REAL ESTATE MORTGAGE
KNOW ALL MEN BY THESE PRESENTS:
I, JOVITO T. AGGUEBAN, single, of legal age, with resident address
at Purok 3, Bulanao, Tabuk City, Kalinga as Mortgagor, for and in
consideration of a loan in the sum of, Philippine Currency, One
Hundred Twenty Five Thousand Pesos (Php. 125,000.00), to me, in
hand      paid     by      ________________________,      married     to
______________________, Filipino, of legal age, with address at Purok 3,
Bulanao, Tabuk City, Kalinga, as Mortgagee, do hereby, or assigns,
that certain parcel of land together with all improvements thereon,
more particularly described as follows:
      “A parcel of land with LOT NO. 19332-D, CSD-CAR-003418-D
being a portion of LOT NO. 19332, Pls-93, situated at Barangay
Bulanao Norte, City of Tabuk, Province of Kalinga covered under OCT
No. 020-2019000049 and registered under the name of the herein
Mortgagor, JOVITO T. AGGUEBAN.”
That this mortgage is so constituted subject to the following terms and
conditions to wit:
      1. That the principal obligation of One Hundred Twenty Five
         Thousand Pesos (Php. 125,000.00) shall be due and
         payable within from the date the said obligation was released
         and to bear interest at the rate of ______ per month;
      2. That during the lifetime of the mortgage, the mortgagor shall
         not alienate, sell or in any manner dispose of or encumber
         the above-mentioned property without the written consent of
         the mortgagee;
      3. That any default on the part of the mortgagor to pay any of
         the obligation stipulated herein above shall constitute
         sufficient cause for the mortgagee to foreclose this mortgage;
      4. That in case of foreclosure, the mortgagee may elect to
         proceed judicially, or extra judicially under Act No. 3135
         against mortgagor. In that latter event, the mortgagor hereby
         appoints the mortgagee as her Attorney-in-fact who shall
         take over the immediate possession of the property and sell
         the same at the public auction in accordance with the law, to
         sign all documents and perform any act requisite and
         necessary to accomplish said purpose. It being understood
         that in whichever event, the mortgagee shall be entitled to
         collect attorney’s fees and other legal expenses aside from
         liquidated damages in an amount equivalent to not less than
         ____________ of the obligation of the mortgagor then
         subsisting provided; however, that in any case of litigation
         from the violation of contract, the mortgagor submits to the
         jurisdiction of the Court in the trial of the case against her;
That I hereby declare under oath that the land herein mortgage is not
leased nor tenanted.
