STATEMENT OF DEFENCE OF SUNWING AIRLINES INC.
1. Save and except as hereinafter expressly admitted, the Defendant Sunwing
Airlines Inc. ("Sunwing") denies each allegation of fact as set out in the
Statement of Claim, as if it was set out herein and denied specifically, and
Sunwing puts the Plaintiff to the strict proof thereof.
2. In answer to the whole of the Statement of Claim, Sunwing says that the Plaintiff
has failed to plead that she had a contractual relationship with Sunwing, and that
no proper allegations of fact have been made against Sunwing. The Plaintiff does
not plead that she purchased or made a flight booking with Sunwing. The Plaintiff
lacks standing to bring these proceedings against Sunwing. Sunwing is not a
proper Defendant in the within proceeding.
3. Sunwing admits the allegations contained in paragraph 8 of the Statement of
Claim.
4. In specific answer to paragraph 9 of the Statement of Claim, Sunwing admits
only that it is a properly licenced Canadian commercial air operator.
5. In specific answer to paragraphs 10 and 11 of the Statement of Claim, Sunwing
denies that the Plaintiff is an appropriate or suitable representative for any
proposed class of plaintiffs as against Sunwing.
6. In specific answer to paragraphs 64 to 69 of the Statement of Claim, Sunwing
denies that the Federal Court has jurisdiction over this Action.
7. Sunwing proposes that this action be tried in Toronto, Ontario.
WHEREFORE Sunwing prays that the claim against it be dismissed with costs payable
by the Plaintiff to Sunwing.
