ABSTRACT: This article aims to delimit which matters are susceptible of arbitration in disputes with public entities, considering the Brazilian legal system. At the outset, the criteria proposed by the literature, for the interpretation of the legal parameter, are critically analyzed. Then, a formula is proposed to operationalize the one that seems most appropriate. At this point, it addresses the powers of the arbitrators to appraise previous inarbitrable questions necessary for the composition of the patrimonial and disposable conflicts submitted to them by the parties. Abstract: This article analyzes the enforcement of arbitral awards adverse to public bodies. Firstly, it will be studied the possibility of spontaneous compliance with these decisions. Thereafter the applicability of the " precatório " system and other execution techniques will be examined. At last, it will be debated the possibility of enforcement in Brazil of foreign arbitral awards and the foreign execution of arbitral awards rendered in Brazil.
Abstract: This article analyzes how other legal systems address the participation of public entities in arbitration procedures. Based on that diagnostic, the tendencies will be verified and the lawmaker role of international arbitrations will be studied. At last, it will point out objective propositions to improve the regulation of the subject under Brazilian law.
Abstract: This paper addresses, centrally, the Courts of Auditor's role in suspending illegal public contracts. It also analyzes this external control instrument according to the Institutional Capacities doctrine, to its teleological element and to its legal standards. The article also discusses the Courts of Accounts' institutional position and the restraining act's nature. Based on the Implied Powers Theory and on the substantive due process of law principle, we will examine at last the legal possibility of the Court of Auditors apply other injunctions similar to the contractual restraining.
Ademais, defender-se-á que a constitucionalidade das normas municipais depende de sua cumulativa compatibilidade com a Constituição Federal, com a Constituição do Estado envolvente e com a Lei Orgânica do Município respectivo – cujo status constitucional será também defendido. Ao fim do artigo, trata-se, com especial profundidade, justamente das ferramentas de tutela da supremacia da Lei Orgânica do Município, tema particularmente negligenciado pela doutrina.
Abstract: The scope of this research is to adress procedural issues about the ineligibility for hiring with the Government – as one of the applicable sanctions under Brazillian Law to the acts of administrative misconduct. Therefore, it is expected to clarify issues of little doctrinal elaboration or intense jurisprudential controversy, in order to ward off some excesses and to correct some technical faults in the legal management of the prohibitive measure – with the view to promoting the legal certainty, the preservation of the companies and the proportionality of reprimands imposed by the state.
