Richard III, Lucrezia Borgia, and Marie-Antoinette might have so much to say if they could only tell what was the collective defamation in the destruction of their personal character. Indeed, all of them endured the ruin of their reputation at the hands of Shakespeare for the first, bad family company for the second, and the ultimate enlightenment pornographic libellists for the third. Today, in order to obtain similar results, we have social networks, but they work in different ways. Indeed, social networks have two innovative elements: the immediacy of information circulation, and the simultaneous possibility of forming groups among their members, who can count and recognize themselves, to act together towards a common goal. This can be positive, for instance crowfunding, aid, organizing a social campaign, or negative: pressuring, bullying, defamati...

These circumstances could lead to lawsuits against hospitals and healthcare professionals: together with Regions and States, they may be vulnerable to legal actions, due to the breach of right to health, to physical integrity and right to life, to the manifestation of the informed consent in the medical field or on the basis of contractual or Aquilian obligations. In this context, predicting the litigation rate could be useful to assess the economic impact of a dispute at a local and national level, so that hospital managers and public institutions can perform multi-dimensional and cost/benefit evaluations to decide whether to invest resources to increase critical care surge capacity. In this work we present CLIP (COVID-19 LItigation Prediction), a modeling approac...

IntroductionIt is a truth universally acknowledged that in comparative law the pattern of judgments is very varied. For instance in civil law systems themselves, such as in France, nowadays, the ideology related to the juge est-il la bouche de la loi, implemented during the French Revolution, justifies the synthetic model of French judgments, showing only hints of the facts of the case and the legal reasoning of the judge. On the contrary, in Germany, according to the systematic and philosophical tradition, judges often describe the complexity of their logical and juridical reasoning. In the Common Law System in the case law method the "direct presence of facts distinguishes reasoning with previous decisions in the 'classical' common law context from reasoning statutes or the constitution" (Komarek, 2013, 157; Siems, 2014, 41), furthermore judges have to detail each logical step according to the distinguishing principle. According to this pattern of judgments it...

Si legge nei suoi diari: «But, ‘Lord!’ how sad a sight it is to see streets empty of people, and very few upon the Change – jealous of every door that one sees shut up, lest it should be the plague, and about us two shops in three, if not more, generally shut up.» (Pepys, The Illustrated Pepys: Extracts from the Diary, Latham, ed., Berkeley, 1983, 88).

The intervention of medicine in human reproduction (contraception, abortion, artificial procreati... more The intervention of medicine in human reproduction (contraception, abortion, artificial procreation) has blurred the boundaries between nature and culture regarding the beginning of human life. This change has led to an unprecedented possibility to increase self-determination, and, therefore, individual responsibility with respect to the choice of giving birth, no longer a gift of God, but a realistic chance to accomplish a wish. This circumstance has opened a debate as to whether or not the right to parenthood and procreation is absolute, and if the person has the right to choose whether or not to conceive. Indeed, the Italian debate is related to two specular aspects of the same issue concerning the alleged absolute inviolability of the embryo: on the one hand, the request of infertile couples to be able to conceive a child through assisted reproduction, including through the use of biological materials external to the couple, subject to rulings of the Constitutional Court, and on the other hand, on the still controversial access to abortion, governed by a law that came into force in 1978, over 40 years ago.

Th... more Wearable devices (WDs) are a specific part of the general concept of the “Internet of Things”. This concept refers to infrastructure in which many sensors are designed to record, process, and store data locally, or interact with each other both in the medium range, through the use of radio frequency technologies (e.g. RFID, bluetooth, etc.), or through an electronic communications network. The devices involved are not only traditional computers or smartphones, but also daily life objects ("things"), such as wearable devices, home automation geo-referencing, and assisted navigation objects. Indeed, the “Internet of Things” refers to a further development of the Internet resulting from physical objects networking. These objects may be equipped with a unique identifier (for example, a serial number), recognizable even by radio frequency. However, the identification of these objects could also be made without resorting to radio tags, simply by combining sensors and automatic recognition procedures (for example, the recognition of a barcode carried out with a mobile phone connected to the Internet).

The current state of research on this issue concerns mainly the use of WDs in daily life, and the enforcement of privacy rules, due to the capacity of WDs for the massive collection of personal data, such as in the health care and labour contexts, both sensitive areas for discrimination.

In a small village in the Italian countryside an elderly person passed away, it is not known whether or not affected by COVID-19, but due to the contagion and the rules that prohibited public, religious or civil cerimonies, the lady's funeral was not able to take place according to the usual ritual and with the collective participation of family members and the local community. The announcement of her death and her leave-taking were given in a completely exceptional way: instead of the usual affiche published by the funeral home and payed by the family, the announcement was made through Facebook, from the mayor's page, in a participatory and emotional tone, with a mixture of secularism and religion: “This morning we gave our last farewell at the cemetary to Ms. XX, aged ..., mother of YX, her home was at …. Her remains were blessed by the priest. The Mayor was there in representation of all those who would have liked to participate, and who were unable since the restrictions for the ongoing coronavirus emergency. The condolences of all our community to the family. The Mayor". Another image that became well-known worldwide concerned the row of military trucks that carried the coffins of the deceased people from the cemetery of Bergamo (one of the most affected places in Italy) to the cremation sites in other regions. These sad episodes show of how much the ban forbidding public funeral of whom passed away was intrusive and affected entire communities, both in countryside villages, and in towns. The farewell cerimonies to deceased is a deeply felt moment, where the communities gather together with the affected family for helping each other to mourne the beloved one who passed away: in fact the burial of the deads is a universal rule. Between 9 March and 4 May 2020, Italian law was very intrusive in this severance, forbidding funerals with criminal penalties. Although the Italian state is increasingly secularized, the farewell cerimonies are still strongly linked to religious tradition, although secular rites are growing. The aim of this abstract is to verify what was the impact in Italy of the interdictive legal rules about funeral ceremonies on the life of people who have suffered individuals and, at the same time, collective mourning.
