Fatal crash witness wrongly arrested for refusing breathalyzer: suit

No good deed goes unpunished.

A woman who witnessed a fatal crash, called 911 and waited at the scene was wrongly arrested for drunken driving by responding cops, she claims in a suit against the city and arresting officer.

Pauline Shepherd, 59, was at the intersection of Farmers Boulevard and 109th Road in Springfield Gardens, Queens, in July when motorcyclist Pastor De La Cruz collided with another vehicle and was killed.

Shepherd claims she called 911 to report the midnight crash and cooperated with police, but, “without any indication that [she] had been involved in any motor vehicle accident or that she had violated any section of the vehicle and traffic law, officers demanded that [she] submit to a Breathalyzer test,” according to Brooklyn Federal Court papers.

She refused and was arrested, spending 15 hours in jail.
