Mr. President, members of this August body, people in the gallery, to all
davaoeos, friends, ladies and gentlemen, Good Morning.
I rise today as a matter of privilege.
Recently, a bus collided head-on a tricycle in front of Task Force Davao Check
point in Sirawan, Toril District, Davao City. This collision instantly killed the
two men who were riding the tricycle. This is not the first incident that
happened involving tricycle accident specifically in highways. Unfortunately,
it does not look like it will be the last.
According to Section 71, Article J Franchise on the Operation of Motorized
Tricycles-for-Hire, Chapter IX of the Code of Ordinances of Davao City:
Section 71: Prohibition on Operation. For Safety reasons,
Motorized tricycles-for-hire are prohibited to operate on national
highways utilized by four-wheel vehicles greater than 4 tons and
where normal speed exceeds 40 km per hour. However, the MTH
Regulatory Board may provide exceptions, if there is no other
alternative route.
Despite this prohibition, why is it that we still see tricycles plying our
highways? It is because there is a lack of public transportation in certain
areas and one example is the route from Toril to Sta. Cruz. How can we hope
to stop this kind of vehicular accidents form happening again if we cannot
provide enough public transport?
With this, Mr. President, I would like to pass a Resolution urging the Traffic
Management Center and the PNP Highway Patrol to strictly implement
Section 71 of the Regulations on Business or Trade Activities prohibiting
Motorized tricycles-for-hire (MTH) from operating on our Highways. I would
also like to pass a resolution urging the Land Transportation Franchising &
Regulatory Board (LTFRB) to open a new jeepney route franchise from
crossing Baracatan to Toril Poblacion.

Moreover, Pursuant to Sections 447 (3) (VI) and 458 (a) (3) (VI) of the Local
Government Code, Municipalities and Cities are granted to have power over
tricycles to regulate their operation and to grant franchises for the operation
thereof within their respective territorial jurisdictions.
and under the Guidelines issued by the Department of Transportation and
Communication (DOTC), as reiterated under Department of Interior and Local
Government (DILG) MC Nos. 2011-68 and 2007-01
