JUDICIAL AFFIDAVIT

I, IRENE OCAMPO, of legal age, single and resident of

Nasipit, Talamban, Cebu City, hereby state that I am submitting
the following statements to serve as my direct testimony in the
instant case. It is being offered (1) to prove that respondent
Eduardo Buenavista engaged in illicit affairs with other women; (2)
to describe the relationship between petitioner and respondent; (3)
to identify relevant documents; (3) and for such other relevant
purposes.

The following examination was conducted by Atty. Emelie

Marie Diez at the latter’s office at Capitol Site, Cebu City, to wit:

1. Q: Please state your name, age, residence, and occupation.

A: I am Irene Ocampo, 30 years old, and resident of Brgy.
Nasipit, Talamban, Cebu City. I am a second lieutenant at the
Philippine Army.

2. Q: What is the purpose of this examination?

A: I am here to give my testimony about the unfaithfulness of
Eduardo Buenavista to his wife.

3. Q: For the record, please state the name and address of the
lawyer who is now conducting your examination.
A: Atty. Emelie Marie Diez at the latter’s office at Capitol
Site, Cebu City.

4. Q: In what language do you prefer your examination to be
conducted?
A: English, ma’am.

5. Q: Do you undertake to answer the questions to be asked

of you, fully conscious that you will do so under oath, and
that you may face criminal liability for false testimony or
perjury?
A: Yes.

6. Q: Let us now proceed. Do you know the parties in this

case, namely: Claudia Zalameda-Buenavista and Eduardo
Buenavista?
A: Yes. I am a close friend of both. We were also workmates
at the Philippine Army Headquarters at Fort Bonifacio,
Taguig, Metro Manila.

7. Q: Specifically, how long have you known Claudia

Buenavista?
A: We became workmates for 5 years but I have known
Claudia way back in college. We are very close, in fact I
consider her as one of my closest friends. We are really close
to each other, so much so that she even tells me her personal
problems.

8. Q: How about Eduardo Buenavista?

A: I’ve known Eduardo since we were kids because we were
neighbours before. We went to the same school since
kindergarten until high school. Thereafter, we went to
different training school. It was only when I started working
in the Philippine Army that we meet again.

9. Q: How would you describe the relationship of Eduardo

and Claudia.
A: The two engaged in a whirlwind romance, and after a
short courtship of four (4) months, they officially became a
couple. Being close to Ed, I personally know how he is with
girls. I advised Claudia to really think through if she really
wanted to have a relationship with Ed.

10.Q: What do you mean when you mentioned that you know
how Eduardo is with girls?
A: I know that even before girls are really attracted to
Eduardo. I even remember when we were still in Grade 2, he

 already had a girlfriend. And then in high school, he would
have two relationships at a time and it reached to a point that
the girls would quarrel and cry over him. When I started
working in the Philippine Army, he was still the same
Eduardo I knew- always flirts with girls, and does not take
relationships seriously.

11.Q: And did you tell Claudia about this?

A: Yes, I told Claudia about this. Apparently, I noticed that
she was so infatuated with Ed. She told me that she knows
what she is doing and that even if Ed was like that before, he
is already a changed man.

12.Q: And then what happened next.

A: Claudia and Eduardo eventually became a couple.

13.Q: How would you characterize the relationship of Claudia

and Eduardo?
A: During the first months, I observed that the two were very
happy and affectionate to each other.

14.Q: Did that kind of relationship last?

A: No. Actually, after about one (1) or two (2) months, the
two would quarrel frequently even in front of friends or
officemates; at times when Eduardo can’t get a hold of
himself, he would yell at Claudia in front of many.

15.Q: What did Claudia do?

A: Claudia would just walk out. And the following day she
would confide to me their problems. She would tell me that
Eduardo is cheating on her and that he is having an affair
with their other officemate.

16.Q: Is there any basis about this suspicion.

A: Yes, because during outings, I observed that Ed is intimate
with other women even if Claudia is around. He would talk
to other girls, drink with them and laugh out loud even when
Claudia is around. It even reached to a point that Eduardo
leave Claudia alone and join with our other officemates to
party.

17.Q: You mentioned that Eduardo is intimate with girls

whenever Claudia is around, can you recall a specific
occasion showing this?

 A: Yes. It was during our homecoming. I observed that
Eduardo would flirt with Jessica, an officemate who is
rumoured to have a crush on Ed.

18.Q: Do you have any proof about this?

A: Yes, I was able to take a photo of them because I sent it to
Claudia. A copy of a photo is attached and marked as Annex
“A”.

19.Q: How did Claudia respond to these actuations?

A: Claudia ended her relationship with Ed several times, but
they would eventually get back together; until I found out
that they were getting married because Claudia was
pregnant.

20.Q: and then what happened next?

A: I thought the marriage will be called off but it actually
pushed through. Claudia resigned from work. From time to
time I would call her and check how she’s doing. Since I was
assigned to the same places where Eduardo is also deployed,
Claudia would also ask me about her husband and how he’s
doing.

21.Q: And how did you respond?

A: I told Claudia that her husband is having relationships
with other women.

22.Q: How can you say that he is having a relationship?

A: Because they would hold hands in public, they are so
touchy and the woman would even visit our site and bring
food for everybody, and the woman and Eduardo would
spend so much time with each other especially during our
free time.

23.Q: After knowing this, what did you do?

A: I confronted Ed about it but he just denied that he is
having an affair and that they were just talking and that he
was just being cordial.

24. Q: Do you have any proof about this?

A: Yes, I was able to take a photo of them, while we were on
a boat. I even sent a copy of the picture to Claudia. A copy of
the photo is attached herein and marked as Annex “B”.

25.Q: Was this incident ever repeated?

 A: Yes, in fact on two different occasions. The first was when
we were deployed to Pampanga. There I saw Ed with a
woman clinging to him. I even saw them kissed. I did not
approach them and just decided to walk in another direction.
The same with the last incident, I took a photo of them
because I planned to send it to Claudia. A copy of said photo
is attached herein and marked as Annex “C”.

26.Q: And what was the second instance?

A: The second instance was when we were assigned to Tawi-
Tawi. There I saw Ed again with another woman along with
with two kids. It was a Sunday morning, so most of us in the
army decided to attend the mass. The place where we were
assigned was just a small community and everybody knows
everyone. It was just a small church so I was really able to see
and confirm that it was Eduardo. I even heard the children
call him papa.

27.Q: Is there anything that you would want to add?

A: I have nothing to add sir.
