Problem:

New Jersey still, to this day, has very harsh penalties for cannabis related offenses. We have
people in prison, jail, on parole, in drug court, and being supervised as a result of conditional
discharge due solely to cannabis related offenses.

While expungements, when they take effect, will help many people, they will not alone help this
group of people hit hardest by prohibition.

Additionally, while the Mandatory Sentencing Reform Bill could help in some of these cases by
making them eligible for parole earlier, it will not release them from being incarcerated or
supervised as it only would affect their parole eligibility date.

Solution:
We propose a phased approach to pardon people who are still subject to supervision due to
offenses involving solely cannabis and/or cannabis paraphernalia, starting with those currently
incarcerated in jail or prison. A timeline could look like:

December or January:
- Pardons for people in prison for cannabis or cannabis paraphernalia charges only
- Pardons for people in jail awaiting trial for cannabis or cannabis paraphernalia
charges only
- Pardons for non-citizens with felonies for any cannabis or cannabis paraphernalia
related offenses that are eligible for expungement other than simple possession.

February or March:
- Pardons for people on parole for cannabis or cannabis paraphernalia charges
only
- Pardons for people on pretrial supervision or monitoring for cannabis or cannabis
paraphernalia charges only
- Pardons for non-citizens with charges for simple cannabis possession or
cannabis paraphernalia only

April or May:
- Pardons for people in drug court or on probation for cannabis or cannabis
paraphernalia charges only

June or July:
- Pardons for people serving supervision as a result of a conditional discharge due
to a cannabis or cannabis paraphernalia related offense only

August or September
- Pardons for any person that is being monitored or supervised in any way for
offenses involving solely cannabis or cannabis paraphernalia, not previously
covered in the above timeline
