Definitions

The terms “I”, “me”, and variations thereof refer to “Freya Yuki”. The terms “you”, “your”, and variations thereof refer to the buyer, blogger, or the person who is using any one of Freya Yuki’s themes.

Overview and acceptance of these terms, rules, and conditions

By using any one of Freya Yuki’s themes, you agree to abide by the following terms, rules, and conditions.

You hereby acknowledge that you have read or will read the entirety of this document and that you agree to follow and comply with all the terms, conditions, and rules outlined in this document. By using any one of my themes, you are hereby bound by the terms, rules, and conditions laid out in this document.

If you disagree with any part of the terms, rules, and conditions outlined in this document, then you are not authorized to use any one of my themes.

For free themes:

• You can use these free themes without having to pay anything, but you are welcome to support me by buying me a coffee or purchasing one of my paid themes

For paid themes:

• You must buy or purchase a license if you want to use any one of these paid, premium themes
• If you do not buy or purchase a license, then you cannot use any one of these paid, premium themes

Personal use only

Any one of these themes, whether free or paid, is for personal use only. This means you are not allowed to sell, resell, redistribute, give away, copy, steal, reproduce, or duplicate any one of these themes, whether free or paid, even if you have made changes or tweaks to any one of these themes.

However, you can use any one of these themes, whether free or paid, on any one of your blogs even if you are using your blog for commercial purposes. For example, if you have ads on your blog, or if you’re selling your artwork on your blog, then you can still use any one of these themes, whether free or paid.

Themes License

By purchasing any one of my paid themes or using any one of my free themes, you are hereby granted a worldwide, non-exclusive, royalty-free, and revocable license to use the purchased paid theme or the free theme subject to the terms, rules, and conditions outlined in this document.

Whether you’re using a free or paid theme, You CAN:

• Use the theme on any one of your blogs
• Use the theme as many times as you want
• Customize or make minor changes or tweaks to the theme

Whether you’re using a free or paid theme, You CANNOT:

• Remove, alter, change, move, replace, hide, or delete the credits on any one of these themes
• Claim ownership of any one of these themes
• Steal, copy, reproduce, or duplicate any one of these themes or any one of the designs used on any one of these themes
• Sell, resell, license, sub-license, rent, or redistribute any one of these themes even if you make changes to it
• Make changes to any one of these themes in such a way that they are no longer recognizable as my work
• Use any one of these themes as a base template or as a base for new creations
• Steal or copy any of the codes on any one of these themes and use it on other themes (Note: if you’re using the resources, materials, frameworks, or tools that may have come with any one of these themes, then the licenses of these resources, materials, frameworks, and tools will apply)
• Commission, pay, or ask other designers, developers, or theme makers to recreate any one of these themes and their respective designs (Note: if you want a custom-made theme, you can contact me here for more info)
• Use any one of these themes for or in connection with unlawful, illegal, harmful, or fraudulent purposes or activities

Extended License

If you want to remove the credits on any one of these themes, whether free or paid, then you will need to purchase an extended license. You can buy an extended license here. You can check out this post for more details.

Note: purchasing an extended license only lets you remove the credits link. The rest of the rules, terms, and conditions outlined in this document still applies. Furthermore, the extended license is only available per theme, which means you must buy two extended licenses if you want to remove the credits on two different themes.

Handling of payments and information

I use Gumroad and Sellfy to sell premium themes. These sites are the ones who will handle your payment information. As such, I do not store or have access to any one of your payment details.

No transfer of rights

The license which allows you to use any one of these themes, whether free or paid, does not transfer any intellectual, property, and other such rights to you. All intellectual, property, and other such rights will still belong to and remain solely with me.

No warranties

These themes, whether free or paid, are provided as-is, and there shall be no representations or warranties of any kind, expressed or implied.

Limitations of liability

I am not and cannot be held liable or responsible in any way, shape, or form for the way in which you use any one of these themes, whether free or paid, or any one of the content you put, post, or publish on your blogs. Under no circumstances or in no event can or shall I be held liable for any loss of content on your blog or any other loss you might suffer. This loss includes, but is not limited to, any indirect, incidental, special, or consequential loss as well as any business loss, loss of revenue, income, profits, or anticipated savings, any loss of contracts or business relationships, any loss of reputation or goodwill, or any loss or corruption of information or data. It is your sole responsibility to always back up your content and blogs as well as take any other step or procedure that is necessary to ensure any loss is prevented. These limitations of liability will apply even if I have been expressly advised of the potential loss.

Indemnification

You shall and you hereby agree to indemnify, undertake to keep me indemnified, and hold me harmless from and against any and all losses, liabilities, damages, settlements, costs, assessments, charges, and expenses including, without limitation, any legal expenses or attorney’s fees incurred or suffered by me arising out of any breach by you of any one of the terms, conditions, and rules outlined in this document, or arising out of any claim that you have breached any of the terms, conditions, and rules outlined in this document, or any use by you of any one of my themes, whether free or paid.

Unless stated otherwise, all themes are copyright to Freya Yuki. All rights reserved. Selling, reselling, redistributing, or stealing any one of these copyrighted materials or intellectual property is expressly forbidden.

Failure to comply with the terms, rules, and conditions outlined in this document will result in actions being taken against you including, but not limited to, bringing court proceedings against you.

Resources, materials, frameworks, or tools that belong to other people and parts of which may have been used to create a theme or that come with the theme will be listed on the Credits page of each theme. The licenses of these resources, materials, frameworks, and tools will be included with each theme purchase. These licenses will only apply to these resources, materials, frameworks, and tools. Your use of these resources, materials, frameworks, and tools will be governed by the terms, rules, and conditions laid out by the creators of these resources, materials, frameworks, and tools, not by the terms, rules, and conditions outlined in this document.

Unenforceable provisions or severability

If any provision outlined in this document is or is found to be unenforceable under applicable law, then this will not affect the other provisions outlined in this document. These other provisions will still be enforceable.

Support

I provide support for all of my themes. I will help answer questions pertaining to or related to the setup or installation of any one of these themes. Any possible bugs or anything that might not be working correctly will also be fixed to the best of my ability. However, making heavy customization or edits to any one of these themes is not included, is not covered, and does not come with this provided support. Furthermore, I reserve the right to reject any request for support for any or no reason, including, but not limited to asking for heavy customization or edits to any one of these themes.

Entire agreement

This document, together and along with the Terms of Use for this blog, the Privacy Policy, the Disclaimer, and the Disclosure, constitutes the entire agreement between you and me in relation to your use of this blog and my themes, whether free or paid, and supersedes all prior and previous agreements and understandings between us in respect to your use of this blog and my themes, whether free or paid.
