This goes hand in hand with Aceh's privileges in implementing Islamic law as stipulated in the Aceh Qanun Number 8 of 2014 concerning Principles of Islamic Sharia. Hence, this research aims to scrutinize the challenges in building Sharia-based investments in Aceh after the enactment of the Qanun of SFI. This study was conducted using normative legal methods with statutory and Sharia economic law approaches. The data analyzed are literature and legal rules such as laws, qanuns, books, and articles related to the discussion. The results of this study indicate that there are several challenges occur in building Sharia-based investments in Aceh. The principle of propriety is contained in Article 1339 of the Civil Code and Article 1365 of the Civil Code. The application of a sas propriety can be seen in the execution of an agreement, where the agreement is carried out based on clausea that has been agreed upon by both parties. In addition, the principle of propriety is also influenced by the teachings of subjective propriety and objective propriety as well as functional propriety.

The result showed that Subsidiaries of Holding Stateowned Enterprises have a different status from State-owned Enterprises and have the same position as SOEs in certain aspects. This is based on Article 2A paragraph (7) of Government Regulation No. 72 of 2016, which states that SOEs Holding Subsidiaries are treated the same as SOEs in terms of (1) obtaining government assignments or performing public services; and/or (2) obtaining special State and/or Government policies, including in the management of Natural Resources, with special treatment certain conditions as applied to SOEs. The laws and regulations in Indonesia recognize various legal forms of companies; however, the le... more The laws and regulations in Indonesia recognize various legal forms of companies; however, the legal form of a Limited Liability Company is considered to have better business prospects. Limited Liability Company also becomes a legal form of a company that can conduct business in all business fields. This condition has led to the practice of changing the legal form of companies in Indonesia from companies with certain legal forms to the legal form of Limited Liability Companies. This change in the legal form of the company is not covered by a special law that can combine the needs of changing the legal form of the company. In practice, this change in legal form is carried out in various ways that may result in legal uncertainty on one hand, and licensing difficulties as a result of a change in legal form on the other hand. Therefore, a new concept that can create legal certainty and ease doing of business in changing the legal form of companies in Indonesia is needed.

Furthermore, the law that guides the implementation of sharia in Aceh does not regulate detail of where the caning can be executed.
