PETITION
1. Your petitioner is EVELYN ELEFANTE-RODRIGUEZ, Filipino of
legal age, married to DANILO REYES RODRIGUEZ, with residence and postal
address at B6 L14 P2 Denver St., Calamba Hills Subd., Brgy. Barandal,
Calamba City, Laguna;
2. Petitioner is the original and registered owner of TCT. No. 060-
2015012273 regarding a parcel of land located at Brgy. Majada, Calamba City,
Laguna with an area consisting of ONE HUNDRED SEVENTY-SIX (176) SQM. A
copy of TCT No. 060-2015012273 is attached as Annex “A” and made part
hereof;
3. This this was previously my title registered under my name being
the cancelled TCT. No. 335447 which I donated to my parents SPS.
GREGORIO ELEFANTE & EDITHA P. ELEFANTE for the purpose of giving them
security of having a title over land that I own when I was still working abroad;
4. After the death of my parents the title was again transferred to me
by virtue of succession and was registered under my name when I was still
single. HOWEVER, there is an existing DISCREPANCY noted in my name as
owner over the title where it was stated: “Owner: CORAZON EVELYN P.
ELEFANTE, FILIPINO, OF LEGAL AGE, SINGLE.”
5. That to correct the DISCREPANCY, the name CORAZON should be
dropped from the owner’s information and it should be presented as: “Owner:
EVELYN P. ELEFANTE, FILIPINO, OF LEGAL AGE, SINGLE.” A copy of my
UMID card and Philippine Passport are attached as Annex “B” and “C”
respectively;
6. In connection with the same correction I am now happily married
and would like to update my information in the title which petitions that the
owner information be presented as follows: “Owner: EVELYN P. ELEFANTE,
FILIPINO, OF LEGAL AGE, MARRIED TO DANILO RODRIGUEZ.” For proper
representation of information and for all legal intents and purposes. A copy of
our Marriage Contract is attached as Annex “D” and made part hereof;
7. That this Petition is being executed to attest to the truthfulness of
the above facts, to correct the DISCREPANCIES NOTED and to update my
owner information in the said title for any and all lawful purpose it may serve.
WHEREFORE, premises considered, petitioner prays of this Honorable
Register of Deeds for Laguna, Calamba Branch to correct and update my
owner information as reflected in my title in TCT No. 060-2015012273 entered
in 29th May 2015 in Calamba City, Laguna, in the interest of justice and equity.

extending, modifying, or reversing existing jurisprudence;

6. The denials of factual contentions are warranted on evidence or, if
specifically, so identified, are reasonably based on belief or a lack of
information.
7. I hereby certify that I have not commenced any action or filed any claim
involving the same issued in any court, tribunal or quasi-judicial agency
and to the best of my knowledge, no such other action or claim is
pending therein; I hereby undertake to report such fact within five (5)
days therefrom to the court or agency wherein the original pleading and
sworn certification contemplated herein have been filed; I executed this
verification/certification to attest to the truth of the foregoing facts and
to comply with the provisions of Adm. Circular No. 04-94 of the
Honorable Supreme Court.

thereon as said provision of law is a reservation on reconstituted title in favor of
persons whose rights and interest might have been prejudiced on account of
the reconstitution or whose rights and interest were not duly noted before,
during or after the reconstitution;
That the reason for the existence of the ENCUMBRANCE has lost its
efficacy due to the lapse of two (2) years period on December 05, 1992;
THAT in the interest of justice as I have been charged with the
knowledge and information of the annotation by virtue of Section 4 Rule 74, I
request the office of the Registry of Deeds for its cancellation for legal interest
and purposes so stated above;
