SUBJECT : Investigation Report re: Illegal Discharge of Firearm involving


PO1 Marbin Jay Pagulayan

DATE : December 27, 2017

1. References:
a. Spot Report from PS-1, dated December 25, 2017; and
b. GAIS-MPD Official Blotter Entry No. 9381, Page No. 568 dated December 25,
2017.

2. ICOW the above references, be informed that this Office conducted thorough
investigation relative to the alleged Illegal Discharge of Firearm that transpired at
about 2:00 AM, December 25, 2017 along Quirino St. corner Pacheco St., Tondo,
Manila, wherein suspect was identified as PO1 MARBIN JAY PAGULAYAN y ALLAM,
27 years old, married, presently assigned at Malate Police Station 9, MPD, and resident
of No. 12 Magsaysay St. Barangay 119, Tondo, Manila.

3. Initial investigation disclosed that PO1 Pagulayan was allegedly involved in a


drinking spree session along Quirino St. Tondo, Manila together with his friends.
Suddenly, two (2) of his companions had a heated altercation, prompting PO1
Pagulayan to pacify the commotion, and decided to drew his firearm and fired
downwards to a drainage hole. Afterwhich, Barangay Chairwoman Edna Ramos of
Barangay 119 Zone 9, Tondo, Manila reported the incident to Hotline 911. Upon receipt
of the information, DTOC, relayed the message to Raxabago Police Station 1, MPD.
PSUPT JAY C DIMAANDAL, Station Commander, immediately dispatched the
personnel of Don Bosco PCP led by PO1 June Orbert Caracas et.al.

4. Consequently, upon arrival of PO1 Caracas et.al. at the said alluded place, PO1
Pagulayan on a civilian clothes was observed as the one reported who allegedly
discharge the firearm, hence the arrest. Recovered from suspect’s possession and
control were one (1) .9mm Beretta Pistol with Serial Number M09941Z, one (1) .9mm
Magazine loaded with Fourteen (14) live ammunitions.

5. PO1 Pagulayan was brought to Ospital ng Maynila for Medical Examination.


Further, results of Alcoholic Breath Examination, Paraffin and Gun Powder Residue
Examination at MPD Crime-Laboratory office yielded positive results.

6. As such, General Assignment Investigation Section of this District conducted


validation and look for witnesses to prove the allegation that P01 Pagulayan fired his
gun downwards but yielded negative result.
7. On December 25, 2017 at 1:30pm, P01 Pagulayan were subjected for Inquest
proceeding before ACP LANIE RAMOS, City Prosecutor Office, Manila for alleged
Illegal Discharge of Firearm under Article 254 of the Revised Penal Code and
immediately turned over to District Integrated Jail for temporary confinement after the
Chief Inquest Division of the Manila Prosecutors Office JOVENCIO A SENADOS
recommended the filing of the case as charged.

8. More so, case folder against P01 Pagulayan was submitted to DIAS for
determination of his administrative culpability. Pending the result of the case, the
recovered firearm of P01 Pagulayan was properly turned over to DLD/D4, MPD for
proper disposition of the same.
