Firearms and Explosive Office Explosive Management Division
1. To supervise, control and monitor the
importation/exportation, manufacture,
dealership, ownership, sale, transport and use
of explosives, blasting agents, explosive
ingredients and other explosives materials.
2. To supervise, control and monitor the
manufacture, dealership, purchase and sale of
firecrackers and pyrotechnics and their
ingredients.
3. To support PNP units and other law
enforcement agencies in the operation and
investigation of explosives related cases.

4. To formulate rules and regulations
pertinent to laws relative to explosives,
firecrackers and pyrotechnics,
explosives ingredients and other
explosives materials.
5. To conduct education on explosives
laws, rules and regulaton.

In
consonance
with
the
compliance
to
the
recommendations presented during the National Explosives
Control Summit (NECS) held at Camp Crame in July 2011 and
the directive of the President to monitor the proliferation of
Improvised Explosives Devices (IEDs) through the illegal use
of industrial and commercial explosives, the Firearms and
Explosives Office (FEO) through Explosives Management
Division (EMD) had made significant strides in pursuit of its
mandates to supervise, regulate, monitor and control the
possession, manufacture, dealing in, acquisition or disposition
of firearms, ammunition or explosives or instruments used in
the manufacture of firearms, ammunition or explosives.

Explosives provide a source of
concentrated energy that can be utilized in
many ingenious ways. The most common use
for legal and lawful public or private use are in
mines, quarries, road construction, wrecking
bridges, etc. The utilization of explosives even
in small amount depends on specialized
techniques and skills should be attempted only
by experienced and qualified personnel.

LAWS GOVERNING THE
LICENSING OF
EXPLOSIVES/EXPLOSIVE
INGREDIETS
(PD 1866, RA 8294 & RA 9516)
Firearms and Explosive Office Explosive Management Division
Under PD 1866 as amended by RA 8294 all
explosives and explosives ingredients are
licensed by the Philippine National Police.
With the advent of Executive Order 522, it
provides specific guidelines for the regulation
of 68 substances/chemicals controlled by
PNP classified as Nitrates, Chlorates and
Nitric Acid.

"With the amendment of Sec 3 & 4 of PD 1866,
Sec 4-D, of RA 9516 the types of
Chemicals/Accessories Covered Exclusively
refer to Chlorates, Nitrates, Nitric Acid and
such other chemicals and accessories that
can be used for the manufacture of
explosives/explosive ingredients.

SEC. 4-C. Authority to Import, Sell or Possess
Chemicals or Accessories for Explosives. - Only
persons or entities issued a manufacturer's license,
dealer's license or purchaser's license by the
Philippine National Police (PNP)-Firearms and
Explosives Division may import any of the chemical
or accessories that can be used in the manufacture
of explosives or explosive ingredients from foreign
suppliers, or possess or sell them to licensed
dealers or end users, as the case may be.

Amending Section 3 and 4 of Presidential Decree 1866.
The penalty of reclusion perpetua shall be imposed
upon the owner, president, manager, director or
other responsible officer of any public or private
firm, company, corporation or entity, who shall
willfully or knowingly allow any explosive or incendiary
device or parts thereof owned or controlled by such firm,
company, corporation or entity to be used by any person
or persons found guilty of violating the provisions of the
preceding paragraphs.

CONTROL MEASURES IN THE USE OF EXPLOSIVES
The PD/CD/I & E should conduct spot checks on the
operation and provide close-in-guarding to prevent any
deviation, pilferage or any other illegal use of
explosives/explosive ingredients
Every owner/operator of mine, quarry or other industry
must have a purchasers license and all employees who
are charged with the custody, distribution and use must
have a foreman blaster license.
Designate Responsible officer in the command to act as
witness of all expenditures and used without the presence
of this officer

CONTROL MEASURES IN THE USE OF EXPLOSIVES
Explosive ingredients used as fertilizer, flower inducer
and other agricultural purposes maybe sold to farmers
without permit to possess issued by the C, PNP
provided their purchase is limited to 50 KGS ONLY and
that they will get authorization to purchase from the
Chief of Police.
Nitric acid which be used by schools and other similar
institution for laboratory purposes shall likewise be
limited to ONE (1) LITER ONLY and be sold to buyers
with out permit from C, PNP but secure authorization to
purchase from the Chief of Police in their locality.

1. Local Purchase
- Is made by any person or entity with existing license to possess
explosives/explosive ingredients issued by the C, PNP who/which
desires to purchase the same locally.
2. Importation and Unloading
- Is made by any person or entity licensed to manufacture, deal or
purchase explosives/explosive ingredients abroad.
- Application to import explosives/explosive ingredients maybe filed
in quantities based on the latest monthly report (stock on hand)
minus the given quantity in the license for 1 year. However,
licensee/importer should schedule the importation of
explosives/explosive ingredients in such a way that shipment shall
not exceed the authorized quantities in its license to include stock
on hand upon arrival of shipment

3. Transport/Movement/Shipping
- any movement of explosives/explosive ingredients
from the port of manila or one province to another or
within the same province but
from 1 licensee to
another.
No movement or delivery of explosives/explosive
ingredients from the dealers magazine shall be made
without the corresponding escorts to be provided by the
Provincial Director/City Director concerned if movement is
done within the same region.
However, if movement/transport of
explosives/explosive ingredients transcends from one
region to another or within Metro Manila, escorts shall be
provided by EMD, FEO in addition to the escorts or
guards to be provided by the dealer.

4. Storage
Magazine- any building or structure, other than the
explosive manufacturing building itself which is used for
the storage of explosives located, protected, constructed
and managed so as to guard them against pilferage,
accidental explosion and to prevent injury to persons or
damage to properties
Types of magazine
1. Main Magazine fixed magazine- primary depository
of explosives/explosive magazine from where these
materials maybe withdrawn and/or transported to
another magazine.
- Provided with strong double padlock 1 for the
licensee 1 for the PNP rep
- Provided with double fence 8 ft with barb wire not
more than 6 inches;

2, Issuing Magazine depository of explosive good for
one day only
NOTE: There should be at least 3 magazines
1 magazine exclusively for detonators
1 magazine for high explosives/detonating cords and
1 magazine for blasting agents
Potassium Chlorate, Ammonium Nitrate, Potassiu
Nitrate, Sodium Nitrate which are controlled pursuant to
EO 522 shall be stored in a warehouse constructed of
Strong materials, safety locked and should accommodate
the quantities in the approved license.

Sec 8 All licenses for explosives/explosive ingredients not
renewed within one (1) year shall be automatically revoked
unless the licensee can justify the delay was due to
circumstances beyond his control, the justification in all
cases should be approved by the C, FEO, CSG.
PROCESSING OF APPLICATION
The Provincial Director or City Director upon receipt of
application shall check the completeness, authenticity and
validity of the requirements submitted.

and general business of gunpowder, dynamite, explosives or their ingredients.
PURCHASERS LICENSE
License authorizing the purchase and possession of high explosives,
initiating explosives systems, or their ingredients.
FOREMAN BLASTERS LICENSE
License authorizing the use and possession of high explosives, initiating
explosives systems or their ingredients by a person.

If Single Proprietorship, DTI Registration, Business Permit
and Certificate of Capital invested in the business from
the City or Municipality Treasurer.
5. Original Clearances: (Court, Mayor,
Police, NBI)
6. Personal History Statement or Bio- Data.
7. PNP Form No. 6 duly accomplished.
8. Original Special Bank Receipt (LBP)

PERMIT TO EXPORT
Permit authorizing the sale, transfer or movement of explosives / explosive
ingredients from the country to foreign purchasers.
PERMIT TO UNLOAD
Permit authorizing the unloading of explosives /explosive ingredients from
Port or NAIA to magazine.
PERMIT TO PURCHASE & MOVE
Permit authorizing dealers, manufacturers or purchasers to acquire
explosives / explosive ingredients from local source based on existing stock.
(Valid for non-extendable of 60 days)
SPECIAL PERMIT TO PURCHASE & MOVE
Permit issued to any person/entities desiring to purchase the
explosives/explosive ingredients locally for a small amount and will be for one time
use only.
