AXA Free Personal Accident Insurance

1. The Metrobank – AXA FREE Personal Accident Insurance Promotion (“Promo”) is open
to all customers who will open a Savings or Checking Account in any Metrobank branch
nationwide.

2. Promo Offer: Open a Metrobank Savings or Checking Account* in any Metrobank


branch and get a FREE AXA Personal Accident Insurance worth Php 100,000.
*Eligible accounts could be any Metrobank Savings or Checking account except Prepaid, Fun Savers Club,
and Corporate accounts.

3. Promo Period: July 29, 2019 to September 30, 2019.

4. Eligibility requirements:
a. Customer must be 18-70 years old.
b. Customer must provide a valid e-mail address.
c. Customer must sign the Data Consent Form.

5. Eligible customers will receive a FREE AXA Personal Accident Insurance Card as proof
of qualification. In case of accident, instructions on the claiming process are found at the
back portion of the Personal Accident Insurance Card.

6. Eligible customers will also receive an e-mail confirmation from AXA Philippines on the
insurance coverage and policy 20 working days from account opening.

7. The Free AXA Personal Accident insurance coverage shall immediately take effect on
the day of account opening and shall be valid for one (1) year.

8. Free Personal Accident Cards are not for sale. Should customer wish to have more than
one Personal Accident Card, he will be encouraged to open another account to qualify.
9. Customer is qualified to receive one (1) Personal Accident Insurance Card for each new
account opened. However, a customer may only be eligible for up to two (2) cards under
his/ her name.

10. Joint (and/or) and In-Trust-For (ITF) Account holders may receive one PA Insurance
Card each.

11. Free Personal Accident Cards are non-transferrable and non-convertible to cash.

12. Savings and Checking Accounts in connection with this promo are subject to the Deposit
Terms & Conditions governing the issuance of MBTC’s Deposit Products.

13. In case of dispute arising from the promo, MBTC’s decision shall prevail. All questions or
disputes regarding the client’s eligibility for the promo shall be resolved by MBTC, in
concurrence with DTI.

Important Reminders:

1. The Metrobank account opened during the promo period should be active upon claiming
of insurance benefit.

2. In cases when the e-mail address given by the customer is invalid, AXA will get in touch
and ask him/her to provide an updated email address.

Free Personal Accident Insurance for qualified customers will remain in force even if
customer is unable to receive e-mail confirmation on Insurance coverage.

3. Promo is only open to customers who will open a Savings or Checking account in any
Metrobank branch.

4. The Free AXA Personal Accident Insurance covers accidental death or permanent
disablement only.

ANNEX A

Personal Accident Insurance


GENERAL CONDITIONS

1. Any person can register up to two (2) cards at a given time. Any card issued in excess
shall be considered null and void. In an unforeseen event, the Company shall not be
liable for more than the applicable amount for any person per event.
2. A written notice shall be given to the Company without unnecessary delay within 30 days
in case of death from date of accident/injury.
3. Any person who is 18 to 70 years old during the policy period is eligible to register.
4. In the event of claim, all certificates, information and evidences required by the
Company must be furnished at the expense of the Insured or his legal representatives,
and shall be in such form and of such nature as the Company may prescribe. The
Company shall, in case of death of the Insured, be entitled to have a post mortem
examination at its own expense.
5. The Insured must give immediate notice in writing to the Company of any change in
address, profession or occupation and the effecting of other insurances.
6. A written notice of claim given by or in behalf of the Insured or beneficiary to the
Company or to any authorized representative of the Company, with information sufficient
to the identity of the Insured shall be deemed to the notice of the Company.
7. Indemnity under this insurance is payable to the Beneficiary/ies indicated upon
activation. In case of death or in the absence of a named beneficiary/ies, the Insured
shall be deemed to have named the following as his/her beneficiary/ies in the order
indicated and the proceeds under this policy shall be paid accordingly
to the Insured's:
a. Widow or widower, or
b. Surviving Children, or
c. Surviving Parents, or
d. Surviving Brothers and Sisters, or
e. Estate
8. No assignment of the benefits of this policy shall be binding upon the activation of
coverage via the link sent to the Insured’s email. The Company does not assume any
responsibility for the validity of the assignment. No change of beneficiary under this
Policy shall bind the Company unless consent thereto is formally endorsed hereon by
the Company.
9. This policy constitutes the entire insurance contract. Any rider, clause, warranty or
endorsement purporting to be part of the contract of insurance and is pasted or attached
to this policy is not binding to the Insured.
10. Completed claim forms and written proof of loss must be furnished to the Company
within ninety (90) days after the death of the Insured. Failure to furnish such proof within
the time required shall not invalidate nor reduce any claim. If it was not reasonably
possible to give proof within such time, the same must be given as soon as it is
reasonably possible.
11. The amount of loss for which the Company may be liable under this Policy shall be paid
within thirty (30) days after proof of loss is received by the Company. Ascertainment is
made either by agreement between the Insured and the Company or by arbitration; but if
such ascertainment has not been made within sixty (60) days after such receipt by the
Company of the proof of loss, then the loss or damage shall be paid within ninety (90)
days after such receipt.
12. If a claim made was rejected and an action or suit be not commenced either in the
Insurance Commission or any court of competent jurisdiction within twelve (12) months
from receipt of notice of such rejection or in case of arbitration taking place as provided
herein. Twelve (12) months after due notice of the award made by the arbitrator or
arbitrators or umpire, the claim shall be, for all purposes, deemed to have been
abandoned and shall not thereafter be recoverable hereunder.
13. In the event of claim, the member’s MBTC account must be active.

EXCLUSIONS
The PA policy shall not extend to cover:

1. Death, disablement or bodily injury, occasioned by or happening through:


a. War, invasion, act of foreign enemy, hostilities (whether war be declared or not),
civil war, rebellion, insurrection, mutiny, military or usurped power, violence
occurring in any assembly or demonstration, civil commotion, riots, strikes,
military or popular uprising and terrorism.
b. Suicide, attempted suicide (whether felonious or not, sane or insane), hernia,
alcoholism, intoxication, drugs, intentional self-injury, insanity, diseases or
infections (except pyogenic infections which shall occur through an accidental cut
or wound).
c. Poison or any poisonous substance accidentally or otherwise taken,
administered, absorbed or inhaled.
d. Earthquake, volcanic eruption or tidal wave.
e. Industrial workers using woodworking or heavy machinery (e.g. bulldozers,
cranes, graders and the like), aircrew or non-fare paying aviation passenger (e.g.
pilot, aircraft technician, air stewardess), naval, military, police or airforce service
personnel, including armed security guards, civil defense personnel (e.g. fire
fighters) other than those in peace-time reservist training, Construction workers /
unskilled workers, ship crew or blue-collar workers on board vessels, stevedores,
shipbreakers, occupations involving diving, or work at an oil and gas rig and/or
onboard offshore vessel or platform (e.g. oil bunkering, kelong fishing),
occupations involving working in the risky places high above the ground,
occupations involving handling hazardous chemicals / electricity (e.g. electrician,
welders), racing-related activities or organizations, such as professional sports
teams.
f. Any weapon or instrument employing atomic fission, radioactive force, whether in
time of peace or war.
g. Performing or attempting the performance of an unlawful act.
h. Engaging in or performing any exhaustively physical, extraneous or hazardous
sports or activities. Extraneous and hazardous activities/sports is defined under
this Policy as, any activity that involves chance or adventure increasing peril or
putting at risk and in jeopardy the life of an insured person. While exhaustively
physical activities are those activities that excessively require intense physical
effort. This includes professional athletes, acrobats, extreme sportsman,
automobile racing drivers, stuntmen, aviators, boilermen, explosive makers,
sawmill workers, loggers, and the like.
i. Murder and assault or any attempt thereat.
j. While riding a two-wheeled Motorcycle without a crash-helmet or a valid driver’s
license.
2. Death, disablement or bodily injury, occurring while the insured is traveling in an aircraft
other than the one licensed for public passenger service. Operated by a regular airline
on a published scheduled flight over a regular air route between two definitely
established airports in which the insured is traveling as a ticket-holding passenger.
3. Death, disablement or bodily injury consequent upon the insured engaging in hunting,
racing of all kinds, steeple chasing, polo playing, mountaineering, winter sports, ice
hockey, football, yachting, or using wood working machinery driven by mechanical
power, as a type of sport hobby or for any other purposes.
4. Death, disablement or bodily injury, consequent upon the insured engaging in the
making or handling of explosives.
5. Death, disablement or bodily injury occasioned by or happening through pregnancy or
childbirth.

WAR AND TERRORISM EXCLUSION


Notwithstanding any provision to the contrary within this insurance or any endorsement hereto
attached, it is agreed that this insurance excludes death, injury, illness, loss, damage, cost or
expense of whatsoever nature directly or indirectly caused by, resulting from or in connection
with any of the following regardless of any other cause or event contributing concurrently or in
any other sequence to the loss;

1. War, invasion, acts of foreign enemies, hostilities or warlike operations (whether war be
declared or not), civil war, rebellion, revolution, insurrection, civil commotion assuming
the proportions of or amounting to an uprising, military or usurped power; or
2. Any act of terrorism
For the purpose of this endorsement, an act of terrorism means an act, including but not limited
to the use of force or violence and/or the threat thereof, of any person of group(s) of persons,
whether acting alone or on behalf of or in connection with any organization(s) or government(s),
committed for political, religious, ideological or similar purposes including the intention to
influence any government and/or to put the public, or any section of the public, in fear.
This endorsement also excludes death, injury, illness, loss, damage, cost or expense of
whatsoever nature directly or indirectly caused by, resulting from or in connection with any
action taken in controlling, preventing, suppressing or in any way relating to (1) and/or (2)
above.
If the Insurer alleged that by reason of this exclusion, any loss, damage, cost or expense is not
covered by this insurance the burden of proving the contrary shall be upon the Assured.
In the event any portion of this endorsement is found to be invalid or unenforceable, the
remainder shall remain in full force and effect.

PAYMENT OF DOCUMENTARY STAMP TAX WARRANTY


It is hereby understood that upon the issuance of the policy, no Documentary Stamp Tax will be
refunded as a result of the cancellation or endorsement of the policy or reduction in the premium
due for whatever reason outside of the month of the issuance of the policy.
