As the years passed by, Carlo decided to take out an insurance on Bianca s life for P1,000,000.00 with him (Carlo) as sole beneficiary, given that he did not have a steady source of income and he always depended on Bianca both emotionally and financially. During the term of the insurance, Bianca died of what appeared to be a mysterious cause so that Carlo immediately requested for an autopsy to be conducted. It was established that Bianca died of a natural cause. More than that, it was also established that Bianca was a transgender all along a fact unknown to Carlo. Can Carlo claim the insurance benefit? (5%) Answer: Yes, because Carlo has an insurable interest on the life of Bianca, he qualifies under (b) Section 10 of the Insurance Law..."any person on whom he depends wholly or in part for education or support, or in whom he has pecuniary interest. While it maybe true, that Bianca was a transgender and invalidates their marriage under our Civil Code, the only requirement under our Insurance Law is that Carlo should have "INSURABLE INTEREST". Reference: Sec. 10 Every person has an insurable interest in the life and health: (a) Of himself, of his spouse and of his children; (b) Of any person on whom he depends wholly or in part for education or support, or in whom he has a pecuniary interest; (c) Of any person under a legal obligation to him for the payment of money, or respecting property or services, of which death or illness might delay or prevent the performance; and (d) Of any person upon whose life any estate or interest vested in him depends.
