AN ORDINANCE AMENDING CERTAIN PROVISIONS OF
ORDINANCE NO. 019, SERIES OF 2005, OR THE LAND
TRANSPORTATION CODE OF THE CITY OF
VALENZUELA

WIIEREAS, pursurnt to Sec. 458 (3) vi of Republic Act No. 7160 or the Local
Government Code, the Sanggunian is given the power to rcgulate the operation of tricycles and
grant franchises for the operation thereof within the territorial jurisdiotion for the city;
WHEREAS, pursuant to this mandale, the Sanggunian enaoted Ordioanoe No. 019,
series of 2fi)5 or the Land Transportation Code of the City of Valenzuela;
WHEREAS, Sec. 43 of the aforementioned Ordinancs has provisions that prohibit
motorized tricycles, both public and private to travers€ along Mac-Arthur Highway;
WEEREAS, Sec. 45 of the aforementioned Ordinanco has provisions against
overloading and states that: "for purposes of safety, no public utility tioycle shall carry more than
four (4) passengers;
WIIEREAS, Tricycle Operators and lhivers Association petitione.d the Sanggunian to
review the mandatc of certain provisions since it deprive them of income, especially in areas
covered by longer routes and those who are using their units as school service;
WHEnEAS, the City Govemment has the duty to address the grievances of the people,
if said grievances are just, and does not contrsvene aDy laws;
NOW THEREFORE, bc it ORDAINED ae it is hereby ORDAINED by the
Sangguniang Prnlunglod of Valenzuela the following:
SECTION 1. Sec.43 of Ordinance No. 019, series of 2005, hereby amended to read es
follows:

SEC. 13. Tricyclc/Bicycle Laacs - (c) The City shall provide a network
of trtcycle lanes in major roads, national highways and lhoroughfares, where
there is no olternative route, taking into consideration the rcutes of tricycle units
being used as public conveyances, as well as for school service, church service
or delivery semice;
(b) The lane shall be placed at the right portion of the street, ovenue
highway designated as such and shall be marked with appropriate

(c) In the case of Mac Arthur Highway, a ne*ork of tricycle lanes are
hereby desigtated in a map, herein ottached as "Annex A", which shall forn
paa of this Odinance;
(d) However, to ensure the free-fow of traffc, tricycles are only allowed
to we such lanes from Mondays lo Sonrdays on these hours:
i) 5:30 an -7:00 am
iil 11:00 an - 1:00pm
ii, 5:30pm-7:30pn
Provided: thal tticycles being used as clrurch semice, especially in areas
where chapels of the lglesia ni Cristo ore located, sholl only be allowed to
convey passengers to and from the said chapel on Thursday; Provided further,
that no tricycle ban shall be imposed on Sandays and Public Holidays.
(e) The City Engineering Oflice, in consultation with the Traflic
Management afice, the Yalenzuela City Transportation Offce and the ticycle
operalors and drivers association representatives moy designate other tricycle
lanes on nalional roads and highways aside from the lanes designated os such
olong Mac Artlrur Highwdy.
(l) Until such time the tricycle lancs hove been desigwted by the CW
Engineering Affce as provided for in this ordinance, a moratoriurn on the
enforcement of lines for lric?cles us@ national roads and highways shall be
imposed.
(g) Tricydes, both public and private who shall travetse or operote
beyond the desiguted tricycle lanes shall be imposed a fine of One Hundred
Pesos (P100.00) on first ofense, Three Hundred Pesos (P300.00) on second
offense and Five Hundred Pesos (P500.00) on thlrd offewe
SECTION 2. Sec.44 of the same Ordinanoe is further amended as follows:
SEC. 45, Provbtons Agcinsl Ove oading - Public utility tricycles mdy
carry three (3) to four (4) passenger *cluding the driver provided they comply
v)ith the minimutn requirements of hoving a step board for the two (2) backriders,
an extended seat with cushion in place of cargo rack for the confort of
passengers and a safety bar at the rear for the safety of the backriders as shown
in " Ann* B " which shall form part of this Ordinance.
SECTION 3. Sec. 112 ofthe same Ordinance is hercby delead.
SECTION 4. Sec. 129 ofthe same Ordinance is fiuther deleted.
SECTION 5. The fines imposed for garbage bins, under Sec. 137 ( the Code is
further deleted.

SECTION 6.The fines imposed for overloading, under Section 132 (7) of the Code
shall not be imposcd on public utility tricycles with rhree (3) or four (4) pass*g""s, but shalL be
imposed on drivers of units who shall violate the minimum available'cafacity ir tt" *it *nu,
