GE 518: LAND

ADMINISTRATION AND
MANAGEMENT
-Review on the Revised Regulations on Land Survey
DAO 2007-29

▪ Signed on July 31, 2007 by then Secretary Angelo T. Reyes of DENR


▪ Also known as the Revised Regulations on Land Surveys
▪ It covers the policies and standards on land survey and mapping
activities.
Objectives:

▪ To progressively review and update the country’s land survey


regulations and streamline the survey procedures, simplify it’s
requirements, and introduce provisions on business process
reengineering
▪ To enable all individuals concerned to keep abreast with the dynamic
advancement of surveying practices and technologies and enhance
their capability, effectiveness and efficiency in the conduct of land
survey.
Definition of Terms:

Cadastre- shall refer to a set of records about parcels of land consisting


of a spatial reference and related information on the area,
ownership/claims, value and use of land
Delimitation Survey- shall refer to the establishment of the permanent
forestland and protected area boundaries by conducting actual ground
survey.
Land Registration- shall refer to the official recording of land ownership
based on the legal documents submitted to the Register of Deeds for
the Province or City.
Muniments of Titles- deeds and other documentary evidence of title or
ownership to land.
Patrimonial Property- shall refer to properties owned by the State but
are not intended for public use, public service or for the development of
national wealth.
Projection map- shall refer to a map where all lots subject for
verification and approval are plotted to determine case of overlaps with
previously approved plans.
Reclamation Projects- Filling of submerged land duly approved by the
Philippine Reclamation Authority
Survey Plan - shall refer to a two-dimensional map showing the metes
and bounds of a surveyed parcel or parcels of land and other pertinent
information.
Survey Returns - shall refer to the collective documents submitted by a
Geodetic Engineer (GE) as a result of the survey conducted and other
relevant documents as may be required.
Classification of Land Surveys

1. Control Surveys:
a. Geodetic Control Survey – first and second order control
b. Project Control Survey- primary control (third order),
secondary control (4th order) and tertiary control.
2. Cadastral Surveys:
a. Numerical Cadastre- based on actual ground survey, bearing and
distances of the lots are determined
b. Graphical Cadastre- bearings and distances of the lots are
determined using scaling from photo map
c. Public Land Subdivision- A&D lands more than 1,500 hectares
3. Isolated Surveys
a. Group Settlement/Townsite Subdivision Survey- A and D
lands of not more than 1,500 hectares into 50 parcels or more.
b. Public Land Surveys- Original surveys covering A and D lands
which has not been subjected to private rights nor devoted to
public use.
c. Amendment Surveys- changing of the boundary
lines,increasing or reducing the number of corners,
consolidating and subdividing a previously surveyed area
without including any new area already included in other
surveys previously approved.
d. Private Land Surveys- shall refer to the surveys covering lands
claimed or owned by an individual, a partnership, a corporation, or any
othe form of organization, undertaken for purposes of original or
subsequent land registration.
e. Government Land Survey- surveys of parcels of lands administered
by or belonging to the National Government includes Friar Land Estatrs
Surveys, National Government Lands Survey, Local Government Units
Lands Surveys
f. Conversion Surveys- survey conducted for the purpose of
transfoming/converting lots covered approved graphical cadastral
surveys, cadastral mapping into numerical or regular cadastral lots.
g. Other Land Surveys
4. Mineral Land Surveys- surveys of mining claims, quarry applications,
sand and gravel applications and other mineral lands.
5. Forestlands and National Parks/ Protected Areas Delimitation
Surveys- shall refer to the surveys conducted by the Regional
Composite Survey Team or qualified private GE in order to delimit on
the ground boundaries of forest lands and national parks/protected
areas from the A and D lands.
Survey Order (SO)- shall refer to the instruction issued by the
concerned DENR Official to a Government GE to conduct survey over a
parcel of land of the public domain.
Survey Authority (SA)-permit issued by the concerned DENR Official to
a private Geodetic Engineer to conduct isolated survey over public
lands for Public Land Application purposes.
Condition in Granting Survey Authority:

1. Be within the A and D area


2. Have no existing claims and conflicts
3. Be outside any existing civil, military and/or any other kinds of
reservations
4. Not be the subject of a pending land registration case or any
pending litigation.
5. Not be within ongoing cadastral or public land subdivision project.
Granting of Survey Order:

▪ Clearance and/or endorsement from concerned agencies which has


jurisdiction over the parcel involved.
▪ Copy of court order, if the subject parcel of land is under litigation

▪ Secretary -Parks and Protected Areas Delimitation Surveys,


SO if area covers 2 or more regions.
- Delimitation Surveys for Watershed Reservation
SO if area covers 2 or more regions
Director of LMB - Political Boundary Surveys, SO if area is covered
by a special law/proclamation giving jurisdiction
to LMB.
-Isolated Land Surveys, SA if area covered by a
special law/proclamation giving jurisdiction to
LMB.
Admin, NAMRIA - Delimitation Survey on Land
Classification, SO
Regional Director - Cadastral Survey, SO
- Parks and Protected Areas Delimitation
Surveys, SO if area is 5000 ha and above
-Political Boundary Survey SO if there is
no involved inter regional boundary
dispute
-Delmitation Survey for Watershed
Reservation, SO if there is no involved
inter regional boundary dispute
Regional Director - Reclamation Project Surveys, SO if area
is 100 ha and above
-Isolated Land Surveys, SO if area is more
than 100 ha
-Survey of LGU Lands, SO if more than
100 ha
-Foreshore Land Surveys, SA if area is
more than 100 ha
RTD for Lands - Political Boundary Survey, SO if the
involved are the barangays of the same
city or municipality
-Public Land Subdivision, SO
-Reclamation Project Surveys, SO if area
is less than 100 ha
-Townsite Reservation and Group
Settlement Surveys, SO if area is up to
1500 ha
- Isolated Land Survey, SO if area is more
than 12 ha up to 100 ha
RTD for Lands -Survey of LGU Lands, SO if area is up to
100 hectares
-Foreshore Land Surveys, SA if area is 12
hectares up to 100 hectares
Regional Director MGB - Mineral Land Survey, SO
RTD for Forestry - Delimitation Survey for Watershed
Reservation, SO if area in the same region
is less than 5000 ha
RTD for PAWCZMS Parks and Protected Areas Delimitation Surveys,
SO if area is less than 5000 hectares
CENRO Isolated Land Surveys, SA if area is 12 ha and
below
Foreshore Land Surveys, SA if area is 12 ha and
below
Process on the Issuance of Survey
Authority

Documents Required:
a.Duly accomplished Letter-Request Form any document showing the
identity of the land (e.g. Lot number, tax declaration, Deed of Sale,
etc.)
b. Survey Authority form duly signed by the applicant and private
Geodetic Engineer
c. Proof of Claims/Acquisition of the property (e.g. Deed of Sale, Waiver
of Rights, Tax Declaration, etc.)
d. Order of Payment and Official Receipt
Procedure:

1. The CENRO Receiving Clerk receives and enters the duly


accomplished Letter-Request in the Record book.
2. The Records Officer, Land Investigator/Deputy Public Land
Investigator verifies the status of the land, whether it is titled or not
and/or claimed by others.
3. The Chief, FMS determines the land classification status.
4. The Land Investigator/DPLI provides the applicant with the
checklist of requirements: 1. Survey Authority 2. advice about the
procedures.
5. The applicant submits the complete documentary requirements. The
receiving clerks receives and check the completeness of the documents
submitted based on the checklist.
6. The Chief, Forest Management Services prepares the Order of
Payment for the Inspection Fee.
7. The Bill Collector accepts the payment of the applicant and issues the
Official Receipt.
8. After payment, the CENRO assigns a Land Investigator/ DPLI to
handle the request.
9. The assigned Land Investigator/ DPLI conducts field investigator,
prepares the Investigation Report and recommendations, and submits
the documents/reports to the Chief, FMS for review.
10. The Chief, FMS reviews the documents/reports and endorse the
same to the CENRO for consideration.
11. The CENRO signs the Survey Authority and Ivestigation Report.
12. The Records Officer assigns a control number on Survey Authority
and enters into the record book.
13. The Survey Authority is then releases to the applicant.
Validity:

Survey Authority 6 months

Survey Order within the period as stipulated


Calibration and Registration of
Surveying Instruments:

Note:
- Original Certificate of Instrument Registration (CIR) shall be issued by
the LMB after the calibration.
- Renewal of Certificate Instrument Registration may be issued by LMS
concerned after the usual recalibration.
- Copy of the renewed CIR shall be furnished to the LMB for updating
the National Database on Surveying Instruments
- A copy of CIR shall be furnished the LMS at the start of every year for
record purposes.
Validity:

1. For steel tapes: two years or up to three breaks


2. Engineer’s transits and optical and electronic theodolites: three
years
3. EDM and ETS: 3 years
4. GNSS Receiver: 2 years
Approval of Survey:

Project Control Surveys – shall be submitted to the LMS for verification


and approval. Project Controls that were verified and approved shall be
used in the verification of the Political Boundary and Cadastral Lot
Surveys.
Completed Cadastral Surveys- shall be submitted to the LMS for
verification and approval. LMS may conduct routinary inspection, as
the need arises, while the survey is ongoing.
Isolated Survey- shall be submitted to LMS for verification and
approval. INCOMPLETE requirements shall be a ground for non-
acceptance. LMS may conduct on-site inspection and validation during
the conduct of survey.
▪ Mineral Land Survey- LMS shall verify and approve survey plan of lots
covered by mineral claims, quarry applications
▪ Forestland and Protected Areas Boundary Survey
-conducted by the RCST
- Verification by the Chief Regional Surveying Division
- Approval by the Regional Director
Cancelled and Rejection of Approved
Survey Plan:

1. Cancellation- surveys later found to be erroneously approved and


not in accordance with the purpose for which it was authorized may
be cancelled:
a. Survey for the purpose of land registration covering non A and
D area
b. Previously approved surveys of different claimants as per
court order.
c. Previously approved subdivision covering surveyed and
registered lands found to be erroneously executed and/or not in
conformity with the owner’s agreement
d. Surveys executed in violation of DAO 2007-29
2. Amendmend Surveys- covers unregistered lands for purposes of
changing boundary lines and by increasing or decreasing the number of
corners and lots without the original area.
3. Rejection- Surveys found to be covering previously approved survey
and/or in-alienable areas when plotted on the projection map may be
rejected.
Conduct of Survey and Custodianship of
Records:

1. LMB in the national level and LMS in the regional level shall be the
repository of all DENR land surveying record and shall be in-charge of the
execution of cadastral solated and project control surveys
2. The LMB/LMS shall conduct a massive inventory of the survey records
which includes data of Reference Points, Isolated Survey plans, Cadastral
Maps etc. The GSD/RSD shall be the custodian of all Survey Records, both
the digital and hard copies.
3. The NAMria shall be the primary agency on the establishment of the
National Geodetic Network of First and Second Accuracy, in which data
shall be readily shared with the LMB/LMS.
4. The Office of the RTD for Lands shall be custodian of the LIM at the
regional level.
