BENET WasnaTon, oc: AGRICULTURE inion ano FonesTaY Wnited States Senate : ramet WASHINGTON, DC 20510-0609 HEALTH, EDUCATION, LABOR, et " February 15, 2017 Mr. Donald MeGahn White House Counsel The White House 1600 Pennsylvania Avenue Washington, DC 20500 Dear Mr. MeGahn: I write to inquire about the White House’s efforts to minimize conflicts between the Pres and The Trump Organization, According to the White Paper published by the President’s attorneys on January 11, 2017 (hereinafter, “the White Paper”), the President “will be completely sequestered from any information regarding the Organization’s decisions.” The White Paper further states that the President’s sons and The Trump Organization's CFO, Allen Weisselberg, “will have the authority to manage The Trump Organization and have full decision-making authority for the duration of the Presidency, without any involvement whatsoever” by the President, Finally, the White Paper asserts that the President “will not share nonpublic information with The Trump Organization or the Trust, and the Trust will not make use of any nonpublic information, from any governmental source, to engage in financial transactions on the Company's behalf.” To clarify how the Administration intends to implement the goals set forth in the White Paper, it ‘would be helpful to have answers to the following: ‘* Has the Administration developed any policies that prohibit employees from The Trump Organization from communicating with either the President or members of his staff? * How does the Administration ensure that the President “will not share nonpublic information with The Trump Organization,” including his sons? How will the Administration prevent the President or any member of his staff from discussing the management of The Trump Organization with any of its employees—particularly his two sons? ‘* Conversely, what steps is your office taking to ensure that the President's sons will not influence the Administration’s policymaking decisions in a manner that would benefit ‘The Trump Organization? «Has the Administration prohibited contact between employees of The Trump Organization and all federal agencies pertaining to either rulemaking or enforcement actions? ‘* Does the White House maintain and monitor visitation, phone, or e-mail logs that track communications between the President, his staff, and employees of the Trump Organization to ensure they are not sharing nonpublic information? + In light of recent revelations involving former National Security Advisor Michael Flynn, does the White House have a plan to provide an accurate accounting of national securi communications between either the President or his staff and foreign nationals? * Does the White House intend to make visitor logs available online to the public in a timely manner to provide some transparency regarding meetings between the President and his staff and outside officials and organizations? 1 believe the current ethics arrangement between the President and The Trump Organization— even if fully enforeed—is wholly inadequate and may undermine the effective functioning of our democratic institutions. Nonetheless, I hope your office can provide more clarity on how this proposed arrangement is being implemented so the American people can have confidence that the Administration is working on their behalf and not to enrich The Trump Organization, If your office is unable to address these gaps under its current ethics arrangement, the Administration must work to create a more robust firewall between the President and his businesses and brands. recognize how busy you must be right now, but I look forward to your prompt response.
