Business licence

The next step of incorporation is establishing a business licence.

Business licenses are permits issued by government agencies that allow individuals or companies to conduct business within the government’s geographical jurisdiction.

A single jurisdiction often requires multiple licenses that are issued by multiple government departments and agencies. Business licenses vary between countries, states, and local municipalities. There are often many licenses, registrations and certifications required to conduct a business in a single location.

FEDERAL LEVEL REGULATIONS

If your business is involved in activities that require the supervision of and regulation by a federal agency – such as selling alcohol, firearms, commercial fishing, etc. – then you may need to obtain a federal license or permit. Here is a brief list of business activities that require a federal licence or permit to operate within the bounds of federal law.

Agriculture

If you import or transport animals, animal products, biologics, biotechnology or plants across state lines, you will need to apply for a permit from the U.S. Department of Agriculture (USDA). You can find more information about applying for such a permit on the offical website.

Alcoholic Beverages

If you manufacture, wholesale, import, or sell alcoholic beverages at a retail location, you will need to register your business with the federal government and obtain certain federal taxation permits with the U.S. Treasury’s Alcohol and Tobacco Tax and Trade Bureau (TTB).

Aviation

If your business deals with the operation of aircraft; the transportation of goods or people via air; or aircraft maintenance, you will need to apply for one or more of the following licenses and certificates from the Federal Aviation Administration:

Firearms, Ammunition and Explosives

If you manufacture, deal or import firearms, ammunitions and explosives you will need to comply with the Federal Gun Control Act’s licensing requirements. This Act is administered by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF). Refer to the following resources from the ATF to make sure your business is properly licensed to sell firearms, ammunitions, and explosives:

Fish and Wildlife

If your business is engaged in any wildlife related activity, including the import or export of wildlife and products derived thereof, you must obtain an appropriate permit from the U.S. Fish and Wildlife Service.

Commercial Fisheries

Commercial fishing businesses are required to obtain a license for fishing activities from the NOAA Fisheries Service. You can find more about permit applications and how to apply for a license at: http://www.nmfs.noaa.gov/sfa/

Maritime Transportation

If you provide ocean transportation or facilitate the shipment of cargo by sea, you will need to apply here for a license from the Federal Maritime Commission.

Mining and Drilling

Businesses involved in the drilling of natural gas, oil or other mineral resources on federal lands may be required to obtain a drilling permit from the Bureau of Safety and Environmental Enforcement.

Nuclear Energy

Producers of commercial nuclear energy and fuel cycle facilities as well as businesses involved in the distribution and disposal of nuclear materials must apply for a license from the U.S. Nuclear Regulatory Commission.

Radio and Television Broadcasting

If your business broadcasts information by radio, television, wire, satellite and cable, you may be required to obtain a license from The Federal Communications Commission (FCC).

Transportation and Logistics

If you operate an oversize or overweight vehicle, you’ll need to abide by the U.S. Department of Transportation’s guidelines on maximum vehicle transportation weight. Permits for oversize and overweight vehicles are issued by your state government.

STATE LEVEL – NEVADA

You will need a State Business License to conduct business within the state of Nevada, and your business may be required to maintain an additional local business license for each Nevada jurisdiction in which your business operates.

State Business License fee and annual renewal fee

The fee and annual renewal fee for a state business license is $150 for Corporations annual list, and $150 for all annual list other business entity types (for example LLC).

The fee and renewal form are due on the last day of the month in which the license was originally filed.

STATE LEVEL – WYOMING

You will need a State Business License to conduct business within Wyoming, and your business may be required to maintain an additional local business license for each Wyoming jurisdiction in which the business operates.

State Business License fee and annual renewal fee

Wyoming has no business license fees. The annual report filling fee is $50, our fee is $15.

LOCAL LEVEL – CHEYENNE

Not all businesses are required to have a business license before doing business in Cheyenne.
