Operator – Driver Agreement

· Starting next week, we will follow the 50-50% sharing system. The Total Uber Earnings, from
which the expenses (gas, load, carwash, toll fees, etc.) are deducted, will be divided into two
with its quotient as the 50% Operator/Driver Net Share. For each week, only one driver will
make trips from Monday to Sunday. He will drive 6 days a week excluding Friday.
e.g.
20,000 (Total Uber Earnings)

= 6,700 (50% Operator/Driver Net Share)
· Since there are two promos offered for each week which are the weekday promo (Mon-Thurs),
and the weekend promo (Sat-Sun), a special schedule is made to be followed depending on
what day and the number of target trips to make.
· For weekday promos (Mon-Thurs), the driver has a maximum of 15hrs a day, with 12hrs-13hrs
to go online.
e.g.
Mon: 14 trips 12hrs 13mins
Tue: 16 trips 12hrs 49mins
Wed: 17 trips 12hrs 51mins
Thurs: 15 trips 12hrs 18mins
· The number of target trips for each promo whether it's a weekday promo or a weekend promo
varies from time to time but this is the regular schedule we will follow from Mon to Thurs:
12hrs-13hrs online shift + 2-hour lunch break (15hours total).
· The number of hours online should not exceed 14hrs to accommodate time for lunch break.
e.g. If the driver's first trip starts at 5:34am, his last trip should start before 8:34pm. He will go
offline/unavailable in Uber or Grab by 8:35pm.
exception: If by 8:35pm he is still on trip, naturally he will stay online until he drops off his
passenger to her destination. After completing the last trip, then the driver is expected to go
offline.
· On the same note, the number of hours online should never go less than 12hrs since the driver
is in custody of the car for more than 15hrs a day. There is no reason he should go offline
beyond 3hrs straight since it is clearly stipulated here that the number of hours online either in
Uber or Grab should always be 12hrs-13hrs per day from Mondays thru Thursdays.

· In the event of any technical issues concerning Uber and Grab such as internet problems, GPS,
waze malfunctions, and the Uber app and Grab app themselves and/or anything that will affect
the driver's supposed number of hours online, his trips, the car, the device, his
passengers/riders, his performance and ratings, he must follow the workaround tips availabe on
hand. If the issue persists, let the car owner/operator know right away by calling within 30
minutes. If the driver fails to comply, the opertor will automatically give a penalty of P500 for
every hour offline without informing her supposedly in a span of 30 minutes. This should be
made clear to both the driver and the operator as early as now.
e.g.
At 7:30pm, Waze App malfunctions/doesn't work.
At 7:32pm, Driver starts doing workarounds to try and make the app work.
At 7:32pm, Driver keeps troubleshooting the Waze App.
At 7:45pm, Driver finally gives up.
At 7:47pm, Driver calls the operator to report the on-going issue. Then the operator helps him
troubleshoot the app and the device while on call.
· Usually the target number of trips on the weekday promo is 60-70 trips from Monday-
Thursday, thus the driver will follow the 13-hour online shift.
e.g.
Mon 5/16/17 (16 trips)
Uber: 12hrs 47mins online
Total Uber Earnings: P2,247.17
· If there's an instance where the driver, upon monitoring his trips and number of driving hours,
seemingly needs more time to drive longer in order to hit the promo, then adjustments can be
made so his driving hours will be lengthened.
Take note: only for Thursdays. This is possible on the condition that the driver has already
reached 50hrs online M – TH (which means he has fully maximized his driving hours), and yet
his target number of trips is still far from reach.
· Likewise, if the driver deems that the Uber promo is too low, he can switch to Grab but should
inform the operator beforehand to allow transparency since the driver and his trips are
monitored all the time.
exception: It is strongly encouraged that the driver does not switch from Uber to Grab within
the day. However, he can drive for Uber on Mon, then switch to Grab come Tue, Wed, & Thurs.
This should be deliberated upon by the driver and almost entirely depends on his discretion
provided that he will let the operator know beforehand everytime he switches.

· For weekend promos with 45-50 trips target in two days: Saturday & Sunday, the driver may
opt to drive in longer hours to hit the target. His options are below.

Mon ~ Thurs: 13hours online shift +2hrs lunch break, total = 15hrs (12hrs min,13hrs max
online)
Sat & Sun: 17hours online shift + 2hrs lunch break, total = 19hrs (16hrs min-17hrs max online)
or
Sat & Sun: 19hours online shift + 2hrs lunch break, total = 21hrs (18hrs min,19hrs max online)

· So if say for instance, the number of the driver's target trips is 50 trips (Sat – Sun) weekend
promo, and he chose to drive for 19hrs online + 2hrs lunch break, total = 21hrs, he can do so
provided that he will follow the supposed number of hours online. Otherwise, he will be
penalized each time he spends time offline unnecessarily.

Sat 10/29/16 (27 trips)
uber: 19hrs 41mins
fare: P2,927.75
· The driver can get the car from 4am ~ 10am. The earlier he starts the day, the better are his
chances in hitting the promo.
· The opertor and the driver will share the following expenses on a 50-50% basis: gas, load, top-
up, toll fees, and carwash.
· If the driver gets the car in full tank gas, he should return the car in full tank gas as well.
· The driver should maintain high level of personal cleanliness and hygiene and of the car.
· The driver should ensure that he does not smoke tobacco or use any other intoxicant material
within the car at any time which causes a noxious odor in the car.
· The driver should ensure that no one (including himself) litters, smokes, spits, etc or otherwise
disrespects the car environment (both interior and exterior) in any form.
· The driver should maintain the highest level of courteous behavior and respect for the
passengers and should not show any form of discrimination.
· The car is intended strictly for either Uber or Grab use only.
· The driver will use the car only for the purpose for which it is permitted and should not use it
for personal monetary gains through cheating and illegal activities.
· For failure to comply with the agreed terms and conditions, the driver will either be warned
verbally once or penalized depending on the nature of his offense. If the offense is a minor

issue, he will receive a verbal waring. Afterwhich, he will be penalized for the first time (first
offense) of P200, for the second time (second offense) of P400, and for the third time (third
offense) of P600.
· As for major issues, since the Fare and the Total Uber Earnings greatly depend on the number
of hours online spent by the driver, naturally it should always be monitored strictly to maximize
payout for both the driver and the operator. Thus, if the driver deliberately and repeatedly
defies the set rules for the supposed number of hours online, he will be penalized according to
how many hours he went offline without proper notice (except when he's having lunch break).
So if he goes offline straight for 3hrs, then goes 4hrs, then 5hrs, that totals to 3hrs offline
which means he will be penalized for P1500.
· If there's anything amiss that affects the driver's trips and anything else that involves the car, it
is the driver's responsibility aside from the standard operating procedure to always let the car
owner/operator know what is going on by calling immediately.
· If violations made by the driver are deemed serious enough, he will be held accountable for
them so the car owner/operator has the right to terminate the driver's services at any time.
· Anything that concerns the car's and the driver's safety, the driver should let the car
owner/operator know right away by calling.
· If the driver has any concerns and other business-related issues, he can always reach a
dialougue with the car owner/operator.
· The driver will be held responsible to any damage done to the car while the car is in his
custody; therefore, he must ensure his safety and security and that of the car at all times.
· In case of emergencies, the driver must contact the car owner/operator right away to report the
incident and seek immediate help or appropriate solution.
