Course Code & Title: LEA 1 – Law Enforcement Organization and Administration (Inter-Agency Approach)

Course Description: The course deals with the study of principles underlying the police organization and
management of the police with particular focus on the history and development of the Police (Law Enforcement),
Constitutional mandate, Republic Act 6975 and Republic Act 8551, together with previous laws and issuances
relating thereto. It includes the organizational structure and administration of the Philippine National Police, both
national and local levels. Emphasis is given on direction, supervision, coordination and control of all local police
forces as a homogenous body under a single command. It includes the basic management function insofar as these
are applied to the police organization.

Outcomes: At the end of the course the learner should have

1. explained the history and development of the Police (Law Enforcement);


2. understood the constitutional mandates and the Republic Act No. 6975 and Republic Act No. 8551;
3. appreciated the PNP organizational structure;
4. stated the police administrative principles and management functions;
5. discussed the activities of the police organization in the areas of recruitment and selection, appointment and
promotion, performance evaluation, training and career developments;
6. recognized the system of personnel management adopted in the Philippine National Police Organization;
7. stated the legal basis of personnel and records management in the PNP; and
8. explained the classifications, filing system of police records and the administrative reporting procedures in the
PNP.

Introduction to the Module

This is Module 2 of 2 of the course LEA 1 – Law Enforcement Organization and Administration (Inter-Agency
Approach). This learner module is developed for the flexible learning program of Aklan Catholic College and
programmed to run for at least a week. This module tackles the four out of eight outcomes of the course:

1. discuss the activities of the police organization in the areas of recruitment and selection, appointment and
promotion, performance evaluation, training and career developments;
2. recognize the system of personnel management adopted in the Philippine National Police Organization;
3. state the legal basis of personnel and records management in the PNP; and
4. explain the classifications, filing system of police records and the administrative reporting procedures in the
PNP.

This module is primarily used at home and it takes advantage of task-based approach to education and self-paced
learning. Success of learning would essentially depend on the collaboration between the instructor and the learner
and the commitment of the learner to self-directed learning.

It contains the (a) essential keynotes, (b) suggestions and links to further readings and media, (c) quizzes, (d)
activities, (e) reflection pages, (f) written test, and (g) task.

How to use this Module

Below is a learning program or sample learning cycle prepared by the module developer to help you navigate
your way through the module works. You are highly encouraged to follow the program to increase the success rate in
using the module.

It is very important that every time you begin work on your module that you begin with a prayer for guidance,

bold in the concept notes can be found in the dual flash drive. If you have any issues in accessing the content of the
dual flash drive, please contact your instructor right away.

You are also encouraged to study supplementary materials provided in the dual flash drive. It is wise that you
review first the outline of the module and the guide questions in each lesson to get an overview of the module. This
will help you create a focus to facilitate answering the quizzes and written test and performing the activities and the
task in each lesson.

It is recommended that you complete two lessons a day so that you can have ample time to prepare for the
written test and for the task performance.

Now, let’s discuss the activities of the police organization in the areas of recruitment and selection, appointment and
promotion, performance evaluation, training and career developments.

PHILIPPINE PUBLIC SAFETY COLLEGE

As provided for by Sec 66, the PPSC was created, being the premier educational institution for the training,
human resource development and continuing education of all personnel of the PNP, Fire and Jail Bureaus.

The PPSC is one of the bureaus under the DILG. It has a Board of Trustees (BOT) which exercise policy
making functions in accordance with general policies, plans and programs on education as may be formulated by
higher authorities. The BOT is comprised of the DILG Secretary as chairman, the head of the PNP, BFP, and BJMP
as members, and the PPSC President as ex-officio member. The creation of PPSC is particularly significant as it
symbolizes the new level of cooperation of the five component agencies in the transformation of the country’s public
safety services.

PPSC is the umbrella organization that provides direction, supervision, administration and control of the
various education and training programs offered by its component training units, composed of the:

 Philippine National Police Academy- The PNPA administers the Cadetship Program that provides the
nucleus of professionally trained young officers for the public safety services.
 Police National Training Institute and its 18 Regional Training School (RTS) Nationwide- The PNTI is
envisioned to become the primary training group for the professionally competent, morally upright and
technically proficient police officers capable of working in close partnership with a responsible community in
the preservation of peace, protection of human rights and maintenance of law and order with the end view of
improving the quality of people’s lives.
 Fire National Training Institute – Handles the non-career courses for members of the Bureau of Fire
Protection.
 Jail National Training Institute- Handles the non-career courses for members of the Bureau of Jail
Management and Penology.

 National Police College- the NPC handles the officer career courses, Bachelor of Science in Public Safety
(In-service) as well as the Master in Public Safety Administration programs. The course offerings are
designed to set the direction for effectiveness of the men and women in the public safety services.
 National Forensic Science Institute – Serves as the scientific laboratory and handles as well the highly
technical courses.
 And other special training centers as may be created by the DILG.

POLICE RECRUITMENT

In order to insure the quality of personnel entering the police service and strengthen the foundation of the
police professionalization, a standard procedure for recruitment and selection of PNP uniformed personnel is
hereby established:

Phases of Recruitment
 Selection – The choosing of available applicants who are fitted and qualified as police officers.
 Investigation – Determining the degree of qualifications, background and intellectual capacity of the
prospect.
 Testing – Giving a series of actual and theoretical assignment to re-enforce what has been in the
investigation phase.
 Appointment – Issuance of order for assignment.

The purpose of the process or phases of recruitment is to insure that candidates for appointment with the
high potential are secured and developed to become good police officers.

SCREENING PROCESS

The selection process which is basically undertaken by means of screening. The process involves two basic
functions first is the measuring of each candidates qualifications and second is ranking the candidates relatively on
the basis of their qualifications.

Qualification Appraisal Guide:


 Clearly unsuited
 Deficient
 Satisfactory
 Superior
 Outstanding

Medical Standards for Police Candidates


 General Appearance – the body must be well proportioned; girth of abdomen should not exceed
the measurement of the chest at rest. In addition, the applicant must be free from any marked
deformity.
 Eyes – the applicant should not be sufficient from color blindness. The required vision should be
from 20/20 to 20/30 in one eye and a binocular vision of 20/30. Loss of either eyes, chronic
inflammation of the eyelids and permanent of either eye must be rejected.
 Nose, Mouth, Teeth – obstruction from free breathing and very offensive breath should be
rejected. At least 21 natural teeth must be present missing ones may be replaced by dentures and
crown of bridge work.
 Genitals – any form of hernia would disqualify the applicant. Any acute venereal disease would be
rejected as well as other deformities such as stricture.
 Arms, Hands, Legs, Feet – must be free from any infections, conditions such as flat foot, hammer
toes. The presence or formation of varicose veins should disqualify applicants. The index, middle,
ring and thumb must be present in it’s entirely for hands and feet toes.

APPOINTMENT OF PHILIPPINE NATIONAL POLICE OFFICERS AND MEMBERS

The appointment of the officers and members of the PNP shall be reflected in the following manner:
 Patrolman to Police Executive Master Sergeant – Appointed by the PNP regional director for
regional personnel or by the Chief of the PNP for the national headquarters personnel and attested
by the Civil Service Commission.
 Police Lieutenant to Police Lieutenant Colonel – Appointed by the Chief of the PNP, as
recommended by their immediate superiors, attested by the Civil Service Commission.

 Police Colonel to Police Lieutenant General – Appointed by the President upon


recommendation of the Chief of the PNP, with proper endorsement by the Chairman of the Civil
Service Commission and subject to confirmation by the Commission on Appointment; and
 Police General – Appointed by the President from among the senior officers down to the rank of
chief superintendent in the service, subject to confirmation by the Commission on Appointments:
provided that the Chief of the PNP shall serve a tour of duty not to exceed four (4) years; provided
further, that, in times of war or other national emergency declared by Congress, the President may
extend such tour of duty.

The Field Training Program

All uniformed members of the PNP shall undergo a Field Training Program for twelve (12) months
involving actual experience and assignment in patrol, traffic, and investigation as a requirement for
permanency of their appointment.

Examination of Policemen

The National Police Commission shall administer the entrance and promotional examinations for
policemen on the basis of standards set by the Commission.

Prioritization of Women for Recruitment

Within the next five (5) years, the PNP shall prioritize the recruitment and training of women who
shall serve in the women’s desk. Pursuant to this requirement, the PNP shall reserve ten (10%) of its annual
requirement, training and education quota for women.

Lateral Entry of Officers into the Philippine National Police

In general, all original appointments of commissioned officers in the PNP shall commence with the
rank of inspector, to include all those with highly technical qualifications applying for the PNP technical
services, such as dentist, optometrists, nurses, engineers, and graduates of forensic sciences. Doctors of
medicine, members of the Bar, and chaplains shall be appointed to the rank of senior inspector in their
particular technical service. Graduates of the Philippine National Police Academy (PNPA) shall be
automatically appointed to the initial rank of inspector. Licensed Criminologists may be appointed to the rank
of inspector to fill up any vacancy after promotions from the ranks are completed.

We will discuss the system of personnel management adopted in the Philippine National Police
Organization; its definitions, elements and functions.

CONCEPT OF MANAGEMENT AND SUPERVISION

Management is the process of directing and facilitating the work of people organized in formal
groups in order to achieve a desired goal.

Police Personnel Management is the art of preparing, organizing and directing the efforts of
members of a police in order that they may achieve accomplishment of police purpose.

Nature of Management

Management embraces the essential elements of authority and responsibility exercised in the
process of organizing and directing people at work so that they may obtain their maximum efficiency
both for themselves and the organization where they belong. It is concerned in placing the right people
on the right job and in maintaining a satisfied work force. It accomplished its objectives through the
effective use of men, money, materials, methods, and machines (5M’s of Management)

Elements of Management

The basic elements of management are:


1. AUTHORITY – administrative authority is derived from the exercise of political power and its
basic purpose is the accomplishment of a particular goal. The three (3) sources of management are: (a)
Law; (b) Tradition; (c) Delegation
2. RESPONSIBILITY – the essence of responsibility simple means that management is held
accountable for the results arising from its exercise of authority. It is one of the means of guarding against
an abuse of management authority. In other words, responsibility limits the exercise of authority.

FUNCTIONS OF MANAGEMENT

According to Prof. Luther Gulick, the seven basic function of management may be summed up by
the word POSDCORB and this stands for the following:
1. PLANNING – the mental process of finding adequate solutions to management problems and the
preparation of an outline of things to be done and how they will be done to achieve results.
2. ORGANIZING – the process of allocating authority; responsibility and accountability to people, as well
as the establishment of channels of inter-group communication in order to secure coordination and
efficiency.
3. STAFFING – the task of providing competent men to do the job and choosing the right men for the
right job. It involves good selection and processing of reliable and well-trained personnel.
4. DIRECTING – the giving authoritative instructions, orders, or commands to working men, relative to
specific actions, procedure or activities which are to be performed in a particular manner or times.
5. COORDINATING – the accomplishment of an orderly pattern of group effort among working men,
through the harmonious adjustment or functioning of task, directed toward a common goal.
6. REPORTING – the making of detailed account activities, work progress, investigations, and unusual
in order to keep everyone informed of what’s going on.
7. BUDGETING – the forecasting in detail of the results of an officially recognized program of
operation based on the highest reasonable expectations of operating efficiency and is a tool
coordinating for operating financial factors.

BROAD BASES OF POLICE ORGANIZATION

The PNP observes several broad bases in organizing units of the commands. Organizations
composing the command are not organized out of vacuum but always with bases. In most cases two or
more of these bases are equally applied as could be expected in actual situations.
The following are the Broad Bases of Organization:
1. Area basis
2. Function basis
3. Clientele basis
4. Work process basis
5. Contingency basis
The nature of the missions, functions and responsibilities assigned to a command organization
determine which basis should apply in its creation. The boundaries of these bases when applied are
blurred. In any case, however, the more dominant reason should be considered.

ORGANIZATION ON AREA BASIS

Organization according to plan is defined as the grouping of subordinate units or elements under a
commanders who is made responsible by higher authority for some continuing operations within a specified
geographic area.

The following are reasons for organizing an AREA BASIS

1. To provide centralized direction among units within the area;


2. To provide a medium or coordination between higher levels of the command and the command
organization itself in the area;
3. To establish specific responsibility of the commander;
4. To maximize coverage of the overall command, thus enabling it to accomplish its mission and functions
more effectively; and
5. To serve as an integrated force for all units within the area.

ORGANIZATION ON FUNCTION BASIS

Organization according to function is defined as the grouping together of subordinate units or


elements under a commander who is charged with specific functions without respect to any geographic
area.

The following are reasons for Organizing on FUNCTION BASIS


1. To obtain expeditious performance of a given task or solution to a given problem without restriction to a
given geographic area;
2. To achieve concerted actions toward the accomplishment of objectives by avoiding overlapping or
duplication of functions;
3. To fix responsibility to a specific functional area; and
4. To effect proper coordination for specialized logistics support required for particular operations.

In some instances, organizations are created on the bases of both area and function depending on
the nature of missions and responsibilities confronting the commander.

ORGANIZATION ON CLIENTELE BASIS

Under special circumstances, organizations may be established to serve a particular sector of the
client public. Such organizations are created on a clientele basis usually without respect to geographical
area or to functions for which they have been specifically dedicated. Normally, these organizations are also
created with respect to work process to effect satisfactorily service to public demands.

The following are reasons for Organizing on a Clientele Basis


1. To concentrate on a specific service required by client;
2. To fix responsibility of commander;
3. To make the organization more wieldy to its assigned task.

ORGANIZATION ON THE BASIS OF WORK PROCESS


Organization on the basis of work processes means the grouping together of subordinate units or
elements primarily trained to practice a given or related jobs.
The following are reasons for Organizing on the basis of Work Processes
1. To maximize utilization of up-to-date skill derived from training;
2. To obtain more effective coordination as a result of homogeneous training and skill; and
3. To make the organization more wieldy to its assigned task.

ORGANIZATION ON THE BASIS OF CONTINGENCY

Organization on the basis of contingency means the creation of a contingent small unit in a short
term period comprising the organic elements tactically organized to address a specific situation or
phenomenon occurring in the area of responsibility.

The following are reason for Organizing on the Basis of Contingency


1. To maximize utilization of existing elements whose expertise or technical knowledge are needed and
applicable;
2. To obtain facts and immediate solution of the existing problem by which the unit was tactically organized;
And
3. To support generally the organization of various basis as mentioned above.

We will discuss the different record management system of Philippine National Police Personnel;
its types and functions.

The Need for Police Records

A police department is only as good as its records keeping capabilities. The effectiveness
of the police department is directly related to quality of its records. They are the primary means of
communication among the members of the police department and have as their purpose the
integration of the various department units into as integrated organization for accomplishing the
police task.
Records are essential in the efficient performance of routine duties, in the wise direction of
police effort, in the supervision and control of personnel, and in the determination of department
policy.

Organization of a Centralize Record System

Depending upon the size and needs of the police force, the station commander shall
maintain an adequate and centralize record system by organizing in his force an efficient records
and communication unit capable of providing appropriate services to the line units. The
centralization of records in a police station brings together at one point all information concerning
police activities, and it is through such centralization that the various line functions of a police
station and department are coordinated.

Functions and Uses of Police Records

A clear understanding of the functions and uses of the fundamental police records is essential
to the development of an adequate records system. The police records shall have the following
specific functions and uses:

 Identify individuals
 Provide a basis for property accountability
 Control investigation
 Make information available to the public
 Increase the efficiency of traffic control
 Assists the courts and prosecutors
 Coordinate custodial activities
 Integrate the department
 Furnish data for the public
 Establish responsibility
 Reveal unusual problems
 Aid in the apprehension of criminals
 Assists other police agencies
 Provide the basis for compilation of police statistics
 Effective employment of personnel and equipment

Incident to be recorded

The following incidents shall be recorded in appropriate police records:


1. Violation of laws and ordinances reported and discovered.
2. All calls in which member of the police force dispatched or takes official action.
3. All legal papers handled such as warrants, subpoenas, summonses, citations,
and the like.
4. Cases of missing and found persons, animals and properties.
5. Reported vehicular and other types of accidents which requires police action.
6. All personal injuries, bodies found, suicides.
7. Damage to property.
8. All cases in which police member is involved.
9. All arrests made
10. Miscellaneous cases, general and special orders, violation of rules and
regulations and any other reported incidents that the police commanders or
supervisors desire to be recorded.

Installation of a Police Records System

The standard record procedure of all law enforcement agencies shall meet the following:
1. A permanent written record shall be made of each crime immediately upon receipt of the
complaint;
2. Proper control shall be made upon the receipt of a complaint to ensure that it is promptly
recorded and accurately tabulated;
3. An investigative report shall be rendered in each case showing fully the details of the
offense as alleged by the complainant and as disclosed by the police investigation. An
effective follow-up system shall be adopted to ensure that all reports are promptly
submitted in all cases;
4. All reports shall be checked to see that crime classification conforms to the forms and
classification of the offense;
5. The offense or complaint report on crime cleared by arrest shall be noted as cleared;
6. Arrest record shall be completed, special care being taken to show the final disposition of
all charges;
7. Records shall be centralized;
8. Records and statistical reports shall be closely supervised by the chief or station
commander or any other superior officer;
9. Periodic inspection shall be made to see to it that the rules and regulations of the local
agency relative to record creation and maintenance are strictly complied with; and
10. Statistical records shall conform in all respect to the uniform crime reporting standards
and regulations.

The records of the police force shall be classified into five categories. They are the following:
A. CASE RECORDS

The CASE RECORDS is the heart of any police records system. It is the basis
for an analysis of offenses and the methods by which they are committed. The following
are the different types of reports included under the case records that shall be
accomplished by all concerned.

A Case Records is composed of two categories, namely:

1. Complainant/assignment sheet- which reflects all information regarding complaints and


reports, received by the police from citizens and other agencies, or action initiated by the
police.
2. Investigation report- which contains the findings of an action taken by the investigating
officer based on inquiries made and by obtaining the available facts of the incident.

B. ARREST AND BOOKING RECORDS

This record maintains the arrest and jail booking report that is required for all persons
arrested. It shall bear an arrest number for each arrest made. Arrest and Booking Records
shall be made out of complete information in full on each person arrested.

C. IDENTIFICATION RECORDS

Identification record is the third major division of police or law enforcement records.
Fingerprint records are the hearts of the any identification system.
The various identification records for the identification of criminals and other individuals
now extensively used in police station shall include the following:
1. Fingerprint Record
 Criminal Fingerprint – all person arrested for an offense shall be fingerprinted and an
identification number shall be assigned to each prisoner to identify records relating to
him.
 Civilian Fingerprint- all persons requesting clearance, certificate or other personal
identification purposes shall be fingerprinted using the prescribed form.
 Alien Fingerprint- all aliens requesting clearance certificate for purposes of petition for
naturalization, change of name, oath taking and for other personal identification
purposes shall be fingerprinted using also the prescribed form.
2. Criminal Specialty or Modus Operandi File- this consist of photographic records and
modus operandi of known criminals. This shall be filed accordingly based on:
 Certain Modus Operandi Characteristics
 Major Classes of Crime
 Criminal Behaviorism; and
 Identification number

D. ADMINISTRATIVE RECORDS

These are records required in the management of the department’s personnel and
designed to aid in the following administrative functions:
1. Assignments
2. Promotions; and
3. Disciplinary actions
Such records are so essential in administering personnel matters that must be maintained
in a police department.
Others is of control characters such as:
1. Personal Records
2. Correspondence File
3. Memoranda, Policy Files, Order, etc.
4. Assignment Records
5. Other Files

E. MISCELLANEOUS RECORDS

Police stations perform a variety of services, which do not relate to records


complaints. In addition to the general classes of records, there is a miscellaneous group,
which do not full under this category of records that a police stations maintains and which
on occasions create filing problems within a department. The average small police station
may simply maintain one file folder for its category. Each piece of correspondence,
together with a copy of the reply, should be filed in chronological order in an appropriate
location file.

Now, let’s proceed to the filing system of police records, the basic methods of filing and storage,
and the comparison between the police personalized power and police socialized power.

CRIME RECORDS MANAGEMENT

Crime record management may be accomplished through uniform crime reporting system.
1. Monthly report of cases handled by the police station;
2. Supplement of monthly report on cases handled by the police station;
3. Report of male person arrested; and
4. Report of female persons arrested
The four reports above described shall be submitted to the National Police Commission
(NAPOLCOM) in three copies not later than the 15th of each month.
The National Police Commission in return shall each furnish the NBI and the chief of the
PNP. Accuracy and promptness in the submission of these reports shall be the
responsibility of the chief of police.

RECORD AND FILING SYSTEM

The nature of police work justifies emphasis on criminal records. To be fully effective, a
police records system must:
1. Be comprehensive and include every incident that had been brought to the police
Attention;
2. Be adequately arranged and indexed to permit ready reference for easy access;
3. Be centralized to prove adequate control and maximum utilization of clerical
personnel;
4. Be as simple as possible, consistent with adequacy; and
5. Lend itself to summarization and analysis to permit continuing appraisal of the
police services.

Basically, with the advent of computers, agencies handling voluminous documents may
not face difficulties in filing and storage of their records.

POLICE SUPERVISION AND MANAGEMENT

In the past, police officers give a little emphasis consideration on their position as
managers. They rather wanted to be called as leader. But as the days roll on, modernization
becomes part in the day to day activity in the police station, where everything is a subject to
change. Supervisory aspects become more sophisticated and more rationalization of the part as a
police leader are in demand. This is the reason why most police leaders in an environment
characterized by scare resources for programs and the public demanding better services, tried to
find new ways to improve their productivity.
Today, officials hiring police chief have to assess whether an applicants have the following quality
and qualifications:
 What was his vision for the future of his agency;
 How they will stimulate subordinate participations;
 What effort will they made to ensure that quality is driven by customer concerns;
 What method they will use to ensure that agency improvement is continuous ;
 How they will empower employees;
 And all related issues.

Power is an indispensable dimension of police departments. As we experience, power is a both

position like police officers.
