RE: APPEAL FOR THE REFUND OF SECURITY DEPOSIT

Dear Mr. Hilario,

We are writing at the behest of our client, DRA. JOSEFINA A. SILVA of J&B Sunrise Optical Clinic,
with whom a Contract of Lease/Award Notice was awarded to for the lease of a 40 square meter- space
unit at the Ground Fl. 500 Shaw Zentrum, Shaw Boulevard, Brgy. Pleasant Hills, Mandaluyong City.
Copy of the document are hereto attached for your perusal.

In the said Contract, it was stipulated that a Security Deposit equivalent to three (3) months’ rent shall be
refundable thirty (30) days from the expiration of the Contract of Lease. Due to the untimely and
unforeseen onset of the pandemic, J&B Sunrise Optical was constrained to stop its operation, eventually
leading to its closure. Dra. Silva informed the Management about this decision through a Letter dated 30
July 2020, to which you have responded through a letter-response. Copy of these are hereto attached.

While it is clear under the Lease Contract that in case of pre-termination, the Security Deposit shall be
forfeited in favor of the lessor, it is my most humble plea to be afforded with your leniency and empathy
to rearrange this term by reimbursing the Security Deposit instead of forfeiting the same. This request
finds support in President Rodrigo Duterte’s sincere plea to lessors for mutual assistance, compassion,
and understanding in treating the lessees at the height of this health and economic crisis.

Although my request appears discordant with our Lease Agreement, the extraordinary circumstance we
presently face warrants for a different arrangement that is mutually sound and fair to both parties. With
the severe financial losses I have incurred due to the prolonged community quarantine, and with my
business ceasing to operate, the reimbursement of the Security Deposit is a reasonable and helpful way
for me to start anew and to account for the remaining obligations I have regarding the closure of J&B
Optical, without depriving you of any gains.

In light of the foregoing reasons, I reiterate my sincerest appeal to your good office to refund the Security
Deposit reconsidering the unexpected global dilemma we are experiencing.

It is my utmost hope that you would respond favorably to this appeal. Thank you very much.
