INTRODUCTION
The Part II Professional Examination is an evaluation of your professional ability
to respond to situations which you will face during the course of your career as @
Professional Architect.
Your approach to situations put to you should therefore be as though you arc
Professional Architect in real-life, responding to problems, queries and complaints
from clients, consultants, contractors and other parties related to the building
industry.
INSTRUCTIONS
Candidates are advised to read all instructions and questions carefully. You are
given fifteen (15) minutes to read the questions.
YOU ARE REQUIRED TO ANSWER ALL QUESTIONS. Please note the marks
assigned to each section of the question and prepare your answers accordingly.
‘The number, and where applicable, the sub-number of the questions must be
clearly stated on your answer scripts. A new sheet of answer paper must be
used for each question.
Candidates may answer questions in accordance with the practice and regulations in
the respective regions in Malaysia where they received their practical training.
However candidates are required to state the relevant By-Laws or Building
Regulations that they are referring to.

‘What are the basic rights accorded to a Professional Architect to practise
architecture under the Architects Act 1967?

State the procedures required to register as a Professional Architect and also
to start a practice after passing the Part III Professional Examination.

‘As an employee, you have been the Project Architect for a large project
comprising 3 phases known as Plots A, B and C. Plot C is nearing
completion and the owner has indicated he will engage you as Architect for
Plots A and B provided you leave employment and start your own practice.

A potential client of yours in Shah Alam, Selangor owns 3 plots of agricultural land
as follows:

Plot B (2.747 acres) ~ Local Plan zoning — residential
Plot C (18.03 acres) ~ Local Plan zoning — residential
On Plot A, he intends to build a 400-room hotel, a 15-storey office tower, a S-storey
podium of commercial and car parking with 2 levels of basement floors. He plans to
sell each parcel with separate titles.
On Plot B, he intends to build a 15-storey apartment block which consists of a 3-
storey podium with facilities and car parking and 2 levels of basement car parks for
residents.
On Piot C, he intends to build 3-storey terrace houses and 3-storey town houses.
He seeks your professional advice relating to the land matters and planning process.
(2) Explain to him the process and the relevant provisions under the National
Land Code, 1965 (Act 56) if he decides to go ahead with his intentions.

apartment tower block, an office tower, a four (4) storey podium containing shops
and office lots and a 3 level basement car park.

Three (3) acres of condominium parcel containing 2 tower blocks with basement car

Six (6) acres of gated and guarded landed residential units
(a) New Co Sdn Bhd is targeting to launch and sell all the components of Parcel 1
as soon as is legally possible and have sought your advice on their intentions
and asked if an Advertising Permit (AP) is required.
Comment on what the law allows and when it is appropriate for them to launch
each component.

(b) For Parcel 3, New Co Sdn Bhd’s marketing department has given you a free
hand to finalise the design brief as long as it comprises of terrace houses, semi-
detached and detached landed units with some manner of management control
over the development after handing over.
Discuss the alternatives available in terms of development concepts listing the
salient features including limitations of each alternative with respect to nature
of ownership, sustainability of character of development, ownership of
communal facilities (e.g clubhouse) and subsequent sale of units and delivery
period limitations.
