Gypsy-Rose Blanchard's estranged husband Ryan Anderson says the paternity of her unborn child still needs to be determined.

Anderson, 38, revealed during a TikTok livestream on Saturday, Aug. 10, that he has to take a DNA test following Blanchard’s pregnancy news, which is part of the procedure to establish paternity for separated couples who are still married under Louisiana state law. His social media announcement comes after Blanchard, 33, and her new boyfriend Ken Urker announced earlier the same day that they are expecting a baby girl together.

“I have to get a DNA test. I don't have a choice,” Anderson said. “... I hate being in this situation.”

“I have to take a DNA test for court,” he explained. “The way the timeline matches up — I don't think it's mine, but I don't know. The DNA test is going to prove it. Crazier things have happened. I just don't know. I have my thoughts and I have my opinions."

Blanchard filed for divorce from Anderson, whom she married in 2022 while in prison, in April. She and Urker announced that they're expecting their first baby together on July 9.

"You love Ken? Good for you. I'm glad that community loves Ken. Good for that. But hopefully if you are here with me, you are team Ryan," Anderson also said during his livestream.

A Louisiana attorney confirmed to PEOPLE in July that Anderson could be listed as the father on Blanchard's baby’s birth certificate should the infant be born before their divorce is finalized.

This requirement is according to Louisiana law, which states, "If the mother is married to someone other than the biological father when the child was conceived or has been divorced for less than 300 days at the time of birth, the husband/ex-husband shall be the presumed father, unless paternity is established for the biological father."

If Urker wants his name on the birth certificate, Anderson must sign an affidavit saying Urker is the father. If he doesn’t do this, Urker has to file a motion with the courts and the three of them will have to take a DNA test over the child.

Louisiana attorney Beau Brock told PEOPLE in July that the law is put in place "to protect the child” and ensure that “the child has a father and a mother to provide for them.”

"All the laws in Louisiana concerning paternity are designed to protect the child and make sure the child has a father and a mother to provide for them. So that presumption can be overcome by DNA and that's what people have to do," he added.

"If the husband goes and signs the affidavit along with the boyfriend, then the true father, if you will, if it's the boyfriend's name, will go on the birth certificate," Brock explained. "In these kinds of situations, we always recommend to do a DNA test because there are overlapping hookups that are possible. You don't know."

If DNA results prove that Urker is the father, his name will officially replace Anderson’s name on the birth certificate as the baby’s father.

Despite the legal hurdles currently being taken over paternity, Anderson said of Blanchard in his latest TikTok live, “I’m always going to have love for [her].”

"She was my wife and I did marry her, you know?” He continued. Addressing some of the social media hate his ex-wife has received, he added, “If anyone is going to bash her, it should be me. I just don’t get the hate … If I can overlook it and accept the way things are. If I’m not bashing her, why ya’ll need to?”
