vakalatnama - it is a written document given by parties to the suit authories
an advocates to represent then before the honble court.
Third ; filling of plaint - filling of the plaint before chief ministerial officer at the filling
counter along with appropriate court fee.
Court fee : court fee is a nominal percentage of the total value of the claim on the value if a
suit
Next step was HOW PROCEEDINGS ARE CONDUCTED :
HEARING : first day court thinks that there is merit in the case. Then they issue notice to the
opposite calling upon him to submit their arguments on a date fixed by court. After notice
issue plaintiff is required to complete following important things and this things was done
with in seven days form the order of notice.
After this an written statement was given by the defendant : onece the notice was issued
then defendant required to appear on date mentioned in notice. However before appering
on the date the defendant have file his written statement within 30 days form the date of
service of notice or within such time as given by the court .
After this plaintiff have to file replication : Replication is a reply against written statement
filler by the plaintiff . The defences made by the defendant un written statement is to be
specifically denied by the plaintiff.
Filling of other documents : after pleadings are completed and both the parties have filled
their submissions both parties are given an opportunity to produce and file documents that
are substained ro their claims procedure for filling other documents.
Framing of issues : next stage in civil proceedings is framing of issues. Issues are framed by
the court in the basis of which arguments and examination of witnesses take place.
List of witness / cross examination : all the witnesses that the parties wish to produce and
examined have to be presented before the court within 15 days form the date on the issues
are framed or within such other period as the court may fix.
Final hearing : on the day of final hearing the arguments takes places which should be
strictly confined ro the issues framed.
After final hearing last step was appeal reference and review was there it took place when
an order is passed against a party such party can further intiate the proceedings by way off.
Dhram chand vs ririka singh. - in this case suit file for specific performance of contract
mandatory injunction. Alternative suit for dmages .
U/ O 7 rule I IPC READ WITH SECTION 15 OF SPECIFIC RELIEF ACT 1963 . This weak was very
good and I learnt most new things in this weak I thought next day I learnt more about new
things.
In this weak I learned about criminal proceedings . I learned what things was included in
this they are : FIR - FIRST INFORMATION REPORT. Bail procedure . A/cahllan. Checking if
challan. Charge. Prosecution on witness statement. 313 vs by accused. Defence and
arguments . Order.

In this weak I learned the requisite amount of court fees and stamp duty is different for
evert suit documnets application and the same is mentioned in court fees stamp act
Some of them are as follows. In case of plaint / written statment rs 10 if the value of the suit
exceed rs 5000- upto 10000
In case of plaint filed in a suit for posseion - rs 5
On copy of a decree or order 50 paise
Talawana - 6rs
Valkalatnma - 25 ra Welfare stamp
For all types if application - 6rs stamp was used.
In this weak I learned the procedure for registration of marriage under section 15 of special
marrige act . The registration of marrige was took place in SDM COURT SUB DIVISONAL
MAGISTRATE . DOCUMENTS FOR FILE OF REGISTRATION OF MARRIGE.

who get married after this SDM SIGNATURE WAS TOOK IN THE FILE AND AT LAST FILE WAS
GIVEN TO SDM OFFICE AFTER THIS NOTICE WAS GIVEN TO ADVOCATE BY THE COURT AND
LAST THIS NOTICE WAS PUBLISHED IN NEWSPAPER AFTER ONE MONTH CERTIFICATE WAS
GIVEN TO PARTIES WHO WAS MARRIED . .Today when I went to court i saw today is lok
adalt. It was took place in whole part of india. I saw today in the session court judge come
with there two discussion partner and give decision for the pending cases of more time
period ago. They give judgement today of pending cases who were pending most of the
years. And also learn how can i take next hearing dates of cases in court.
