Introduction

This is the Preliminary Title. Here, you will learn the date of effectivity of the Revised Penal Code. The
characteristic of penal law will likewise be discussed. You will also learn as to what circumstances the
Revised Penal Code is applicable.

Rationale

The students will be able to determine the characteristics of penal law and as to what circumstances the
Revised Penal Code is applicable.

Intended Learning Outcomes

A. The student will know the date of effectivity of the Revised Penal Code;
B. The student will know the Characteristics of Penal Law;
C. The student will know the Intra-territorial and extra-territorial application of Penal Law.

Read Articles 1 and 2 of the Revised Penal Code (Act No. 3815, as Amended).

Discussion
PRELIMINARY TITLE
-Effectivity and Application of RPC

1. The Revised Penal Code (RPC) took effect on January 1, 1932. It is based on Spanish Penal
law.
2. Penal laws
- acts of the Legislature which define crimes, treat of their nature and provide for their
punishment.
3. Criminal Law is a branch of public law because it treats of acts or omissions which are
primarily wrongs against the State. Hence, a criminal case is denominated “People of the

4. Characteristics of Penal Law (PGT):
a. Prospectivity – it shall be applied prospectively except if it is favorable to the offender.
b. Generality - penal law is applicable to all persons who reside or sojourn in the
Philippines whether citizens or not
c. Territoriality – criminal law is applicable to all crimes committed within the Philippine
Territory (Intra-territorial application).

Extra-territorial application – Except as provided in the treaties and laws of preferential


application, RPC is applicable even to those crimes committed outside the Philippines,
against those who:

i. Should commit an offense while on a Philippine ship or airship


ii. Should forge or counterfeit any coin or currency note of the Philippines or
obligations and securities issued by the Government of the Philippines.
iii. Should be liable for acts connected with the introduction into these islands of
the obligations and securities mentioned in the preceding number.
iv. While being public officers or employees, should commit an offense in the
exercise of their functions;
v. Should commit any of the crimes against national security and the law of
nations, defined in Title I of Book 2 of the Revised Penal Code.

Exercise

Memorize the characteristics of Penal Law. It’s as simple as PGT.
