Facts
On March 11, 2001 found the body of victim AAA in a creek in Paranaque lifeless and allegedly raped, that on the
day of March 10, AAA using her Mazda car together with her friends Myra Dacanay and Kathrina Golez went to
Alabang to watch movie. They all went home when AAA was abducted by accused Nieves Constancio, Ernesto
Berry and 3 others suspect, Dander, Pagkalinawan and Burgos.
On March 29, 2001 the arrest of Constancio, Berry, and Pagkaliwan while other two remain uncaught, the
prosecution presented the witnesses, Janet Bales on March 12, the day after the incident happen aroung 3:00 AM
Berry attempted to abduct her but did not succeed, while Chito Adarna testifies that on evening of March 11, 2001
he saw Constancio using the Mazda car dumping something in the creek in Paranaque.
While in arrest, Berry made an extra-judicial confession to Atty. Suarez who clearly explained his constitutional
rights and executed a sinumpaang salaysay, likewise he made an extra-judicial to newscaster Amparo about the
incident confirm Constancio as mastermind of the crime.
The RTC, rendered Constancio and Berry conspired and guilty beyond reasonable doubt of crime Rape with
Homicide, while Pagkaliwan is acquitted for failure of prosecution to prove his guilt.
On appeal on 2012, the CA affirm the RTC.
Issue
Whether or not extra-judicial confession of Berry is admissible in evidence?
Ruling
The accused contending that it violated section 12 of Article III of the Constitution, the court ruled that It is already
settled that statements spontaneously made by a suspect to news reporters on a televised interview are deemed
voluntary and are admissible in evidence.
