( based on R.A.9255 and its IRR ) GENERAL RULE: An illegitimate child shall use the surname of his/her mother
EXCEPTION: An illegitimate is given the OPTION to use his/her father’s surname if the latter recognizes him/her in the manner laid down by law o Expressly recognized through the record of birth in the civil register o Admission in a public document o Admission in a private handwritten instrument made by the father
