The Complainant submits this complaint to the Court and states that there is probable cause to believe
Defendant committed the following offense(s):

Charge: First Degree Arson - Dwelling
Minnesota Statute: 609.561.1, with reference to:  609.561.1

Charge Description: On or about November 9, 2020, within the City of Shakopee, County of Scott, State
of Minnesota, Defendant, Alexis Saborit, DOB: 3/30/1979 (41), did unlawfully and wrongfully, by means of
fire or explosives, intentionally destroy or damage any building that was used as a dwelling at the time the
act was committed, whether the inhabitant was present therein at the time of the act or not, or any
building appurtenant to or connected with a dwelling whether the property of the actor or of another.

more than $1,000 measured by the cost of repair and replacement.

STATEMENT OF PROBABLE CAUSE 11/10/2020

 
The Complainant states that the following facts establish probable cause:
 
On November 9, 2020, at approximately 4:35pm, City of Shakopee Officers were dispatched to the
Pullman Club in reference to a male smashing car windows with a baseball bat. While en-route, dispatch
advised the suspect was a Puerto Rican male, who had returned to his apartment near the Pullman Club,
and was holding a gas can out of the window.

The suspect was identified as ALEXIS (NMN) DEFENDANT, (DOB: 03/30/1979), the DEFENDANT
herein. 

DEFENDANT lives in the City of Shakopee, and officers located him at his home address.
Upon arrival, officers observed DEFENDANT on the second level, where his apartment windows were
open. After some time, law enforcement observed DEFENDANT stick his head out of the window. 

DEFENDANT was upset and yelling. He was screaming about hating people, but would calm down and
listen to officers at times. A short time after establishing contact, he angrily disappeared from view, then
came back a short time later with a red plastic rubber gas container and poured a small amount out of the
window onto the ground.

Officers could immediately smell the liquid and believed it to be diesel fuel. DEFENDANT would put the
container down, and pick it back up. At one point he obtained a lighter and the gas can, and held the lit
lighter above the gas can, threatening to hurt anyone whom entered his apartment. DEFENDANT said if
anyone came into his apartment, there would be a fight. 

DEFENDANT would be calm and listen for a short period of time, then see other officers, and become
angry and begin screaming about how he hates people and the police. Defendant said he had only drank
one shot of alcohol today but said he was angry because someone had
put "shit" into his drink. 

At approximately 4:51 pm, DEFENDANT agreed to come out onto the deck to speak with officers. He
entered the inside of the residence, walked down the half stairs, opening the doorway to the deck. Officers
observed he was holding a large machete knife in his hand as he was standing in the threshold of the
doorway to the deck. 

At approximately 5:04 pm, officers were able to convince DEFENDANT to drop the machete out of the
window. He threw it onto the ground next to a vehicle which was parked directly underneath his windows.

Shortly thereafter, officers began to stack up on the stairwell to the second story. DEFENDANT was able to
see out of his window and into the stairwell window. DEFENDANT then became
uncooperative, and the successful dialogue was lost. 

DEFENDANT had held a lighter up, and returned to the interior of the apartment. He closed all of the
apartment windows. 

Law enforcement informed DEFENDANT that there were people inside, and they did not want anyone to
get hurt. DEFENDANT continued to yell and not listen.

Around 5:07 pm, officers observed the flicker of the fire near the front door of DEFENDANT's apartment.

He came back to the window with a bat. Law enforcement observed the fire increase inside. DEFENDANT
turned off the kitchen lights and appeared to add items to the fire. DEFENDANT began screaming at the
top of his lungs, "Go outside," which he repeated several times. DEFENDANT returned to the window and
closed them again. At this point, officers evacuated all other residents from the apartment building for their
safety.

Law enforcement advised personnel to use less lethal munitions to break the window on the northwest
side, so fire could shoot water directly into the apartment to attempt to contain the
growing fire, which they did. 

DEFENDANT returned to the window and continued screaming and pointing. Officers observed white
smoke initially start flowing out of the window, which quickly turned to heavy
black smoke. DEFENDANT had the bat again and began beating the windowsill and the side of the
building.

The smoke intensity increased. DEFENDANT began throwing tree bags out of the apartment, which
landed on top of the parked vehicle below him, substantially cracking the windshield and denting the hood. 

Due to the only apartment entrance being blocked by heavy fire, and DEFENDANT becoming overcome
by smoke pouring out of his window, officers persuaded DEFENDANT to jump out of the window.

Ultimately, DEFENDANT did jump and hit the hood of the vehicle. DEFENDANT stood up and went
towards the wall where officers attempted to place him under arrest. DEFENDANT was uncooperative,
pulling his arm away and resisting arrest despite repeated demands to stop. With the assistance of
additional officers DEFENDANT was secured and escorted to the squad car and transported to the jail.

While at the jail, officers used Language Line to read DEFENDANT his Miranda warning, which he stated
he understood. DEFENDANT said he did not have anything to say at that time. 

DEFENDANT is further described as a 41-year-old male, standing 6’0’’ tall, weighing 154 pounds, with
black hair and hazel eyes.

PLEASE TAKE NOTICE: Pursuant to Minn. Stat. 609.49., intentional failure to appear for duly scheduled
court appearances may result in additional criminal charges, and in addition to any arrest warrant that may
otherwise be issued by the Court.

From the above sworn facts, and any supporting affidavits or supplemental sworn testimony, I, the Issuing Officer, have
determined that probable cause exists to support, subject to bail or conditions of release where applicable, Defendant’s arrest
or other lawful steps be taken to obtain Defendant’s appearance in court, or Defendant’s detention, if already in custody,
pending further proceedings. Defendant is therefore charged with the above-stated offense(s).
