 TERMS & CONDITIONS
1 PRICES:
The prices quoted for EX WORKS - METODA, and are subject to change at any time until the order is
accepted by Macpower

2 VALIDITY:
The prices quoted will be valid for 30 days from the date of quotation.

3 PAYMENT TERMS:
25% advance along with order, balance 75% against Pro-forma invoice prior to dispatch.
(We advise the transaction through A/C Payee Cheques / Demand Drafts / Pay Orders / NEFT / RTGS etc. in
favor of Macpower CNC Machines Ltd.)

4 TAX:
G.S.T. as applicable at the time of dispatch will be charged extra.

5 INSURANCE:
Transit Insurance will be charged extra.
(It is in interest of the customer to avoid probable heavy loss in case of accident during transit.)

6 DELIVERY:
Delivery commitments are based on the current manufacturing schedules. Macpower will put their best
effort to deliver the machine on time. However, Macpower accept no liability for failure to do so. Delay in
the delivery committed shall not render the contract voidable on the part of the purchaser and no claim
either direct or indirect can be made on Macpower due to delay in delivery. Macpower reserve the rights of
partial delivery. Moreover, due to any force majeure acts of god or which are beyond Macpower’s control,
Macpower is not liable for any delay in transit.

7 LIABILITY:
Liability will pass over to the Purchaser once the machine has been dispatched from Macpower premise.
Unless otherwise instructed Macpower will dispatched the good at owner’s risk. And accept no liability for
damages or delay in transit.

8 WARRANTY:
All machines are being dispatched after proper inspection by the Quality Assurance department of
Macpower. The liability of Macpower in respect of any defect in or failure of the machine supplied or for any
loss, injury or damage attributed thereto, is limited to making good by replacement or repair defects which
under proper use appear therein arise solely from faulty design, materials or workmanship within the
warrantee period at the termination of which all liabilities ceases on the part of Macpower. The warrantee
period is either 13 months from the date of dispatch of the machine from Macpower or 12 months from the
date of the machine being certified as ready to use at the site by Macpower engineer whichever is earlier.
Warranty is not applicable for parts, which have normal, wear & tear like chuck, Collets, Soft Jaws,
Revolving Centers, etc. and certain consumables items like bulb, Indicators lamps, work lights, Rubber
Sealing / Gaskets, O ring, bearing, belts, encoders. The damage due to the machine due to any accident is
not covered under this warranty. Warrantee of CNC system would be as given by respective manufacturer.

9 INSPECTION & TESTING:

Machine inspection and Geometrical Test Accuracies as per IMTMA test chart at our works before dispatch.

 Test report will be supplied with the machine.

10 ERECTION & COMMISSIONING:

Erection to be done by the Customer. The machine should be installed, cleaned, greased and electrically
connected to the supply according to the operation instructions manual. Commissioning will be done by our
Engineer. The span of commissioning will be 3 working days maximum. Final acceptance report will be
prepared and signed by both the parties.

11 TRAINING & TRIAL:

Operational Training to one person on Programming and Maintenance at our works for a period of 3 days on
mutually agreed basis, all expenses to your account. The Training is conducted at our works on planned
schedules and not linked with machine dispatch. Customer has to confirm the schedule of training and trial
in advance and plan to visit accordingly. For job trial, material & appropriate tools will be provided by you.
Macpower don’t undertake any responsibility for job proving.

12 TITLE OF GOODS:
Unless & until 100% payment is received by Macpower, the Title of the goods will not be passed to the
purchaser.

13 CANCELATION:
Due to any reason if wish to cancel the order, Macpower reserves the right to forfeit the advance.

14 CONTRACT & JURISDICTION:

Order (Contract) will be considered as having been accepted only after its acceptance in writing by
Macpower. Any change or modification in Order can be confirmed only after written confirmation from
Macpower. All orders / contracts are deemed to be entered into at head Office of the Macpower and no
proceedings to enforce any claim and no suite arising out of contract shall be instituted, except in competent
court of law within Gondal / Rajkot Jurisdiction.

15 SPECIFICATIONS:
All specifications, weight, dimensions and other particulars submitted in the quotation of Macpower are
approximate and without obligation. Due to continuous product improvement all the particulars mentioned
here in above are subject change without prior notice.
